    • Hello, firstly thank you for reading this. I know no one wants a long winded back story. So I’ll be breif. I entered a local store to buy some paint (which I did pay for) I am honestly not a bad person or a theif.   Didn’t have a basket or trolly as was on my lunch break. Whilst picking up the three tubs of paint placed some masking tape in my pocket (it was hanging out of so I had every intention to pay) just didn’t have a hand free. Paid for my goods (forgot about the £4.39 masking tape) I’ve got so much going on and im not well at all (like I say no one cares I get that) also have autism so wasn’t thinking particularly like others do maybe (who knows my minds going around and around) I left the store after paying, was pulled back in by security. Asked for the tape which I gave immediately  shook up. Gave them my ID and details. I was given some paper and told to expect a large fine in the post for their time and the tape and sent on my way. my questions are: I hardly ever go out without support so the ban I guess I can’t go there now for anything (their loss) - ok but is my photo going to be all over with my name? how much am I expecting in the post as a fine? I have sent them cash in the post recorded signed for delivery to arrive tomorrow (incident happened today) for my error. Their Address was on the bit of paper. i have read two posts on this page but they were from many many years ago so I hoped for updated advise please?

    • utter BS, doesn't matter you signed it. pers i'd be writing as per the other threads here rejecting the car as not as described under CRA etc and be done with it. as its a debit card you could also do a full chargeback within 120 days to your bank and simply dump the car back to BMW. 100's of like threads to read here. get your ducks inline. make sure you know what you are doing and off you go. dont take any BS from BMW, no matter what you sign it does NOT remove your consumer rights. p'haps it might be on the off chance you are a good manager , a quick phonecall tomorrow saying you dont want it because (no bla bla fitted) it might be resolved in 5 mins..i will guess to date you not tried

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

****** is right. I was watching him and gave the police a pretty good description. They had been driving round the local 'bad' estate before they came to me. They apparently went as soon as they got the call. Someone had come to mind for them and they rounded up two of his mates but the address they "had on file for him" (which says it all really) was not the right address. Honestly doesn't anyone actually check out that the addresses these scumbags give the police are accurate? Unfortunately there were no fingerprints so he obviously knew what he was doing.

 

My lovely builder came within the hour to change both locks and to board up the window in the door with a thick bit of wood all the way across. I'll get the door changed as soon as I can afford it. It's an almost solid door but with a half circle of glass at the top which is divided into four triangle-ish portions - bog standard front door. It was here when I moved in 16 years ago and unfortunately it's clear if you are a ****** burglar that if you break the glass you'll be able to reach the lock on the the inside. Obviously it never occurred to me, or anyone else who has been here - family, builders, anyone.

 

I am so careful. I always lock the Chubb as well as the Yale even if I am only popping out for five minutes. I have an alarm. I thought alarms boxes were supposed to deter burglers! I've also got a panic button and I'm afraid to say I didn't even think about pushing it. I've never had to use it, and if I heard a noise in the night I'd push it, but obviously the shock froze my brain.

 

My daughter is scared he'll come back and is now in my bed because she doesn't want to be alone - understandably - and I could also murder him for the distress he's caused to her.

 

First thing tomorrow I'm going to the nearest cash for gold place, and I'll call any others and also pawnbrokers. The police say they send out lists, but I bet the people doing that don't work over the weekend, so I'm going to do as many as I can myself. I've trawled the nearest bins and grassy areas for the bag itself - nice bag too, present from my sister - but no sign. I'll go further afield tomorrow.

DD, this is terrible, you would think now that the police would warn people in your area about this type of crime, we had a warning about leaving keys in reach of the doors, some bunch of scumbags were using a telescopic rod through a letter box to fish for anything useful, keys being a particular target.

 

I had a thing hanging in my hall where you put letters and hang keys on but it was easy for my brother to demonstrate he could do it so it was removed round to the other side of the L shape. You can't access

it via the kitchen window which is the nearest.

 

The local leaflet said that the **** were also after letters for ID fraud....

 

I think now everyone reading this ought to check where they leave their keys near the door.

So sorry to hear your news, DD. I really hope your things are recovered; I cannot believe how low **** like this will stoop. My Mum's flat was burgled a couple of years ago, and all they took was an old gold coin that had belonged to my dead sister. It wasn't worth a great deal money-wise, but it was priceless to Mum.

 

I sincerely hope you and your daughter get over the shock quickly, and thank you for the warning. I have to admit to leaving keys in the lock overnight in case of fire - I'll have to have a serious re-think now.

Barclay, taking money from our account when we are already overdrawn,no idea now how we will pay any bills next week even though my JSA is supposed to go in on Tuesday

Get a letter of appropriation to them pronto Bobcat. Just do a search on the site and you should find one.

 

You might have to be quite firm with them, but they should pay your bills rather than themselves!!

Hearing that car fuel prices will be going up again in August by as much as 15p per litre! Fortunately for us, our car is new and very economical - but I know a few people who are already finding it a huge struggle to afford to run their cars!

 

And after reading the information on fair fuel site posted up here - it makes my blood boil :-x

Sillygirl, my friend had their car stolen just in the way you describe. The keys were on a shelf in the hall and the thief hooked them.

 

Janie, I'm so sorry about your mum's loss of your sister's coin. She must have been so upset. What breaks my heart is that my jewellery wasn't worth that much either and it's probably been sold already and the proceeds snorted, smoked or injected by the ****** without a second thought.

 

Duckwaddler, lexis and nystagmite, thank you. I really hope they get this ****** too, and if they do I'll be going to the court with a really strong victim impact statement. Untill people get proper sentences reflecting the misery they cause as well as the financial loss we're all more in danger of getting robbed in this way.

Fuel prices make my blood boil too. The knock on effect of fuel prices is just awful. I always used to jump in my car and visit friends, go to the coast, country, etc. but now you have to add the cost of fuel to every journey as a specific item and it makes days out so expensive. Like many children my daughter wants to go the Harry Potter Exhibition near Watford, which would be a staggering £50 for two of us, but even if I could justify that which I can't at the moment as things are very tough right now, it's the cost of the petrol on top which means I wouldn't get much change from £100. Also, so many places are now charging for Sunday parking. It seems that for many of us life is no longer for living, it's just for existing. :-x,

They say now that people are spending more money on fuel for their car than on food! Did you take a look at the fair fuel website? In Venuzuala petrol is under 1p per litre!

Rent and council tax are priority bills, and your HB is for YOUR housing not ****ing Barclays.

 

A hand written letter is fine, but get yourself down to the bank in the morning. There's a template letter here. I thought they could only offset if the account was in credit? :-o

 

They emptied my deposit account and left a fiver in it a couple of years ago so I make sure there's never a credit balance now!

 

I'd better have a re-think about where my pay goes, if they are starting to take from an overdraft! :!:

Do you know, I thought the same but wasn't too sure as I don't have an overdraft, I refuse too lol! Perhaps BobCat has a case against them?

they have put the overdraft on as charges, we get very overdrawn with them due to me losing my job,am supposed to be paying it back at £10 a month.They know this and we wrote to them to ask for the £75 to be taken in bits as we only get £67.50 a week JSA (has it gone up yet?) but they not listend of course and decided to take it all making us even more overdrawn

There have been a few stories like this over the past few months. Why do these people go into the "care" profession when they obviously don't have the mentality or temperament for the job? My OH works in a council run residential home for people with dementia and Alzheimer's, and all of the staff there are caring people, you can tell by talking to them for 5 minutes. The majority of problems come when this is run as a business and companies get the cheapest labor in to do the same job, and cut staffing levels so no-one can supervise as they should.

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)
