    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.
    • I see you said you tried to stop the DD but it seems that didn't work. May I please ask why that didn't work? You should be asking your bank to cancel the DD and I don't see why they would have objected, hopefully you can clarify this. I agree that you should be making a claim here against your bank and ask them for a DD refund. There is no timeframes for this.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Monty, The defence which Postggj has posted, can I email this to to the parties that require it and if so when has this to be done, is it only theI/A i should take to the court on Tues.

What you are essentially doing is adding more items to your IA and will be able to serve this when you attend court on Tuesday. We need this information to provide a more complete defence since it will also show how they mis-sold the PPI.

 

The holding defence is a different matter and is fine, Postggj is happy with the PPI aspects. It would be useful to get in the holding defence by e-mail tomorrow, if this is difficult then just take 3 signed copies with you on Tuesday and hand them to the Sheriff Court.

 

You must also complete Section A of Form 1a that they sent you and strike out the bits in Boxes 1&2. In box 3 just leave live the parts that indicate that you wish to defend and issue a counter claim. Let me know if you need any more help - it should make sense.

 

You will need to scan all this in and send it by pdf to the court - do check their e-mail and always check that it has been recieved, you also have to send a copy to the Pursuers agents.

 

Please should if its not clear.

 

Remember again - they have mis-sold you a loan and issued proceedings against you. You have a strong hand here.

I posted the holding defence in Post 82 above. I asked PostggJ to check out the PPI part and he agrees it is fine. You only need to complete the xx bits and submit this by e-mail or hand deliver as above.

 

Postggj has suggested some additional items to include in your IA.

 

So you also need to print out an addendum to your IA.

 

I suggest that you phrase it along the lines of:-

Case no: xxx

 

Pursuer: xxxxxxxxxx

 

Defender: yyyyyyyyy

 

Payment Protection Insurance

 

The Defender also requests the following additional information is provided by the Pursuer as part of her Incidental Application.

 

The Defender requires the Pursuer to confirm the following:

 

1. Who Underwrites The PPI Policy that was included in the loan

2. To provide a Copy Of The Underwriting Sheet

3. To provide a Needs And Demands Statement

4. To provide a Statement Of Price

5. To provide any Policy Documents

6. To confirm how much was paid to the Underwriting Company

7. To confirm how huch Insurance Premium Tax was paid on the single policy?

8. To cofirm how much commission payments the Funding Co received in regards to any policy.

HAVE EMAILED SEC: A OF THE SUMMONS TO THE COURTS AND THE F/C REPS, I HAVE ALSO E-MAILED A COPY OF THE HOLDING DEFENCE TO THE COURT DO I NEED TO SEND A COPY OF THIS ALSO TO THE F/C REPS.

Well just back from Court, no representation from Funding Corporation and no acknowledgement from them to say they have received th I/A served on them. Judge was really nice and has said it will now be heard on the 8/9, I will wait and see if the FC supply me with what I asked.

No idea, but I suspect that they thought that this would be another of the 99.99% of cases that are admitted or the Defender fails to acknowledge service and they get judgement in their favour.

 

I would serve them another IA then.

Will do, I never realised how many of these cases are actually heard until today, also while I was there 3 companies had failed to me the I/A requirments asked for and this was peoples 2nd and third time at court just to get an I/A hearing.

Postggj is correct. Though we will get in that defence just in case. Hopefully they won't turn up for the hearing and then it will be game over.

 

The Sheriff with have them comply with the order in the IA given that they have not opposed and clearly had the opportunity to do so.

He Guys,

 

Just wondering how long The Funding Corporation have to give me the information requested on the I/A.

 

Also e-mailed their lawyers twice to ask for confirmation they had received the holding defence, but they have still to answer back.

Hi Pinky

 

Did the Sheriff make any order for them to conform at the IA hearing? I appreciate that they did not show up which means that they have not/cannot oppose the IA. Hence the Sheriff should have made an order as craved for.

 

They will now move to the hearing and the Sheriff Clerk will have served them a copy of your defence. If they have not conformed to the IA by the call date then you need to tell the Sheriff that they have not done so and ask for the case to be dismissed for procedural non-conformance.

Its 8th September, when I emailed the court and The F/C lawyers a copy of the Holding Defence, the court has confirmed they have received this and I had asked the F/C lawyers to do the same but they have not replied to this.
