Have made a formal complaint now to the ICO. no idea what happens next but will keep you informed. And a group action would seem to be the way forward.

Yep 12 hours have passed and im still celebrating.

 

Its by far no way a win against this [problem] company.

The file is over 450mbs in size so as documents that is one hell of a file to sift through.

I'm given to understand that there are emails in there where a certain Mr Crossley is admitting that the whole scheme is basically a [problem], and that he is just bullying people into paying him money. Definitely nobody should even be thinking of paying any of these demands, from him or any of the other chancers. I wonder if, as more of these emails become public knowledge, there might not be a case for those of his victims who have paid taking him to the Small Claims Court and getting their money back.

 

Remember, ACS Law made these files publicly available, albeit unintentionally. There is no "hack" involved, and I can't see why any of the emails would not be admissible as evidence.

Looks like he got away before by the skin of his teeth, I would have thought just having an IVA would have made time unsuitable to be a Solicitor.

Well..they certainly charged ACS 'admin' costs, these were sometimes added to the 'bill' sent to the infringer, normally only a few pence, but I did see an email where an ISP was demanding a fee of £20 per IP !, so it could actually make them money..assuming ACs paid up, there are some emails from Etranet (I think) chasing Mr Crossley coz he hadnt paid up.

The overall list is a backup of the entire ACS email (about 400mb), about 6000 emails, there are many attachments, some of these are the 5300 user spreadsheet already mentioned, listing Sky customers and the porn film they have alledged to have downloaded, another attachment is a list of 8000 Sky customers all accused of downloading the song "Evacuate The Dancefloor", this second list also notes if they paid up, not many had !

 

The above Excel files are quite small about 10mb or so, but I feel it is not wise to post them as they are rather sensitive.

 

The onus really is on ACS and Sky to inform people if tey are on these lists, and they should pull their fingers out and do it quickly.

 

Clearly these files should not have been just passed about as attachments (for example it would of been easy to just press the wrong button and send it to the wrong recipient), Sky 'claim' this dat was sent in encrypted form so ACS did the unencryption and then were very careless, I'd hate to be their IT guy (no doubt the IT was outsorced to one of the many support companies in London).

Hhmm..It says he had a period ofdepression in 1999, I doubt whether the recent events have made him happy either.

Hhmm..I assume that Andres is the writer of "Evacuate The Dancefloor", the spreadsheet refered to must be the 8000 user list that has recently surfaced, there is no mention that the spredasheet is or shall be encrypted, I believe Sky's claims that they encypted their data is simply not true, it would appear that this spreadsheet always existed and that the Sky IP data was simply filled in, no doubt by some sort of automated/macro given the size of it.

 

I wonder if it is neccesary for a contract to be entered into between the 'client' and the ISP, Sky in this case ? Did other ISP's enter into similar contracts or did they just see it as an easy money maker, that single spreadhseet earned Sky just over 17 grand !

I'm on the evacuate the dance floor Sky spreadsheet, when I realised last night I laughed, but woke up this morning really annoyed, they have breached my data.

 

What happens now, are ACSLaw obliged by law to write to me and let me know? Did think about contacting them but will sit tight and see what happens next.

Just found this hidden away on the Sky website, strange the Sky News website has no mention of the leaked info.......

As a result of an apparent security breach, the names and addresses of some Sky Broadband customers – as well as customers of other broadband providers – have been published on the internet.

 

 

As a content provider as well as a broadband company, Sky supports the principle that copyright material should be protected. However, our disclosure to law firms is subject to the following conditions:

• We only disclose customer information in response to a Court Order
  
• We only ever provide such data in encrypted form
  
• We never disclose bank or credit card details
  
• We have put in place an agreement with ACS:Law that requires data to be stored and used safely and securely
  

Following recent events, we have suspended all disclosures to ACS:Law with immediate effect. This suspension will remain in place until ACS:Law demonstrates adequate measures to protect the security of personal information."

I suppose technically speaking they have libeled you by accusing you of copyright infringement without proof, especially so since there has been no legal action.... nor likely to be & those accusations are now in the public domain.

 

You could bring a private action which could prove expensive or contact a solicitor as mentioned earlier who is bringing a class action. Unfortunately even then it does not guarantee any financial recompense... it would depend on his assets & given the recent publicity they are probably dwindling fast as he will now have little or no income his creditors will be clambering for payment before his business totally collapses then there's the rents for his offices; staff wages etc although they're probably like rats jumping a sinking ship by now.
