    • Yup, well so far they have lied to me about responding to a CCA,  are threatening me with a default notice that they don't have, produced a knocked up version of my NOA, sent me 29 pages of spew for an agreement. No wonder they pay 5 p in the pound for that crap.
    • Paragraph 2. I think there should be further down and also you should make the point that the payment to was made unilaterally and without the imposition of any conditions. Paragraph 3 – this is unnecessary because you are not claiming as an entitled third-party. This worries me because it makes me feel that you haven't fully read around because this is a paragraph which you would include where you were suing EVRi as a beneficial third party because you had actually made your contract with Packlink or some other broker. I think you need to revisit and do some more reading. I'm afraid I have a sense that you have simply copied this from somebody else's witness statement without understanding that it wasn't necessary. Please can you post the amended draft. Other than the suggestions above, it looks okay – but let's see it again for a further appraisal. In terms of the evidence, parties bundle, I think it might be an idea to start off with the correspondence with EVRi and then go onto the other evidence. You will have to amend the index page accordingly. You could shorten this bit. Take 19 is pretty well blank and you may as well miss it out also, there seems to be some repetition of emails and the email chain. I think will be worth going through and getting rid of duplicates if you can. 49 pages is a bit long and it would be a good idea to try and reduce the number. I have a feeling that 50 pages as the County Court limit anyway. The judge will be happier with you if the bundle is smaller. Maybe you could reduce the size of some of the images or messages et cetera. You have got several messages which straddle onto a second page so that things like sign off information and standard confidentiality information become orphans. A bit of manipulation and they could be joined to their parents I think. Page 31 as an example. So is page 19. You may only be up to shorten the whole thing by 56 pages – but I think it would be a good idea. 56 pages is, after all, 10%. If you can do more then so much the better

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I got my entire vinyl record collection back from my Mum's yesterday. I had an amazing night going back through all my old records. I found all the hand drawn flyers I did for a local rock night, too.

 

That being said, anyone want to buy Skeletal Family's entire back catalogue? LMAO...I was such a dodgy goth. :roll:

I went through the Goth stage, even though I didn't like the music :oops: I also went through the rocker stage, and worse lots of leathers drenched in petunia oil :lol! and silver studded leather strap bracelets, and even one for my neck :-o

 

But vinyls are beautiful huh? Two of my favourite vinyls that I owned were a Meatloaf picture vinyl, and a 45 vinyl by ELO, that was the most stunning shade of purple!

Although I doubt the room will be just for his use - but I do have another friend who's 18mth old daughter has downs syndrome, but she also has other problems (not quite sure what though), and she has a room that is solely for her use, so I will certainly be passing this on, thank you! It's a very complicated condition is downs syndrome, because my other friend, her cousin had a boy with downs a few years ago, and he doesn't seem to have any real problems other than with his eyesight. He's quite the smart genius too!

Haven't been on holiday since I met my Mrs 17 years ago. Her and the kids have had a few, but nothing special. I decided this year to go with them and saved up what pennies I could. I was going to go in October/November when it is cold here, and you get the benefit of warmer climates. I have had a few bad months lately and seen a good offer for Lanzarote, and I thought 'Sod it', and booked. We are going all inclusive for 10 days on the 19th of this month.

 

Happy Days.:-D

 

 

Knowing my luck though. We will get back and we will get told it was roasting here and Lanzarote would have had a bad couple of weeks of rain.:|

 

 

If all else fails, kick them where it hurts and SOD'EM;)

Today is my parents 25th wedding anniversary. The scary thing is, mum was only 7 months older than me when she got married.

Congrats to your parents Nys, and Sod'em - have a great time. Whatever the weather it'll be a good break, and quality time with Mrs S and all the little Sods. (I'm sure they're lovely really). :wink:

 

What made me smile was someone I hadn't seen for a while saying "Blimey Caro I didn't recognise you from behind. Haven't you lost some weight!!"

 

I took it as a compliment although I'm not quite sure what she was implying about my behind!! :p

I'm glad you like it. It's the expression on the fox's face that cracks me up. And she keeps on looking for it.

 

One other thing, duckwaddler, which is making me smile a bit, is that they got the burglar - good - but not my jewellery - sad. But I'm not giving up hope on that yet. Can you believe it was a woman! She has pleaded guilty to my burglary and 13 others. She says she threw the jewellery away but I don't believe that. Why would she when she could get money for it? I hope they get your friend's burglar soon too.

Seriously though, the friends I had then, some 32yrs ago were amazing! And a few of them, even if it's 10yrs, I can still call them and we pick up were we left off! One of them even has their own coven!

I don't believe it. Anyway the search goes on.

 

This morning when I came back from school I saw a man lurking outside a neighbour's house further up the road. I watched him for five minutes then got out of my car, opened the boot just to bring attention to myself and took a good look at him. He immediately walked off. I went to warn my neighbour and tell her what had happened to me because I hadn't been able to see her in the past 10 days and she actually spoke to the woman who burgled my house, probably on the day I was burgled or maybe earlier that week. She saw her outside the house and went out on some pretext and spoke to her and the woman went away. It was definitely the same woman. I am thinking it is her accomplice watching my friend's house and I am going out regularly to check on what is going on. My friend now has the house blazing with lights.

 

Please, everyone, if you have a door with any kind of glass panels try and get it replaced if and when you can afford it. Otherwise, make sure you double lock even when you are in the house. There are very nasty people out there. :mad2:

There's a new tv show started on the BBC of a morning, it's called "robbed, raided and reunited" - and that's how one of the victims were broken into, they just smashed the glass on her front door! :-x

 

Like I say, I have been robbed twice, but that was when I'd first left home - but I've seen first hand what this can do to people! My Nana was robbed twice, the first time she was in bed asleep during the night, and ended up in hospital with a heart attack a couple of days later, the second time she was out, but had some things that were of great sentimental value taken - she never got over it, and had a stroke a couple of months later and died :-(

 

These people out there who think they can just see something and help themselves to it make my blood boil! :mad2:

 

I remember one young so and so saying to me "if I see something, and I want it, I'll just take it"! Mind you, his own Mother said that thieving gave a "buzz" - so I suppose he didn't know any better really :roll:

 

Keep your eyes peeled DD! Karma will catch up with them, you'll see :hug:

It's dreadful for anyone to be robbed but I am so sorry about your poor, poor Nana. As much as I am upset it's better that it was me rather than my 94-year-old neighbour. She wouldn't have opened the door and like your grandmother she'd probably have died of the shock. It makes my blood boil too. :mad2:

 

Years ago I was temping at a criminal solicitor's office and honestly you should have read the list of offences they all had - and that was about 25 years ago. Most of the ones done for stealing cars said it gave them a "buzz".

 

I'm sure you are right about Karma. Wouldn't it be nice if we could sometimes actually witness the Karma?

I have witnessed Karma on many many occasions - in fact someone who has had it coming for a long time is experiencing Karma like you couldn't imagine right now :-D

 

But you can be assured, whether we hear about it or not, they get it - I mean, it can't be nice being living in the head of someone like that? What misery they must have to endure day in and day out :!:

Seeing the photographs of my friends new mahoosive 5 bedroomed house! My Little Godson was in the garden in one of them - and he looked like he was standing in the middle of a park :lol:

 

She's got a water butt, and a compost compressor too! It has those vents that looks like shutters too, I'm not sure what they're for (I think it's something to do with better air quality) - but it is humungous!! And a real state of the art eco house!

 

It's really funny - every time I speak to her, we just sit on the phone grinning, getting all excited like two teenagers :lol:

 

I can't wait for the warm weather, we have a BBQ planned, and then when the kids are in bed we're going to sit and have a game of cards on her veranda, which is huge by the way!

 

It actually looks like a house you'd get abroad! I'm over the moon for her!
