In same position on 2 cards, nice to see the same old names and template letters.

 

I have got to the same stage with a few and next step is court, petrified and not sure where to start. Will start my homework proper this evening!

welcome on board! :) i sent last missive to Barclayshark customer services recently! Waiting with great fascination to see what intelligent reply they come back with!:rolleyes:

I still get annyiong messages from calder but they seem to be dropping in frequecy now,The last one i had was on Tuesday!They do seem to go on and on and on though.They reapeat the messagre twice as well:rolleyes:

I would stop offering them tea and bics.

I've not received any calls from any of the creditors, except one threatagram asking for money.

I think they really wanted money to pay for there holiday.

I spoke too soon! I got a Wendy on my answer machine asking to speak to me from Calders recently!:eek: i expect she was ringing me to offer me an appointment in reponse to my last letter to view my alleged Barclayshark agreement! I should have rang her back and said i presume you ringing to discuss my appointment request to inspect my original alleged agreement :DShe was brave as most DCA seem very wary of leaving messages on my answer machine and normally just rely on those annoying repetive text messages! Do Calders or mercers get nice young ladies to ring you up?:D

Not had anybody call me up in ages, not even a text from them.

I ask you all my time in writing to them and they cant even text or phone saying thankyou for writing:-o. What's the world coming to, they can't even send me a nice blonde round to me :-o:rolleyes::rolleyes:.

Dear .....

 

I am in receipt of your templated response to my letter dated (whenever).

 

Your letter fails to answer the questions I asked, so I repeat them below:

 

(1) Can you confirm whether or not you still hold the original signed and executed document at your offices for this account and that it will be available to bring to any court should any type of legal proceedings be commenced in future.

 

(2) If you do have this document, why are you so reluctant to provide me with a copy. ?

 

(3) Alternatively, if you still maintain you retain the original signed Agreement with all the prescribed terms as laid down in the regulations then I request to be allowed to view this at your offices and that you contact me in writing to arrange a convenient time to view the original agreement

 

I am sure that you will agree that doing the above will maybe resolve this matter and would also save future court time and costs, which would be in both our interests. I would appreciate your due diligence in this matter and I look forward to hearing from you in writing.

Just got my reponse to the above letter i sent! Surpries sorprise i was sent exactly the same template letter as last time!:rolleyes: They dont even have the imaginatuion to press a different button on their letter machine!

Exactly the samer letter ! except this one had an Emma instead :rolleyes:of a Francis as a customer services specialist!

I am in receipt of your letter dated the-- July 09. I am frankly quite astonded that your company refuse to comply with all my requests to resolve dispute and save possible future court time and save costs on both sides,which would be beneficial to us both to resolve this matter,you are reminded e should any furture type of legal action be initated against me your company will be rquired to bring the original correcly executed alleged agreement to court for it to be legally enforceable

I refer to my letter of xx/xx/xx; the content of which appears to have been ignored. As previously stated; until such times as you're able to produce a true copy of the Consumer Credit Agreement that was requested on xx/xx/xx, no further payments will be forthcoming to anyone.

 

Please note that should you decide to go ahead with legal proceedngs in the absence of such an Agreement and in defiance of the law, that these actions will be treated as both unlawful and vexatious and vigorously defended.

 

I trust that this letter clarifies both my position and your own (finally), as I have no desire to keep on repeating myself and/or continually remind your company of its legal responsibilities.

The above is the latest missive i got from Calders!This dispute is begginning to look like a game of ping pong!Should i just ignore it as i think it a probable waste of time even attempting to communicate with this division of Barclayshark as i will be sending priorityones letter to Barclayshark customer services!which will be giving them something to mull over but proably only to press button A again on their letter machine in response,:rolleyes: so i assume my instinct is right in just ignoring Calders and just concentrating on sending my letters to Barclayshark customer services only?

Looks like we're in the same Barclayshark fan club as well.

 

Mercers have given up & now got Calders on my back - but still no cca from Barclayshark.

 

Rang ICO yesterday to chase up my complaint against BC non compliance to my SAR - ICO are still working on December 08 complaints so I gotta a long wait. I did ask about the lack of a cca but was told that I had to complain to other authorities, told him that BC's insisting on me giving a legal reason for justifing the need for them to provide my cca, the ICO guy I spoke to recommended that I join an internet forum as there would be much help available there - I asked for the name but he said that he wasn't allowed to name any forum BUT suggested I type consumer forum in my search engine :eek: so does that mean we are now the 'unofficial' official help & guidance advice site :D

Although this looks like ping pong, Barclays are one of the most persistant creditors that I've dealt with.... so I'd send a copy of your letter to this bunch as well.... by rec. delivery.... with a covering letter referring to their recent correspondence and telling them to read the attached (your copy)... and see what happens after that.
