I sent a 'the account is now in dispute' letter to BC a week ago and it has not arrived with them (Royal Mail says it's reached the Post Office I sent it from and gone no further), two other letters I sent at the same time have been delivered.

 

Am I right in thinking that this letter is just a courtesy; because they defaulted back on the 12th then I should still refrain from making a payment to them, and resend the letter?

1 Churchill Place. Previous letter (CCA request) was received ok there.

 

I'm going to resend anyway, just wondering if I should consider my payments stopped from now, or from when the next letter is received by them.

 

I have had a couple of CCA's marked as not delivered so far on the royal mail website and the next day have received a letter from the relevant DCA saying the account is on hold due to my request. So it might just be a royal mail error.

 

Its up to you but maybe you could give BC a call to see if its been received?

 

Re stopping payments, I guess there is two ways of looking at this. You could continue to make payments and hope they hold a valid CCA which they probably do not, but at least the debt is being paid for

 

OR

 

You could do what I did, cancelled EVERYTHING until I have received valid CCA's - to date I havent received ONE and no further payments have been made!

Yeah, this is basically the route I'm going down. Payments to all those in default of my CCA requests are stopped until I receive a valid CCA.

 

Ironically, Cap One did send me a technically valid CCA so I've SAR'd them to get all they hold, but I'm paying them in the meantime. What turns up in the SAR bundle will steer my next course of action with them, but the 40 day deadline is some way off yet.

SAR from Crap One? Blimey let me know if you get yours as I have requested mine as well about 2 weeks ago and have heard nothing since so the clock is ticking!

This problem with the letter might just be because they bulk signed for the mail. The only way this bulk signing for can be got round is if it sent special delivery

ah yeah, I never considered the bulk signing thing. It's the first time I've seen that message on the Royal Mail tracking. Dunno if I'll be using Special Delivery for my letters; for what they cost I might as well just pay my creditors lol
