    • The ISA quoted vehicle CY08JCJ entering 12.49 and exiting 14.19 this is not my sons vehicle. These times also vary from the two payments made?
    • Not completely black and white. ICO says if you ask for the information to be sent in a particula way, in your case electronically, then they should send in that way "if possible". So I suggest making that request firmly. I would guess if they actually only hold paper copies they'd be with their rIght to decline to scan everything for you. Or they could transcribe just your personal information.

    • Regarding SARs - does the recipient provide hard or digital copies of info?  I sent out a request recently. All the info was digital and I'd like it sent digitally - for expedience -  but they want to post hard copies.  Can I demand digitally?  If it's hard then I will have to labour over scanning it all back in to my computer - which is a waste of my resources.  I had this issue recently with a lawyer - they said they had too much info to send by email. Yet miraculously found a way within 2h. (It would be useful to have hard copies too - but in terms of short-term follow up communication digital is best for me)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oh no a newbie!! I' really sorry and I'm sure you have been asked these same questions 1000s of times but I really need to get things straight in my head!!

 

We have 7 credit cards and 2 unsecured loans, in 2004 we ran into financial difficulty and defaulted. They were all passed onto DCAs who we now pay minimum monthly payments.

 

A relative recently told me about a company who would be able to get my debts 'legally and ethically cancelled' for an upfront fee of £495 per debt, they also claim that they can have the defaults removed from our credit files is this too good to be true?

 

I was seriously considering this as we sold our house in 2007 and went into rented accommodation. We now can't get a decent mortgage because of the defaults on the credit file. I was planning to just wait until 2010 when the defaults would be taken off.

 

Then I found The Consumer Action Group from a link in fool.co.uk and now my head is really spinning!!

 

I'm half excited and half scared but I think I might DIY with your help!!

 

After reading the forums and gathering as much information as I could this is what I propose to do but please advise me if any of this is wrong and I have misunderstood anything!

 

  1. Send CCA to DCA with £1.00 postal order, not cheque, and do not sign letter.
  2. When I receive the information back am I meant to be looking for anything that could make the debt unenforceable, if so what?
  3. Send SAR to original creditor ie Capital One not Robinson Way. Do I sign this letter? Robinson Way state they are the data controller for my account why do I not send them the SAR?
  4. Try to reclaim charges and any mis-sold PPI from original creditor ie Capital One. Can I still do this if account is in default and with a DCA?
  5. Use any charges due back to me to reduce the debt to DCA?
  6. Offer a full and final settlement to DCA?

Am I going to end up with new defaults on my credit file?

 

Is there really anything that can be done to remove default notices on my credit file?

 

I have today received a settlement offer from Robinson Way. I owe £2192.28 they have offered me £893.76 should I take it?

 

I know its obviously not this simple but am I on the right track?

 

Any help would be really appreciated.

You've obviously done quite a bit of reading already, so that is a very good start.

Generally speaking, if something sounds too good to be true, it is. Whatever service they are offering, you could probably do the same thing with the help of this forum.

Personally, I would hold fire on this until you've got the results of the CCA requests - you might find that some of your debts are unenforceable.. The only exception to this is if you think you may have substantial charges from nearly 6 years ago, in which case, go ahead because you'll need to put in your claim quickly.

They will not be doing this out of the kindness of their hearts and it is quite possible that they don't have a proper agreement. It's your call really, but if you can afford it, you could try to negotiate it down a bit more. Personally, I would wait until you get the result of the CCA request.

Harlequin, one other thing I should have mentioned - post a new thread for each creditor - it's much more likely then that you've get the relevant help - and it's best to call it something like "Harlequin v DCA Name".

And another thing! - make sure you send the CCA requests off by recorded delivery.

Special delivery is best as creditors tend not to sign for recorded deliveries.

 

 

But the fact that you have sent something recorded still gives that record that you have sent something to them should it be needed at a later state!

 

(Remember the Moorcroft paragraph "this letter serves that requirement, even if not actually read by you" :D)

When you've had all the help you need, make sure you stick around to help others too!

Just think, if everyone left the site after they'd got their help, there might not be anyone left the next time YOU come back needing more assistance!!!!!!!
