    • Thank you for posting up the required details and well done for apparently not revealing the identity of the driver. I am assuming you are the keeper? The depth of ignorance of the parking companies is absolutely amazing. The Protection of Freedoms Act 2012 Schedule 4 is the law relating to private parking and allows those rogues to be able to transfer the charge from the driver [whose name they do not know] to the keeper after 28 days . This is dependent on them complying with the Act. So many of the don't and Alliance is no different. It would help if we could see what you appeal was and to post the back of the PCN as it is lacking so much of the wording necessary to make it compliant so that in your case only the driver is liable to pay the charge. And of course just entering the ANPR arrival times means that they have failed to specify the parking time which is a requirement..  Because the car park was so busy you had to drive around for quite a while before finally finding a place to park which is when the parking period may  actually begin. The poor dears at Alliance have not grasped that particular part of the legislation as yet. To be fair the Act has only been in place for 12 years so one must make allowances for their stupidity . We shouldn't really mock them- but it is fun. You weren't to know but the chances of winning an appeal against Alliance and the IPC is around 5%-and that is high for them. If they allow you to cancel they lose the chance of making money and they would have had a field day when you were there with so many people being caught overstaying because of the chaos in trying to find a parking space then trying to pay.  Your snotty letter could go something like this- Dear Cretins, Yes I mean you Alliance. After 12 years one would have thought that even you could produce a compliant PCN. Did you really think I would pay you a penny extra considering the time I wasted trying  to pay with  long queues at the parking machine, then trying to get a signal to call Just Park. On top of that you then had the cheek to ask for an additional £70 for what dubious unspecified pleasure? You must have made a killing that day charging all those motorists for overstaying because the queues to pay were do long and even walking to pay from the over flow parking fields takes time. And yes I did take photos of the non existent signs in the fields so please don't give me the usual rubbish about your signs being clearly visible. Oh yes that £70. Please tell me and the Court whether that charge included VAT and if it did, why am I being charged to pay your vat? I am sure the Judge would look carefully at that as well as the Inland Revenue. The truth is you had no reasonable cause to ask the DVLA for my data given the chaos at your car park and I believe that you therefore breached my GDPR...................... I expect others will give their views as well.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just found an old Crap 1 card so when they next ring up then il try to pay it with that, also found the card they send in junkmail.with the number 0000000000 on it , i might try that one as well.

I use my old cards for other stuff as well but dont think i should put on here what .

I dont see what is the point of them saying that the call is being recorded, after all its not against the law if you wish you to use aload of expletives down the phone at them or talk to them in a funny way.

They seem to be under the impression that its something your not allowed to do :rolleyes:

No its not really fuzzy as some of them cant help they have a low IQ especially if they work for a dca.

I went for an interview when I was desperate for a job a few years back. Turned out to be Moorcroft of all the places in the UK. (How ironic for me. ) lol :eek: erm lol (I hate them with a passion due to two of my accounts and one of my girlfriends being with them.) They said I was over qualified and turned me down. Ha ha. So filled in application for Maccy D's out of sheer desperation instead . Got offered the job, but turned it down due to moral standards + actually caring about the young people who are the so called "future of Britain". (for what good it will do us in the end lol.)

 

The moral of this story......"If you work for DCA then unemployment should be considered a positive career move." :D

Over qualified to work for a DCA, Excuse me while i finsh laughing at that line.

 

Done. My dad has found that he got made redundant from a printing firm and then told he was under qualified to get a job so he went to college and done a load of courses applied for more jobs still did not have enough qualifications so went to university. Now he is over quified to work and has been on benefits for a few years now. But stangly enough he is not over qualified to work on the field picking daffs and stuff like that.

Just leaves an open door for the few on here that have posted funny DCA calls etc.

 

I really hope it shows others that read the more amusing threads, that there's nothing to be scared of, and to stand up to them. + Expose them for the con merchants they really are for trying to profit from the vunerable, and decent people, who have fallen on hard times through no fault of their own.

 

Life is hard enough as it is without these parasites preying on decent people who just want to live life as best they can under the circumstances.

 

One day hopefully the law will fully protect those people. Until then...

I was a newbie once.

Thanks to the CAG it's given me and my girlfriend a new start in life, that we wouldn't have had otherwise.

I just wish the CAG had more mainstream media coverage, cause there's a lot of people out there that still get suckered in by DCA's and companies that prey on peoples lack of knowledge of the law and what they are really entitled to.

CAG is the beginning of a new era, where once again the customer is king and companies respect that to stay in business. Sooner it comes the better.

 

For the time being, keep going and support what is right, and one day the customer will be king again.

Yep, have to agree with you both 100%

 

The CAG should make peeps realise there's nothing to be scared of and push for more media attention to show people that there's nothing to be scared of.

 

When me and my girlfriend get our bank charges refunded, we'll be making big donations so the CAG can continue. We would donate now, but are both struggling to pay basic bills at the mo.

my pride and joy (Carlos Sainz Celica gt-four) is off the road due to not being able to afford a £60 part for it. :sad: Only cost £3000 2 years ago, but it's my baby.

 

I love this website and always give the site address to anyone I meet who needs some help.

 

The CAG is a true voice of hope in a country who's media and government promotes bad news and dispare as a norm.

But for many talented people, just affording to survive is all you can ever aspire to acheive if you live here.

Me too. I've got myself a CAG email account but that's the best I can do at the moment. In a few months time I might have a bit of money but I've got a huge battle ahead with quite a number of nasties. If I can see them off then there will be light at the end of the tunnel. Quite right they do too, as the people who set up CAG are true

hero's and well deserve at the very least media attention and

a knighthood for their services to the people of this country.

 

It's only fair that we start a thread (that's made a sticky on the frontpage) also petitions etc, so the people behind the CAG get the full recognition they so rightfully deserve for all the hard work they've done over the years.

Had the following call 10 mins ago.....

 

Hello this is David from Halifax, can I speak to Mr Fuzzy Bobble?

 

Me: Yes, speaking (after 3 cans of carling I may add)

 

Halifax Dave: I need to confirm a few details before I can continue.

 

Me: ok, go ahead matey. (covers mouth to hide laughter)

 

Halifax Dave: Can you confirm the first line of your address?

 

Me: Can you confirm you're a W***ker from Halifax and trying to persue me for an alleged debt you cannot persure an alledged debt for?

 

Halifax Dave: WHAT?????

 

Me: No properly executed Credit agreement has been sent, even though I requested it over 14 working days ago. Or in simple language that you will understand. F*** Off and never call me again you pathetic mimimum wage earning parasite......

...If you're recording this I want a copy of so I can play it to my friends at the pub.

 

Oh dear and I thought they had to phone between 8am and 9pm

I thought that too, but when have DCA's ever followed the OFT guidelines and the law for that matter.

many many years ago - when I had a loan out with Lloyds TSB (who used to be a decent bank before TSB came on board) - I was off sick from work one day - so was lounging around the house in a dressing gown and slippers.

 

There's a knock at the door - I answer it - to find a "bloke" - fresh out of University - hope in his eyes of making a difference in his chosen career, a nice new iron pressed white shirt and a suit which looked like it had just come off the peg in a fine Saville Row establishment - and in his hand was one of those big leather folder things with the zip on it.

 

I had a pretty good idea who we was working for...

 

Conversation went something like this:

 

 

Kid: (Enthusiastically) Is Mr X there?

 

Me: (Being civil - and feigning ignorance of the fact University Kid's actually speaking to Mr X) I'm afraid he's not here at the moment. Can I help?

 

Kid: Not really - I'm here from Pound of Flesh Ltd (can't remember the actual name of them - could have been someone like Moorcroft or something) - we just need to speak to him about this loan that's outstanding. When would he be back?

 

Me: I'm not too sure to be honest. I think he's abroad with work at the moment up in the Baltic. I think he said he'll be back in a few days.

 

Kid: OK - thanks for your help. Can you make sure he gets this when he gets back and gives us a call please.

 

(With that - hands me a card with my name on it and a request to ring them to be intimidated)

 

Me: No problem bud - I'll make sure he gets it.

 

Kid: Thanks - and have a good day Sir.

 

 

Kid walks off, I shut the front door, card goes in the shredder
