    • Banks have different limits above which they require Probate. So it may be Probate is not needed, although as he died with no Will that could complicate things. Is all the £28k with Virgin Money? Your wife should contact all banks who hold his money with the death certificate and ask them what they need to release the funds to her. Most banks have a central "bereavement department". Check their websites. Use that department rather than general call centre or bank branch if they have one. Nearly every bank website has a section on "what to do when a customer dies" so have a search for that. Your wife may also have to provide evidence that she is his daughter. When his wife died it sounds like they had a joint bank account so that's why her money just went across to him. But as it isn't a joint account now transfer to your wife won't be quite that simple.

    • She's an only child and he as a brother and sister. He has no will and we have done a check on this to find out if he had left one and nothing has come up. He has savings of around 28k His sister and brother are well off so 28k is nothing to them and aren't interested in his money. This just leaves my wife/his daughter. Would this still need to go to probate there is no estate e.g house or business to sell and the amount left in his bank is just small? When his wife died they just closed her bank account and moved her money across to his account and we just assumed that once my wife has handed in the death certificate and shown evidence of who she is the same would apply to her? We don't know yet the council have only just written to us today with a guide of what to do next.

Strictly speaking banks could refuse to take instructions until Probate is granted but In practice I would expect the bank to take instructions to cancel the DD if the Executor presents the death certificate and a certified copy of the Will
    • Hi   Sorry I probably wasn't clear enough. He had lived in the flat until December 2022 with Dementia by this time it was unsafe for him to have capacity to live on his own and he had to move into a nursing home. We had left it too late to apply for power of attorney so approached a solicitor in March last year for Deputyship. We were still in the process of dealing with it by May 2024. He passed away a few weeks ago and the solicitor was contacted to halt the application and we will just pay the fees of what work he has done up until now. My wife was the named person on her dads bank account but we didn't have the ability to alter any direct debits hence the reasons for applying for Deputyship as we were having problems trying to stop some payments coming out of his account Eon being another difficult company. We kept his flat on from December 2022 - August 2023. it was at this point I contacted Sancutary housing to inform them he was no longer living in the flat, it had been cleared out and was ready for a new tenant and that he had Dementia and had moved into a nursing home December 2022 and explained the reasons why we kept it on. As the named person to speak on his behalf I asked them what proof they needed in order to give notice on the flat e.g proof of dementia and proof that he was living in a nursing home and anything else they wanted. The lady in the upstairs flat and some of the other residence in the street had asked about him and we had told them he had moved into a nursing home. The lady in the upstairs flat wanted his flat for medical reasons so asked us once we had given notice could be let her know and she'll ask them if she can have it. We explained the difficulties and it was left at that but I did tell her I would let her know once notice was given. I contacted the company by email a number of times and also telephone conversations and nobody followed it up and it wasn't till the end of February this year that the housing manager for the area wrote to our home address to ask about him that he had been to the flat a couple of times and nobody answered and he had asked some of the residence in the street and they hadn't seen him for sometime. There was an email address on the letter so I contacted him and copied in the last 2 emails I sent Sanctuary regarding me wanting to give notice on the flat for at least 9 months explaining that it went ignored as well as telephone calls. I also stated I wanted to have his rent payments returned from the date I wanted to give notice which was from August 2023 as the bank wouldn't let us stop the DD without POT or deputyship explaining we were in the process of Deputyship. He gave some excuse about not having POT to cancel on his behalf and spoke to someone in HR and said he would contact the nursing home to confirm he was there with Dementia and if it all checks out we can give notice on the flat which came to an end on the 22 March 2024. There was not mention of back payments for the rent already paid or the fact I had asked to give notice in August 2023. Despite someone living in the flat from 1st April they continue to take DD payments for the flat and have taken another 2 payments of £501. another concerning thing despite Eon not allowing us to cancel the DD to his account the lady upstairs informed Eon that she was moving into the flat February 2024 and Eon refunding the account to his bank and said in an email sorry you are leaving us and canceled his account. Something they wouldn't let us do but a stranger. She also changed her bank account to his address despite the fact notice hadn't been given on the flat yet. So we need to find out how much information Sanctuary actually had for her to tell her power company she was moving into the flat in February despite the housing manager only just getting in contact to find out where he was. So a complaint is going into Eon and Sanctuary and we are going to take advice and ask the bank to charge back the rent. My wife hasn't taken the death certificate to the bank yet to inform them of his passing.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I Cannot beleive the incompetence of royal mail,

I Sent 3 cca requests on the 2nd jan.

And out of the three I have only one signature validated on track and trace,

Have called royal mail CS and they have informed me I need to wait untill

The 22nd jan before i can report the 2 missing letters as lost.

Whats the point of using recorded signed for letters service

When Royal Mail Cannot guarantee delivery.

Is there another private service i can use to re-submit my cca requests.

And do I need to re-Submit the missing CCAs ?

Recorded delivery only gives you proof of delivery, it's not a guaranteed service. For guaranteed delivery, you'd have to upgrade to Special Delivery which will be delivered by 1pm on the following day, at a cost of £4.30.

So what Royal Mail Are saying is we will charge you £1.40 or whatever it was.

but dont be suprised if we fail to deliver your letter

I am currently liquidating my business and sent letters out last October - recorded delivery. The website is still saying that some of these letters are still out for delivery.

 

I resent the letters December and still not all have been delivered.

 

Royal Mail is passed being a joke! :mad:

Just out of interest, dont assume that you letter is lost because it isnt showing as signed for. I used to work nfor Royal Mail and after a stint as a postie I worked in the office where they scan the posties sheets to show deliveries have been done. One of the main problems was getting the posties to hand in the sheets on time. They dont all go back to the office at th end of shift so the sheets are only handed in the next day. I have known posties go off sick or on holiday and only hand in the sheets when they return to work. Its not ideal and wrong but it happens. Another problkem when youwrite to a company is that the stickers are put onto one sheet and signed for a a whole. Some companies get hundreds of letters a day and cant sign for each one individually. Then its down to the person scanning the posties sheet to make sure he scans every single number.

So sometimes its not that the postie hasnt delivered, its down to bad practices.

Sometimes the letters have been delivered but the details haven't been entered on the system. Royal Mail actually says this in their blurb and suggest that you contact the recipient yourself to check whether it has been received - and you pay extra for this service! Doesn't help when you want proof of delivery.

The same has happened with us. Out of 5 letters, all sent Recorded Delivery on 3rd January, one has been delivered and signed for, one has 'been delivered from Delivery Office', and no record of the other three. My impression is that the only way of getting a letter properly delivered and signed for via Royal Mail is by sending it Special Delivery, £4.30. One of the Post Office cashiers told me, very flippantly, that Recorded Delivery letters 'just go in the sack with the others'. Great news when you've little money but believe what Royal Mail says about Recorded Delivery. :rolleyes::mad:

If the royal Mail Are charging extra for signed and recorded letters,

And then Just putting them in sacks with the normal Mail,

Then They should be heavily fined for charging for a service

That is not been correctly carried out.:mad:

I keep checking the RM site for one, out of three sent last monday, which remains undelivered and I'm wondering how long to leave it before I re-send via special delivery.

 

I'm hoping the recipient will acknowledge receipt and save me the extra cost, but I think by the middle of next week it will go again to stop my nerves jangling, this time special delivery; I'm tempted to send everything that way in future although I can't really afford it.

It takes up to 15 days for Royal Mail to deliver 1st class mail after posting.

 

Last Monday was only the 7th and the OP's letter's were posted on the 2nd. That means the 22nd and 17th of this month to wait and it is now only the 12th.

 

Why not just check your account to see if the £1 has been encashed, or the PO or whatever you used?

 

Whatever happens you have recorded proof you sent the request, assuming you kept the receipt.

Under court rules any letter sent out by first class mail is deemed to have been delivered two days later. Recorded delivery proves you have mailed the letter and the signature on receipt is an additional safeguard against the debt collectots claims he hasn't received it. A debt collector would be on difficult ground to prove he hadn't received a letter.

Recorded delivery is not treated any differntly than ordinary 1st class mail. It does go in the sack with other mail, the only difference is that the postie is supposed to get a signature on delivery.

Special Delivery is treated very different. It is scanned at every point of its journey and moved around in special sealed cages.On arrival at the delivery office it is scanned again and then each postie has to collect their own specials from the locker and sign to say they have taken possesion.

Recorded delivery does not offer this option, it is just normal delivery (supposedly with a signature at the end point!!!)

I didn’t receive a POD for a letter sent to Capquest, so filled in a form from the Royal Mail website and received the POD a few days later. It was a bulk signing sheet which clearly showed my reference number. As my letter was sent Special Delivery, there was no charge for this.

 

Recorded delivery is not always reliable and there is a charge of £2.20 to apply for a POD from Royal Mail.

 

However, if you receive a response to your letter, then they have obviously received it!

 

Unfortunately, it can sometimes be a long wait for a reply to a CCA request.

Hi,

 

I too have also had the same problem with Royal Mails so-called Recorded Delivery Service, where you pay extra for a service you don`t receive.

 

A few of my Recorded Delivery letters have not been signed for, although I have later received a reply from them.

 

Going on from there, I Ndecided to use the Special Deliver Service to deliver a letter and guess what, and guess what? This didn`t show up on the system until over a week later.

 

I`m of the opinion that Royal Mail do not offer any Special Services at all. They advertise these extra Services in order to get more money from people, sort of like Banks do, they seem to rip people off.

 

They are nothing more than modern day terrorists who hold the Country to ransom every time they want a pay rise of are asked to do a full days work for their pay, instead of running off home as soon as their bags are empty. If everyone took this attitude the whole Country would be in uproar. If they aren`t happy with their working conditions or wage, they should quit or get another job instead of holding the Public to ransom.

 

I find, if you need to deliver a letter to a Bank, simply go into your local Branch and hand in the envelope, ask for a signed receipt of delivery and ask them to deliver it via their internal mailing system. This is of course outside of their standard letter handing poilicy, but do we really give a ****?

Perhaps a few thousand Compensation Claim Forms thrown at Royal Mail from CAGGER`s could possibly kick start Royal Mails Recorded and Special Delivery Services?

Why should we also have to mess about with POD requests?

 

We pay extra so we can simply Trace and Trace on the Royail Mails Website. They are offering Services, people are paying extra for Services, so we should RECEIVE these services. Not, go out of our way to find out if our letters have been delivered!

These missing Recorded Delivery letters are worrying the life out of me. I agree with everything you've said here. Royal Mail are offering a service which they unofficially admit means very little in reality. The only way to get a letter properly delivered and signed costs £4.30. It makes me furious - why are they selling a (Recorded Del) service that feels more like a lottery - and costs as much as a lottery ticket?:-x

PS some Special Delivery letters I've sent in the past also haven't been signed for. :rolleyes:

Nice to hear someone agree`s with me, my girlfriend just thinks I`m a twisty so and so.

 

What do you think? Perhaps if we`d all kept our Recorded Delivery Receipts and then thousands of us threw an N1 Claim Form at Royal Mail for compensation, how much do you think it would cost them to defend each claim in Solicitors fee`s? They`d crap themselves. They might just get the message then.

 

The funny thing is, I`ve always wanted to be a Postman, but this last year, I have lost all respect for the Royal Mail. I think I`ll just stick with my dead end, mind numbing factory job instead. :(

I have to agree with this. When the Signed For service fails you can claim your money back. Signed For service provides NO guarantees. Read the T's & C's.

 

However... If you want a guaranteed service, it's your responsibility to purchase the correct service... In this instance, it's Guaranteed Delivery, which costs from £4.30.

 

If you send by Signed For... It isn't guaranteed.

They aren't lost... The recipients have refused to sign for them...

 

It's as simple as that. Fact of life, avoidance of service... :mad:
