    • Yeah I figured, unlikely I'll need credit anyway mortgage all paid off etc so I'll take that on the chin and learn from the experience. Probably would've beaten that too had I remembered the protocol, first time ever going through the process though sob it wasn't familiar to me  Oh well  
    • This is my slightly amended WS taking on board your previous comments, any suggestions for amendments would be most appreciated.  Thank you for you time.   1.        I am the Defendant in this matter. 2.        The facts in this statement come from my personal knowledge. 3.        I became aware of original Judgement following a routine credit check on or around 14th September 2020. 4.        The alleged Letter of Claim dated 7 January 2020 was served to a previous address which I moved out of in 2018, no effort was made to ascertain my correct address. 5.        The Judgement debt was not familiar to me so I began investigations to ascertain what the debt related to and how such a figure had been equated in any event. 6.        I made immediate contact with the Court, the Claimant Solicitors and the Claimants thereafter, asking them to provide me with a copy of the original loan agreement but this was not provided to me.  7.        I sent a Data Subject access Request to Barclays but no agreement was provided – See appendix 1 which details the timeline of communication between myself and Barclaycard as well as copies of correspondence between us. 8.        I do not admit to entering an agreement with Barclaycard in 2000. 9.       The claimant has failed to comply with the additional directions ordered by District Judge Davis and therefore this claim should be automatically struck out.  10.    The claimants have failed to disclose a true executed copy of the original agreement they refer to within the particulars of this claim. They are not entitled to enforce the agreement pursuant to section 78.6 (a) of the Credit Consumer Act 1974 12.   The reconstituted standard Barclaycard agreement that the claimant has included in the court bundle does not satisfy any CCA request and so the claimant is and remains in default of my CCA request and therefore unable to enforce the alleged agreement. 13.  The claimants have failed to provide proof the assignment, such as a deed of assignment. 14.  The claimant has failed to provide a statement of account setting out how the alleged debt accrued under that agreement 15.   Despite numerous requests to the claimant, I have still not seen any evidence, such as an original agreement or deed of assignment, that substantiates the claimant’s assertion that I owe the debt to the claimant, nor evidence of how the debt was accrued. 16.   As per CPR 1.4(2)(a) the court encourages parties to cooperate with each other in the conduct of proceedings in order to try and save time and costs for the parties and to also save the time and resources of the court however, despite vast attempts at mediation the claimants have been most unreasonable and have remained unwilling to mediate. I believe that the facts stated in this Witness Statement are true.  I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.
    • A set aside application costs £275 which is more than the judgement so not worth it. Not that they would grant a set aside anyway.  Set asides are granted, for example, to people who moved and didn't get the court papers, so have a genuine reason for not defending.  Forgetting doesn't count. Your only choices are to pay up within 30 days, or defy the court and not pay.  If the latter, we've never seen a PPC enforce judgement for a single ticket, ever, you would get away without paying - but you would have a CCJ and a knackered credit file for six years.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Much as I love Christmas, it is too commercialised. Why not just remane it Chocolatemas? I've been trying to find an advent calander that does not have chocolate in it. When I was wee they used to have glittery Christmas trees and snowmen on them or a nativity scene. Now it's High school musical or The Simpsons. The supermarkets are full of sweets & chocolate then the minute Xmas is over they fill the shelves with keep fit stuff and diet foods!! Every one should have a decent brake over Xmas - do we really need supermarkets and other shops open on Boxing Day?

Anyway apart from that , Merry Christmas!

I havent celebrated Christmas for years because it means nothing to me. People say to me, 'why dont you celebrate it for your daughter, so she doesnt miss out on presents.??

My reply is 'And teach her to take part in an anual holiday that means nothing to us?'

I will not teach my daughter to drift through life questioning nothing & just being a sheep.

So, I celebrate new year instead. Something that has much more meaning to me. My daughter & I decorate the house with new year decorarions & give new year presents. Something much more worth while I feel.

 

Some people seem to get offended when I tell them I dont celebrate Christmas. Like its something they have also wanted to do but never had the courage. Its a funny old wold sometimes.

Lots of people don't celebrate Christmas for lots of different reasons and that is their choice and that choice should be respected!

However it also works the other way round. You can't call everyone who celebrates Christmas a sheep just because the majority of people in this country do the same thing!

That is their choice for whatever reason and that should also be respected!

D'ya know what? I love christmas with a passion!!!

 

I know it's commercialised, I know it's a big money-spinner, and I know it's a bit contrived! But the thing is................ I really love it!

 

I love the fact that my dad's gonna sit on one of the sofas huggin' a bottle of wine (that I'll desperately try to wrestle off him!); I love the fact that my mum will be pis*ed as a fart on Bailey's and then announce to the entire house that she's "having a hot flush" (even though she's 65 - bless her!") And I love seeing everybody that I love in the whole wide world happy, contented, full of food, full of drink and generally "happy"!!!

 

I love it when somebody starts an argument about the 'game' they're playing with the kids............. usually because 'somebody' hasn't read the instructions right in the first place! Therefore, the kids totally whoop their asses!

 

And I love it most of all cos it's a time when I remember my brother - cos he died 2 days before christmas day 15 years ago. :( So we make it a special occasion for "being family" in his memory. And I always remember how much he loved christmas day........... so we "big it up" in his memory!!! :)

 

But most of all................ I love the thought of it. And if it costs that little bit extra, then so be it! Cos even though (like everyone else!) I can ill afford the expense, I'll take the sentiment of the whole spectacle................................ and look forward to it every time!!!!! ;)

Hedgey - don't do Christmas for reasons already posted - but still do Boxing Day as if it some sort of party - brother, parents etc. but still not right as son does own thing, just comes down to say hello and back up to pit . No real joy in this house unfortunately.

It's the holidays - so everybody should do what they're happy doing - as opposed to what peeps think they should do. x ;)

My stomach goes in knots at the thought of Christmas! I loved all the preparations and excitment when the children were little - it was really done for them then. Now they are 23 and 18, they still have a stocking to unwrap in bed and I just do little mini stockings for the table filled with miniature drinks, chocs, little bit of jewellery for everyone. Elderly parents stay (each Christmas I am aware it may be their last) so really it is a time of celebration that we are all still together. Old friends drop by for drinks in the morning and I really don't bother about when the main meal is ready - its ready when its ready and not a minute before! We then have all the leftovers on Boxing Day (I much prefer this day) and parent toddle off home and then I can chill out! Christmas is what you make of it mentally and each year I have spent as little as possible financially - I shall use up the spare cards from last year and not buy any more. The tree will go up on 17th (day before daughter's birthday) and I then start to get into the spirit of the occasion but I absolutely detest shopping and all the false bonhomie - bah humbug!:D

Christmas for us with 4 lads has always been really hectic. Traditionally, for the last 25 years we had never spent Xmas Night in our own house. Until my parents both passed away in October 1999, we (and my 3 sisters & brother & their familys) spent Xmas night from about 7 o'clock onwards at Mom & Dads opening presents (kids only) and playing silly games (everyone). After 1999 we carried on the tradition at one or the other of our houses but it was never really the same as grand children had come along and present giving had to be cut back cos there were so many. So last year when we got together to arrange Christmas night I decided to make a stand and said sorry, hubby & I would like to spend Xmas night in our own house for once wih just our own offspring. After the initial complaints-it was agreed that we would do our own thing & get together on Boxing Night instead. Great sucess!!! So much so that everyone has all agreed that our get together this year will be New Years Eve. Just goes to show that the perfect Christmas is each to their own!!

of course it is, life is always what you make it, we are all different and we all enjoy different things. Christmas is not all about spending money, I have no religious beliefs myself, so I join in anyone`s celebrations who will have me! Jewish, muslim, St Patricks day, any excuse for a knees up! But Christmas is special, the atmosphere and the build up is unique. I marvel each year how I manange to find the money, but find it I do. We have just had our first Chrismassy weekend with my sisters and we had a brilliant time. ( Jimmy Carr was cracking by the way) If I found anyone who was on their own on Christams Day, I would feel duty bound to invite them round rather than have tham on my concience. I have done this in the past and if peeps say they prefer to spend Chrissy on their own then that is fine at least I have offered. Come on peeps, you are a long time dead, my lovely nephew died died last year aged 46, I am glad he made the most of his life, he was the life and soul of every party and sadly missed. You never know what is around the corner. Most of the peeps on here will have had or are still having financial problems, these are minor to what some people have to go through. So all you bah humbugs out there, "GET IN THE CHRISTMAS SPIRIT" :D

Oi, St Hils, your halo is slipping! :razz:

 

Thing is, what makes you obviously thrive is the opposite of what makes me thrive! Nothing to do with being long dead, I just don't like the hustle and bustle and all the activity in general. My idea of an ideal Christmas is to be somewhere hot and non-Christian so they don't even have Christmas there, a good book, and enough cash to keep on topping up my glass of Diet Coke.

 

Add to that the fact that my youngest son is Asperger's Syndrome, so that excitement and surprises and sensory over-stimulation are too much for him to handle. As a result, previous xmases have often ended up with being just too much stress for us parents trying to keep his stress levels down, and for him being unable to process all that was going on around him, invariably leading to meltdown.

 

As the kids are getting older, every year, we are turning the level of decorations and celebrations down a notch further, until hopefully we won't have to do much, and even, with luck, not have to do it at all. Once we're only left with our youngest (the one with AS), we might even be able to get what we want for xmas, that is the warm place described above where we don't have to have anything to do with xmas at all. Now that would be bliss. *sigh*
