    • Because of the tsunami of cases we are having for this scam site, over the weekend I had a look at MET cases we have here stretching back to June 2014.  Yes, ten years. MET have not once had the guts to put a case in front of a judge. In about 5% of cases they have issued court papers in the hope that the motorist will be terrified of going to court and will give in.  However, when the motorist defended, it was MET who bottled it.  Every time.

Just a few follow up questions in light of what's been said:   If I dont appeal to PPM, who can I appeal to?   Why should the PCN been attached to the windscreen? Is this written in law?   I assumed the document I had received was the NTK, if this is not the case, what does a NTK look like?   Regarding the compliance with the Protection of Freedoms Act, could the "period" of parking not be argued either way? The legislation doesnt state it must have a start/end time of parking, which I assumed an ANPR camera would pick up if it had one. Is 4 minutes not technically enough to show the vehicle was parked?    Thanks !

    • Will get them done asap My job changes week to week so at the time I didn’t know. 
    • You will probably get a couple more reminders followed by further demands fro unregulated debt collectors with even increasing amounts to pay. They are all designed to scare you into paying.  Don't. It's a scam site and they do not know who was driving and they know the keeper is not liable to pay the PCN. Also the shop was closed so they have no legitimate interest in keeping the car park clear. So to charge £100 is a penalty as there is no legitimate interest which means that the case would be thrown out if it went to Court.  Keep your money in your wallet and be prepared to ignore all their letters and threats. Doubtful they would go to Court since a lot more people would not pay when they heard  MET lost in Court. However they may just send you a Letter of Claim to test your resolve.  If yoy get one of those, come back to us and we will advise a snotty letter to send them.  You probably already have, but take a look through some of our past Met PCNs to see how they are doing.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Anyone have any dealings with these?

 

In 1995 I took out a Universal Credit loan for £6000 with 60 payments of £145. I paid for a couple of years and run into problems. At this point the balance was £4000. I went to Cab who arranged for the interest to be frozen and payments of £10pm to be made. I kept up with these and was contacted by Paragon (who took over Universal Credit) who said if I paid £15 a month they would clear my credit file and not take any action against me. I kept these payments up for a year (plus the year at £10). I then discovered after paying £25 for my balance that I now owed £12,000 as they had been adding £200 interest a month and taking £15 from me.

 

I cut back on some other payments to pay more to Paragon, £147 a month. They said the interest would be cut to 12 percent, this still took up most of my monthly payments. I carried on paying at this rate until January 2007 when they offered a 6 percent interest rate if I paid £176 a month. To date I have paid £14,600.

 

Paragon have now contacted me again asking for more money otherwise they will increase the interest. They seem very unkeen on telling me how much I actually owe and have sent a form for me to accept my liability to them (they left the amount blank).

 

I feel I have been treated very poorly by them, they have lied many times about the interest rates and keep me in the dark about what I owe. I have already been paying this for 12 years and have paid back £8600 over what I borrowed and still owe goodness knows how many thousands or even tens of thousands.

 

I'm considering seeking legal help on this and would appreciate any advice.

firstly you need to send a CCA request to see if they are legally allowed to collect the debt.

THey have 12+2 days to produce one then the account goes into default. you can then stop payments and intrest has to stop.

The letter you require is Letter N

 

Send the CCA letter to the DCA recorded delievery with a £1 postal order. Make sure you keep the receipt.

Do not sign the letter, sign it with a computer signature.

CCA request as advised.... by rec. delivery... encl. a PO for the £1 fee.... keep the receipt.... and don't sign it. Print a sig. in block caps. or something....

After giving your thread a quick re-read, it seems that Paragon are trying to get you to sign an Agreement with them now. Your original Agreement was not with them however... it was with Universal Credit. This is the one that they will need to locate in order to legally chase you for payment.

 

If they don't have it.... then it's bye bye Paragon.

Paragon called me on Sunday (yes, Sunday) and no doubt charged me £20 for it.

 

They are saying that they will only accept payments of £212 a month as a "reduced" payment. My original credit agreement was for £145, so it's hardy reduced. And they expect an increase every 6 months.

 

I'm writing to ask for my credit agreement and will await the results of that. I do recall that the original Universal Credit agreements state any changes to the interest rate will be given in writing one month in advance. Paragon changed mine from zero percent to 28 percent and applied the interest back over 2 years without ever telling me.

 

They also state they don't have the balance available.

Sismile... you need to stop getting roped into chatting on the 'phone ! This is what they want ! Everything must be in writing from now on. If they 'phone you any more, just hang up, put the receiver down and walk off until they get bored with the silence, or just say "In writing only please" and hang up. The choice is yours.

 

If they have no CCA, then they can make as many demands as they want.... it won't get the account re-enforced and they can't legally demand payments from you. The account will remain in dispute until they can come up with it....

 

As for saying that they don't have the balance available :rolleyes: .... how do they know how much you owe then ? :mad:

 

Send the CCA (the link in post #2 above)... by rec. delivery... and keep the receipt, as advised. Do not sign anything that they send you and do not sign the CCA request with your normal sig.... just in case they decide to play dirty with it.

Unless it's signed, then anyone can type up a CCA for anyone and claim they are owed money. The signature is what makes it binding. It might be best if you start your own thread though, so we know the background of your situation, etc.

What happened to your CAB agreement here? Presumably Paragon told you that because the agreement was with Universal, that it was no longer valid?

Maybe you should explain what's happened to CAB, and get them back on your case.

 

As PriorityOne said above, it's VITAL that you avoid speaking to Paragon on the phone. You MUST get everything in writing. And remember, if you don't get a reply to your CCA in good time, then THEY CANNOT ENFORCE THE DEBT. It sounds to me like they're just squeezing more and more out of you because you agree to it! You must STOP THIS NOW!!

No you can't go to jail for a civil debt.

 

As soon as you read this response please, please phone 0808 808-4000.

 

That's the National Debtline. It's a charity, makes no charges and above all is staffed by qualified debt advisers.

 

It's also instantaneous advice (unless their lines are busy) unlike the CAB where there's an element of chance about the advice your receive and when.

 

Please keep us posted on developments, beacuse in my opinion you are being ripped off.

Counting date of receipt as day zero, they've got 12 working days before they are in default. A further month on they commit an offence.

  • Barclays: WON!!! It took four months but was totally worth it!
  • Cabot: I'm still waiting for an enforcable agreement, more than a year after requesting it. Go on, Uncle Ken, take me to court if you dare. You know you want to!
  • Elephant.co.uk: VICTORY - they admitted there was no debt!
  • Ashbourne Management (gym membership): Finally got my default removed and out-of-court settlement; I'm not finished with them yet!

Hi Folks. Did you read the full page article about Paragon in Sunday's "Financial Mail" (part of the "Mail on Sunday").

 

Not very complimentary!!

 

Seems they have also recently sold a bunch of their debt to Arrow.

 

Good articles, and well worth reading. They should be available on line and if anyone wishes I'll go through the old papers and post the details.
