Just found your thread. Wow you have the big guns here with you - ODC, CurlyBen, dpick etc so you're in REALLY good hands. Stick to what they have told you. Your last post shows that you are more relaxed about it all now .

 

I sent my CCA request directly to Littlewoods and they wrote back three weeks later to say that they would not be pursuing me for the debt as they do not have an agreement for me. My debt was not as much as yours but still worrying enough (for me). Approx £650. They have said that they will keep the data on their internal files and on the CRA files for 6 years and will mark the debt as unsatisfied (we'll see about that).

 

Good luck with it all. I've subscribed to your thread to watch your progress and help in anyway I can (although I'll not get a word in edgeways for all the talent that's on this thread )!!!

DEDEE! however beware! just because they tell you they wont pursue the debt, wont stop them entering a default on your credit file - thats what they have done to me and im fighting it.

 

Manf - let us know what happens, i hate littlewoods and am out to help everyone i can!

now this isnt their main number, they told me they were having problems with that but if i sent it to that number it would reach them.

its very handy to have fax numbers - you fax what you want, print out the fax header to say its been sent, and saves on recorded delivery!

I'm off to read your thread in a bit. Saw your PM but have only just got home in the last hour .

 

Littlewoods have already defaulted me (circa 2004 I think), so this is not an issue for me. What is an issue is that they clearly have not followed the procedure before defaulting my account and neither have they complied with my CCA request. There were also charges levied on the account too.

 

I'm trying to ascertain the best strategy to deal with this.

Always send a CCA (consumer credit act request) to the DCA (debt collection agent) and for the OC (original Creditor) send a SAR and look at reclaiming charges

Normally I'd wait before approaching the OC to see what the DCA turns up.

i sent littlewoods a CCA because i KNEW there were no charges to reclaim (lucky for them) but yea otherwise if you think there may be charges i would send them an SAR.

 

again use a postal order and dont sign usin your real signature!

When it comes to signing letters I find adding a signature line a good idea, makes photoshop specials almost impossible.

 

I tend tou use something like this #_______*_______# and sign over it.

I've been down this road, Information Commissioners Office & CRA won't do owt the only option you have available is to take them to court, serve them with a S10/12 notice & follow up with court action after 21 days if you can afford it .

 

Anyone know of a better way, I'm happy to be corrected
