Hello, Ive been with Abbey Nat. for a number of years. I have paid several thousands of pounds in Bank Charges over the years due to unauthorised overdrafts and returned cheques, etc. Even when ive been in credit they still manage to bounce Direct Debits ie my mortgage, they tell me my balance which shows in statements (even from AGM machines) isnt actually my current balance????? Can anyone advise me. thanks

Can anybody advise you on what?

 

If you want to know how to claim your charges back you need to spend a couple of days having a thorough read through the FAQs - There is a lot of info in there including a step-by-step guide. Also have a browse round the forums you will pick up a lot of advice.

barracad is right. Have a good read around, especially the FAQs, but just the general forums as well. But in essence, all your charges can be reclaimed.

 

Once you've got to grips with how the site runs, then everyone will help you along the way with any of the finer details.

Quite often the balance on your statement is not the balance available as there may be cheques waiting to clear into your account.

 

It also seems to me that any Standing Orders or Direct Debits leave your account first, and then any funds due to clear that day clear later on - something else to bear in mind.

thanks for your replies. ive only registered here today so am a novice. Ive read lots and its been a g8t help. Apparently i can claim back all bank charges yipeeee. So i guess my best way forward is to write to Abbey requesting a refund. Will let you know how i get on. Thanks again.

When I first joined, probably like many, I was amazed that this was possible. However, I was terrified of the thought of having to go to small claims court should it go all the way.

 

Now, 6 weeks later and countless hours reading around the site, I'm more than willing to go to court and fight my corner.

 

Its great how much help is provided in this site, but even more than that, after a while, you just get sick of the fact that these banks (and other businesses) are shafting us senseless, and that its about time we stood up to them.

 

I've now got a completely different mentality to the one I used to have. Well done to everyone on CAG.

hello - Ive read around the forums and FAQs, alot of food for thought but extremely informative and helpful. Organised and typed up my DPA letter and requesting list of transactions/charges for 6 yrs. the show begins.:)

Hello all; as prev mentioned sent letter re DPA request accompanied by £10 to have list of or statements of charges applied to my account over 6 years. Two letters arrived from Abbey today:

"under a Data Protection Act Request you will only receive the transactions that are currently held on our systems. Any earlier trans. have been archived onto microfiche which is not covered by DPA. .... these transactions will not therefore be supplied to you under DAP and not subject to 40 day ruling. We are unable to supply a list of charges applied to ur account for the last 6 yrs because we do not store this information separately from other transactional data. We can ... supply details of the transactions held on the microfiche on payment of an admin fee ie £5 per A/c for 1 monthly statement - £10 per account for multiple monthly statements. In relation to manual transactions - not all interventions are recorded ... ie some interventions may relate to work carried out by a dept rather than individuals where no central record of activity is kept" blah blah blah

 

What am understanding from all that is I will receive the transactions currently held on their systems. For Microfiche data not covered by DPA i will be charged as outlined above and is not subject to a 40 day ruling. And in relation to manual intervention they dont keep records.

 

Any one advise me on the next step,, its a joke.:mad:

Typical Abbey staling again.

 

This is a tactic they have used time and time again.

They DO have a requirement under the DPA to let you have information that is inteligible.

They cannot charge you more than 10.00 to supply this so dont have non of it.

 

If they dont supply within the 40 days they are in breach.

 

There are other cases which have had the same response.

Received bank statements from Abbey today from June 05 to June 06 charges then amount to £1,875.38. Managed to hoke about upstairs and found more statements from Dec 04 to April 05. Total of charges applied to account so far are £2,807.38. Ive wrote of again today re microfiche argument sent it 1st class recorded delivery and letting them know they have 25 days left to comply or ELSE.

dont forget its your choice to push on with the next stage if you wish,and have a substantial amount to claim.

You can make them aware in the prelim letter that you are definately going for the x amount you are aware of and inform them that you will be claiming any additional charges if you find these have been applied on the data still to be supplied.

I am in the exact situation as you, I received 12 months worth of statements same as you yesterday, and the crappy letter about microfiche the same. I have read Martins reply, and to will be sending the same letter (Alans) tomorrow recorded delivery. I have had £940 charges in 12 month. I will follow your thread if its OK, As we are both in the early stages with Abbey and I'm not quite sure what comes next. :) .

 

Good Luck and keep posting as I may need some guidence.

Yorkshire Bank/Visa - Data Protection Act S.A.R - (Subject Access Request) sent. Visa Prelim sent £235. No statements as yet for Bank Account.

Hello Murphy55 did you receive all ur statements individually along with a load of crap about loans, etc. The poor trees? As soon as I hear anything ill let u know regarding a copy of Alan's letter i sent which they should have today. Will promise to keep in touch, Keep the head up.

Hi Candles. Yes I got my letters all individual envelopes. I sent (Alans) letter today registered post, reminding them that they only had 17 days left to comply with the Data Protection Act. Good to feel I dont have to go this alone (if you know what I mean). My husband just smiles at me and gives me a pat on the head when I'm on the Forum. He thinks I am wasting my time and is amused at the fact we mere mortals are daring to take on the FAT CATS of this world. He will soon be on my case asking me to help him claim around £4,000 back from a closed account from the YORKSHIRE BANK. I will keep you informed. Thanks to everyone for there help. :oops:

Martin's right if we all inform each other of their tactics we can be one step ahead of them. When I think of the times I have been to the bank and they have taken all my money out and I have had to wait for them to refund it back. e.g £145 for a DD and kept it 2 days, then charged me because the DD was for £146.50 and still not paid DD. Even though you dont have enough in the account they will take what ever is in there hold it for afew days so you cant get at it and then refund it into your acount, informing you it has'nt been paid but hey don't despair we are charging you £35 for not paying it because you were £1.50p short. Bleep Bleep Bleep. No more Abbey National.

 

And another thing they do, I have my Child Benefit paid in monthly, and I cant remeber the last time I had any of it, because my Bank charges always always come out on the day my Child Benefit goes in. I have 3 children so get around £150 a month I dont get it Shabby Abbey gets it. Has anyone else noticed this?.

 

Sorry For Ranting - But we have had to do without food sometimes because of there tactics.

hi Murphy; my hubby does exactly the same as urs. Mind thinks ive lost the plot but i just smile. Wait til we get r money refunded and us girls will go on a shopping spree. Will keep u posted. Murphy why dont u open another account else where if u can away from Abbey Shabby, i know its a bloody disgrace but they dont care. What i have done though is open a new bank account and transferred my salary and travel expenses into it. Presently my Abbey National A/c is £230dr in charges and they can go and jump for it. AS ive said keep the head up. Take care. Will keep u posted.

I have recently received a years worh of statements and Microfiche (fob off )letter. Abbey have until the 24/07 to comply with my request for information on charges in the last six years. Shall I wait untill this time is up or can i do anything in the meanwhile perhaps call the complience 'team'?

 

I am unsure of exactly of how much I'm due because i haven't got all the information from Abbey as yet! However from the look of the charges I have been given its likely to be in the region of 2-3 thou.

 

This site is such a help Will be donating DEFO!
