    • Not completely black and white. ICO says if you ask for the information to be sent in a particula way, in your case electronically, then they should send in that way "if possible". So I suggest making that request firmly. I would guess if they actually only hold paper copies they'd be with their rIght to decline to scan everything for you. Or they could transcribe just your personal information.

    • Regarding SARs - does the recipient provide hard or digital copies of info?  I sent out a request recently. All the info was digital and I'd like it sent digitally - for expedience -  but they want to post hard copies.  Can I demand digitally?  If it's hard then I will have to labour over scanning it all back in to my computer - which is a waste of my resources.  I had this issue recently with a lawyer - they said they had too much info to send by email. Yet miraculously found a way within 2h. (It would be useful to have hard copies too - but in terms of short-term follow up communication digital is best for me)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just recieved a letter from BOS kicking out my claim against them for over £20K because the charges happened more than 6 years ago but this thread has given me the belief to keep at them to get back what is rightfully mine.:cool:

More reading up on this forum then a reply letter off to them.

Consider sending this to them and simultaneously filing an immediate complaint with the Information Commissioners Office. Just about to send off my Prelims for the CC and Current Accounts and wondered if we have an 'interest Guru' around who might be prepared to have a look at my workings beforehand?

 

I have all the data (charges and dates) entered, I'm just not sure the s/sheets I am using were engineered for pre-6 years claims; and I want to make sure I'm claiming back all I can be in terms of both interest on penalties and S69 at the Court stage.

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

Help! :(

 

I'm getting in a bit of a flap about o/d interest again. I'm not sure whether the spreadsheets are designed to go back as far as my claim (20 years in my case).

 

I've tried the advanced one and that produces a different figure in the for the interest on penalties in each of the 'charges and interest' and '8% interest' tabs. I'm not even sure what o/d interest rate is assumed by this spreadsheet.

 

I've also tried a completely different sheet UKAV very kindly gave to me but this seems to use a entirely different method, whereby I have to try and estimate my average o/d balance for the month and I'm not sure exactly how to go about this.

 

I'm half-tempted to say 'b*gger it' I'll just go for the principal with no interest, then the judicial if it goes to court. But then I think about the way these people have siphoned money from me over the past 20 years and I think should very definitely claim back the interest :mad:

 

Anyone out there willing/able to take a quick peek at my sheets and help me sort this?

Now what's all this Mac? I never thought you would concede defeat in a million years.

I'm no expert, but I would most likely think that all the s/sheets stand at 8% interest. I'm sure UK can help you with his sheet, I personally used the simple charges calculator s/sheet as it was much more straight forward to understand than the complex one.

Oh I can assure you I'm no way condeding defeat, Ja-de :D Cavalry is on its way to help apparently and I'm grateful in the extreme for that!

 

Although I understand the arguments for charges, o/d interest, judicial and contractual interest, I'm not sure that the sheets I'm using are calculating this back as far as my claim goes. Current thinking is that I'll probably go for charges +simple o/d + S.69 and forget contractual.

 

I'm sure I'll get there in the end though and thanks for the encouragement ;)

Fellow-flyer UKAviator and Photoman have both come to the rescue over the past few days with regard to the spreadsheets and interest calculation - and I'm pretty much set on my course now - I'm going contractual on both the current account and the card; and of course will be claiming both all the way back!

 

I have plenty of reading to do and hopefully will get my re-worded prelims out this week and start drafting the POCs in time for just after the hols :D
