    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. Anyway I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all.

 

I sent off my acceptance form for full amount on Saturday night, they would have received it by now (I used their freepost address so didnt obtain proof of delivery). Nothing in my account yet though. It states on the letter it will take up to 14 days. I'm preparing myself for it to take 13.5, for some reason :rolleyes:.

 

If you've won vs. Halifax, can you please post a) how long it took for them to pay once you sent off your acceptance form and b) roughly how long ago it was they paid out (month/year?).

 

That way I can attempt to gauge how long this will take, and whether or not I should get a loan :D Thanks!

The lady I spoke to was slightly surly, but I'm sure it gets on your nerves with all these people ringing in and threatening to sue your company (!).

 

I was told by a member on this forum that the more you hassle them, the longer it takes. I usually 'get results' by ringing 2-3 times a day until they listen, but in this instance I think I'll just have to sit back and wait. For the time being anyway. :(

The lady you spoke to, was this the same person who's name was on the full offer letter you received, this is the person who you need to talk to and this is the person who will be more than happy to assist, im sure if you managed to speak to this person you would be informed of when you will have your cheque/account pay in. Politely refuse to speak to others as they will probably not be able to answer other than within 2 weeks.

It took about two months in my case. I didn't bother for a month and then phoned, and didn't get anywhere. I then rang three or four times over a couple of days a month later, and got the money paid into my account. They had closed the file thinking the money had been paid. I'll be asking them for interest.

If it takes two weeks then at least that's as long as it WILL take. If I don't bother they will think I'm giving up.

 

I tried to speak to the lady twice, but of course, she wasn't there on both those days. Probably a fictional character knowing the Halifax. Or "on holiday".

I am in the same position as you.

 

I sent my acceptance letter off and have called to confirm they received it. They confirmed they received it on the 1st March. Still nothing in account as yet but will keep you posted.

yeh I'm in the same boat too. rang them on Monday to ask where it was and they confirmed they received my acceptance letter on 1st March and it usually takes 5 days to clear in my account. by my calculations that should mean it would have been in today. but it isn't.

 

im gonna give them a call now to see what they say.

I've just spoken to my Review manager and apparently they have sent the requistion to the cashier this morning and should take 1-3 working days to clear.

 

so Tuesday me thinks, if not then I'll get on the phone to tha bastards and threaten court action.

Hi - I was successful against Halifax too :D

 

I faxed off my acceptance on the Monday morning, as well as posting it too. The funds were in my account by the Thursday lunchtime of the same week.

 

Give them a ring, just to see that your acceptance is on the system and just ask how long it may be until the money is in your account. I rang a couple of times and was just told it would take up to 14 days. About an hour after my second "nudging" call, the funds were in the account.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Gave them a call just now, nothing yet. They are saying they haven't received the form (apparently due to the large number of claims atm).

 

Still, I'm hopeful I'll get it by tomorrow.

 

By the way guys, the lady who wrote the letter and signed in is called Michelle Hazlett. After ringing the 01977 number on the letter, I was told one day she was not in that day, and now I'm being told she has moved departments.

 

I now have to ring through the customer relations dept. and press option 2. The people on the 01977 number won't even speak to me about bank charges! Weird!

 

Anyone had any luck with the 01977 no? (01977 672349). If I can just *talk* to this Ms Hazlett it would put my mind at ease..

I'm still waiting, 14 days up next Tue, tried phoning twice a day but to no avail, think I just peed them off, if it isnt in my account Tue then I'm filing for the whole amount plus intrest as their time is up with the court the same day, in a way I hope they dont pay it in in time ;)

Bit of an update/useful info.

 

Try calling this number: 01422 326326

 

Ask to speak to 'either Kelly Duffy or (the person who wrote you the letter)'

 

They will then handle you in a more 'professional' manner than compared with the 0870 customer relations people.

 

I've requested a ringback from Ms Hazlett and will hopefully be wrapping this up today. I think this is an internal number/rarely given out. The gentleman on that line hinted that they could get the funds moved into my account asap :|.

Same boat acceptance was received back 1st March (thurs) have been told up to 14 WORKING DAYS!!!! so that would be 18 days phoned again today nothing yet will phone guy who sent acceptance form 2moro if not in by lunchtime 2moro i think a week is long enough to hit the magic button.!!

Not sure where the 01977 number is based, sounds somewhere 'up north' though, going by their accents :D

 

The lady rang me back within an hour. Usual story, "please wait".

 

I will take them to court if they do not pay up (can I do this if I've signed the acceptance) If I can, I won't cave in, I'll push for the court fee + interest. It's not fair we have to wait 14 days. :o

just to let you know guys that in my previous replies I rang my Review manager at around 10am this morning and she said that somebody had sent the requisition to the Cashier this morning (im thinking that she had done it there and then)

 

and 3pm came along and the £1948 has been debited to my account!

"we accept offer of.....from Halifax in full and final settlement of my/our complaint regarding bank charges on my/our Halifax accounts."

 

The word "accounts" is, very obviously, in the plural.

 

My question is this. If you had 2 Halifax accounts and made 2 complaints. If you settled on the first and signed an acceptance containing the above phrase. Have you just shot yourself in the foot?

Not really, I have taken it that they have solved my complaint this time by paying up in full, my next complaint is for the previous 3 years. Read somewhere that their reply wont hold up well in court either.

I telephoned them on monday 5th March to be told they had received the acceptance that morning and it would be up to 14 days. Called again on wednesday for an update and was told 7-14 days but they normally pay out quicker. Called again 10 mins ago to be told up to 14 days.:confused:

 

Seems like there is no set time and no set payout system in place and I think it's a case of wait and see. If they exceed the 14 days though I think it is a case of submit your court claim and get the interest off them aswell for the delay.:p

 

Ah well....off to South Wales this weekend so would have been nice if it was in the account today... :rolleyes:

 

Do they pay out on the overnight update or do they just credit it anytime during the day ????

Hi all

 

Need some advice. Halifax are saying that they have not received my acceptance form, which I sent off a week ago.

 

I requested another copy to be sent to me immediately, but the lady on the other end of the phone said that would interfere with the original acceptance form I sent (assuming they will receive it).

 

What should I do? I cannot be bothered to keep waiting and waiting now that I've won.
