Hi,

I posted my acceptance form on Thurs 22 Feb. Rang on Mon 26 to check they'd recieved it. They said not but try the next day. Rang the next day (Tues 27) and was told it had been recieved and the money would be in in 14 working days from then. I did remind them that the original deadline from my LBA still stood (6 March). But money actually arrived in account yesterday, so pretty quick really.

Not sure if it was the phone calls that did it, but it can't hurt to remind them your still on the case and time is ticking...

£562 in charges

06/02/07 - Sent preliminary letter recorded delivery to branch.

10/02/07 - Recieved 'passed to complaints dept' letter from

branch assistant manager.

20/02/07 - Sent LBA recorded delivery to branch.

22/02/07 - Recieved letter from complaints dept offering £444.

Called in person to reject and was offered full amount there and then. Posted back amended acceptance form.

:)Donated 5% of money recieved because I would never have got my money back without this site - please do the same when (not if!) you get yours back too

Hi Hedgehog, im waiting 4 my money 2 arrive, but my friend got his money yesterday, 15 days after posting his acceptance letter, hope this helps!!

I filed on 19th Feb. No news since, nothing. I rang them twice on Thursday to see if they received, they said they hadn't (liars).

 

I'm gonna be ringing them up first thing tomorrow (SAT) and keep asking until they confess they've got it. By the way, their "customer relations" phonelines are open at the weekend for a few hours, despite what they say in the recorded message.

 

 

Wish me luck someone.

What are all the circumstances of your claim and offer? What's happened so far to get you to this point?

It was just a general thought really. I am on day 10 of waiting for the £4000 payout. I noticed that a few people had not been payed out until the last minute and just wondered if it came to it what would be the next step if they didn't pay out within the 14 day period.

I had no problem getting the offer and acccepting / returning the acceptance etc.

Did their offer stipulate that they'd pay within 14 days? If it did and they don't I'd call them and tell them you'll give them 24 hours to sort it or you'll submit a claim.

Having just called Halifax and informed them that the 14 days for payment is up tomorrow I have been told that they are now taking up to 28 WORKING days before payment due to the volume of claims.

 

I hinted at filing a court claim and the response I got was 'that will take longer than waiting for the current claim to be paid'.

 

WHAT THE HECK DO I DO NOW ???:mad:

Im no expert but i would say that this is just another attempt at them trying to prolong your claim, just carry on with your timescale. As many people have said on this site, its your money not theirs!!!

I would very much doubt it if it went that far, if you file to court then the bank has time to decide whether to file a defence or not and if you read around some other threads you will see that alot of other people have been in your situation and it never ends up going that far. They usually end up settling rather than file a defence and go to court

The banks dont want it to go to court as it will set a precident for them in the future.

I have won the case and sent the acceptance letter to them. They them stated it would be up to 14 working days for the money to be in my account. Now they are saying it could be up to 28 working days.

They made the offer 8 days after receiving the LBA.

 

My issue is that they stated that it would be 14 working days for the money to be in my account. This is now complete rubbish. It seems they can take as long as they want!!!

Did you win at court?

or did they offer you full settlement at what stage?

 

If they offered at LBA stage, you could tell them that you ceased your proceedings on the understanding that you would have the funds within 14 days. Tell them that you will reinstate your proceedings if the funds are in your account by friday(say) and then they will be liable for interest plus all court costs, and an application will be made for expenses, As you believe this is a deliberate delaying tactic to prevent court action and this will be brought to the attention of the courts

the lady on the phone said it would be fine if I want to cancel the payment of the offer and if I want to go through the courts then that is up to me.

 

I can't afford to be waiting around or hanging on another 8 weeks while a court claim goes through.

I would send them a letter (or fax) briefly outlining the points i have raised in #9.

It might gee them up a bit, it might not.

Its really up to you.

 

Did they settle for the full amnount you were claiming? as this may have an effect if you go down the court route
