    • You have to request judgement when no defence submitted.. The question is how with Money  Claim Online?
    • There are example threads where AOS is done but defences are submitted late, it happens, sometimes because MCOL is broken! As the claimant you will be able to reference a late filing and request it be struck out for not following Court Directions, for example if the defendant arrived at court with it on the day without submitting... but I believe there is some (slight) wriggle room for defendants (reasons depending) on late defence. I believe you just need to continue your claim, no defence and not following court directions will almost certainly strengthen your case
    • I'm afraid it's against site rules to recommend lawyers. You could look on the Law Society's Find a Solicitor page for local firms with the right expertise, or google nwnf lawyers in the uk, then check out reviews on social media, review websites and so on, to see how other people rate them.     • Thanks for that information. I seem to think they have similar names and similar addresses and I thought it was Aldi that was offering the great deal that attracted you to that car park. So we are still stuck with Nexus. Please do not call DCBL about a settlement figure.The first reason is that they have your telephone number which is not something you want to give to those vultures as you rightly call them. They will then harass you on the phone and try and send you last minute details the day before the case -which they shouldn't do. And second they are already charging you £60 to £70 more than they should lawfully, to that they will then add the Court costs that they haven't yet paid or incurred and then say that they will give you this great offer of £150 to avoid going to court.Big deal-not. Were it around £50 that would be a better deal but they would not accept that.   
    • Hugo, how are you getting on? the deadlines can creep up on you. It's useful to have a week or two in drafting a defence, so you can understand it for yourself before submitting. Read other like threads for examples and tailor to suit you. Get one drafted and posted (without personal info) and let us take a look

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi every Friday and Saterday night I get phone calls on my mobile from people who want a taxi. When I ask them where they got my number they always say 118118 gave it to them. I contacted 118 and after a very long conversation with a person with a basic command of english I was put through to a supervisor who said basicaly she couldn't help.

 

Any ideas on how to get this stopped? TIA

Do they have another number recorded for the taxi company ? The numbers they are use those that 192 used to use. It appears that someone has recorded an incorrect number against the firm. They have a website so it may be worth getting their actual phone number (not 118118 lol) and calling them or emailing them.

Well I complained by email and got this in reply

 

We have received your email with reference to your Directory Entry.

The Directory Service that we provide lists Customers for all Telephone companies. To ensure all Customers details are handled safely and in accordance with the Data Protection Act we are unable to change the Directory details ourselves for other Service Providers.

As a company other than BT provides your telephone service you will need to contact them directly, this will be your mobile telephone company.

The Directory Enquiry National Database will reflect the changes shortly after the amendments have been made by your Service Provider.

So it's off to Vodafone now to see what they have to say.:)

Vodafone just confirmed they don't put numbers onto the directory unless you ask them to, I haven't. Somehow Thomson Directories has got my number attached to a local Taxi firm and when people phone 118118 to call this firm and the number is busy they give mine out as an alternative off to Thomson Directories now!

:D Might be easier to dump the phone! Still, with 118118 also doing Classified Searches, Thompson are the hot choice for this info, the trouble is identifying their location - as (strictly speaking) they shouldn't tell you!

get your number to forward to a premium one and reap the rewards

 

Surely if your own number diverted to a Premium Number you would be charged the premium rate and not the original caller.

 

To do it would require your number leaving a message for the caller to redial the Premium Number, but then you would be taking it out on the innocent caller who is only dialing the number given to them.

PUTTING IT IN WRITING & KEEPING COPIES IS A MUST FOR SUCCESS

Nice one Seahorse :) Got it all sorted, Thomson Directories did a few checks phoned both the taxi firm and me to confirm we wanted my number removed from the database. And this weekend was the quietest I've had in months. They couldn't explain how my number got linked to the Taxi firm though
