    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If you know of a DCA registered as dormant Check it out on web check at Companies House web site. Look and see if Dormant It will say Dormant the bit that says Active can be ignored . If so.

If you have a Receipt, Standing Order form or Direct Form, Letter or anything send an enquiry to Companies House to find out If they should be trading at the time of your letter etc .If they were trading and should not have been, Copy the letter (blank out your details etc) and send off to these nice people

Is it that way or the other way around ?

I've got paperwork as Apex Credit Management Ltd.

this is the questions sent to CH today

 

This is the questions I asked Companies house today. Their first reply avoided the whole issue completely

 

 

I have sent off documentation, however there was another couple of

questions on the Email

1) This company used the name Apex Credit Management Ltd for a very

short

period Were they using it in 2003-4?

2) What action will you take against them if this is the case?

3). Does the fact that banks are possibly shareholders in them have any

influence in the fact that no action is taken?

4)I find it hard to believe that I am the only one that has noticed this

practice?

Company Number 03967099 BCW GROUP PLC

 

I can confirm that the company was called Apex Credit Management Ltd from 05/06/2000 until 04/07/2006.

 

I am unable to comment on any action we may take against the companies, which are claiming to be dormant but are trading, as this is dealt with by the Companies Administration Dept., who will need to examine any documentation you have sent them before any decisions are made.

 

I am also unable to comment on any comments/complaints by a third party, as everything is confidential due to data protection reason.

I have loads of correspondence from DLC and the site says they are dormant. What would Companies House actually do if they aren't supposed to trade?

 

I also have correspondence from HL Legal Solicitors who are in liquidation.

 

Thoughts anyone? Stivis?

Ah, should have looked closer at the CH website! Apex Credit Management became BCW Group Limited on 4 July 2006. BCW Group Limited then became BCW Group plc on 20 July 2006.

I have had demands for an old debt with argos from bcw, even though i have a letter from argos saying that the debt is now owned by cabot.

I had been paying argos direct until last month when i received the letter from argos and then got a phone call from bcw saying i was trying to avoid paying and that they would be sending a 'field officer' to my house to collect all of the outstanding amount (about £1900).

Why would cabot need bcw to collect money for them ?..very odd.

I have bank statements going back to 2002 which show receipts by Global Debt Management Services Limited every month until recently.... listed as non-trading, with dormant company accounts filed up until 2005... next one's due this year. Owned by Alliance & Leicester.

Blackrain, i dont know if H.L.Legal are in liquidation but i also have a very sturn demand from them on behalf of capquest, on my letter dated 24 jan 07 under the headed H L Legal it says in assoiation with Sampson & co,

Blair, Oliver and Scott are listed as Dormant, however i still get letters from them, had a look at companies house register and they appear to be active, no expert though.

Can somebody please clear up what it means by either dormant or non-trading? I received a letter recently from Blair, Oliver and Scott on an issue relatiing to a loan with Intelligent Finance, so how can a company appear to be non-active when they're still sending out correspondence?

Hi all

 

Just dropped in - this is very interesting. I just wish I had kept all my old letters from the many DC's I've happened upon in my years.

 

What I have noticed tho is that apparantly BCW Group only formed on 20/July/ 2006 yet I have a letter from them on the 23rd May 2006.

 

On the 27th May 2006 I got a letter from gpb (geoffrey parker bourne) solicitors for their client Aktiv Kapital First Investment Ltd for the same debt.

 

(This was at the same time that Aktiv Kapital could not supply the cca agreement)

 

Very confusing stuff, the way they all seem to be in cohoots with each other.

But anyway the BCW Group plc is the opposite of the way you originally asked for proof of paperwork but if it would help you are welcome to it.

 

Ah yes and Welcome Finance (owned by cattles) trade in NI as a loan lender who chase their own debts.

I just got a letter from GPB.. Thy claim I owe £340 and they are offering me the opportunity of negotiating terms of settlement before they proceed with legal action. Isnt that nice of them!

To negotiate, I must phone 0870 060 **** And there was me thinking that 0870 numbers contravened the OFT guidance on debt collection...

Still...as they havnt given me any more details as to the origin of this so called debt, Im thinking of filing a complaint. As I understand it from other threads, GPB aren't in possesion of a consumer credit licence and this is needed for persuing debts. Am I right or wrong?!

It means that there should be no business activity through the company. They should be receiving no money through their accounts. If they act on behalf of someone else (in this case Bank of Scotland) their trading status should be 'agent'.

 

This is one of the companies that will be investigated. Please, if anyone has any correspondence from them, please pm me!!! This is urgent. We can fight against these DCAs and let the tax authorities deal with them!

 

Please, please let me know if you have any correspondence from any dormant DCA.
