    • Sorry for late reply dx been away and appreciate your replies. Yes he has paid the original borrowed amount off but obviously interest on top in which is owed and offer to write off. I know it is only a small amount owing but I didn't know whether to attempt to pursue with reclaim of previous paid amount plus interest. Or just to accept their offer and have removed from Credit File.

    • You were given this PCN because you overstayed not because you went to Starbucks or MaccyDs from the other car park. I assume therefore that the parking time is only 30 minutes as you were recorded as being there for 38 minutes. Given that there is a Consideration time and a Grace period  as well as the time between their photographs of your car arriving and leaving one wonders why they gave you a ticket. Force of habit I suppose. Because they are on airport land which is governed by Bye Laws that supercede PoFA we do not usually look at their PCNs there because in none of them can the charge be transferred from the driver to the keeper  as would normally happen after 28 days if the charge is unpaid and the land is not subject to Byelaws. In your case as they have failed to specify the Parking period  which is the time car is spent actually parked in a parking space not the bit that they include which is driving from the entrance to the parking space and the other bit from the parking space to the exit. As that reduces the lawful time you were actually parked I would suggest that they have breached your GDPR.

    • Original credit agreement for them to prove the debt. Post 2 is the pro rota, I did this to the Original creditors sometime ago with offers of payment i got no reply, soon after the dca started sending me letters and phone calls. Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Received a faulty laptop from currys.

Sent it back and despite proof of delivery of return they denied receiving it.

I filed a dispute with my bank but apparently there were missing documents I didn't send (although I'm not sure I ever received a request for them)

filed with MCOL against currys.

I've had a look but there doesn't seem to be many recent cases. 

My only concern is I took currys PLC to court, would this be the right one? (there's many currys on companies house)

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I suppose that you are saying that you sued Currys and did you sue them in the right name?
How on earth would we know?

You given us absolutely no details and in particular we have no idea what name was on the receipt, for instance.

We don't know what the story is – although it is slightly more obvious than the other two threads that you started the last 24 hours.

You are asking this question now even though you have already issued the claim and as I gather, you have already had exactly the same issue of incorrectly identifying your defendant in a previous case when you have been suing UPS.

The receipt just says currys.

Update - AOS filed by Manpriet Kapoor, extending deadline until 30 October 2023.

 

Breakdown of dispute:

Item: Laptop

Cost: 699.00 GBP

reason for dispute: Faulty screen, returned to store and advised to send it back. sent it back tracked & signed for. GPS delivery scan shows currys RDC but they denied receiving it.  Filed an official complaint with the SCC email and was essentially told not their issue. Tried a chargeback but bank was missing a letter i sent and by the time I resent it they were out of time.

 

Will update with defence when received and hope the context helps explain things more.

I received defence today. However I notice they have blatantly lied in their defence saying I did not respond to them when I did. (defence point 2.8)

Given its signed by a declaration of truth can I ask it to be struck out by presenting the evidence they received the information ?

The answer to your question is that – no this is not the time to start applying for strikeouts.

But more generally, I made the point in my first post to this thread that you hadn't given us any information – and frankly that hasn't changed.
We are helping you with a lot of these very similar cases. We have already pointed out that you give us minimal information and you refer to other threads rather than explain each thread what has happened.

We haven't had sight of your claim form only a rough summary of the issues.

If I look through this, I can see that your whole way of dealing with things is pretty haphazard – missing documents, wrong company names, and a very cavalier way of asking us for our help. Maybe it's because we're doing it for free that you aren't particular bothered.

If you don't give us the claim form here then there is nothing else that we are going to do and I can tell you now that if you have any more of these cases running you don't present properly in the opening post – and let's face it you have lots of  experience – then I simply won't get involved. Maybe others will but it will be up to them.

Hi,

Apologies for the lack of detail in the opening post.

I bought a laptop from currys back on January 28.

The screen became faulty within 2-3 days.

I went back to the store and spoke to one of the people.

He tried a few things such as resetting it etc but it didn't work.

He then advised me to send it back to their main warehouse with a copy of the receipt and they would either replace or refund it depending on if they could fix it and had stock available or not.

I sent it back and it was signed and delivered and they came back saying a refund would be issued within 3-5 days but it was never issued. (I kept records of these conversations).

I then got back in contact with the SCC people who then said that they never received it.

I supplied the courier's GPS evidence but they remained of the same position that they never got it.

I took it to their ADR partner but as seems to occur a lot, ADR went in their favour.

Who is the so-called ADR partner?

Why did you consent to it and how were the proceedings conducted

Hi BF,

It was CDRL.  I consented to it because I'm aware the courts favour people trying ADR before going to court. The proceedings were conducted in writing as all CDRL cases are.
