    • Hi dx, the only secured debt we have is the mortgage on our property and that is a joint mortgage.  all payments are up to date with a clean credit file albeit with a of debt so no missed payments etc sorry what is f&fs? If I am made redundant I am not wasting it on paying all this unsecured debt down and leaving my family broke. This is the dilemma I am currently in. i am not sure I can mentally keep living the way I am I am weighing up how to deal with it without leading to needless ccj threats etc… not sure what direction I am to go in. Hi uncle, okay but 3-6 years of a bank owning my debt means our files are destroyed for longer than 10 years based on that ? Not sure this works out for us that way? Unless I am misunderstanding you
    • How are you funding the privately run supported living housing in the new city ?  Why are you moving? Have you served in armed forces previously? If you are registered with the existing Council as disabled or have other needs they assist with, then depending on the reasons for needing to move, your current Council may help with costs of moving. But you would have to submit an application to them. So you are best to speak to your current council about the help you are seeking.  It is not about a Council being responsible as I don't think there are specific laws saying a Council has to help with costs of transportation. And in regard to Housing costs in new city, as this is going to be private, I don't think the Council will pay under Housing Benefits. You might have to claim Universal Credit, but UC might not cover the full cost as Housing is limited to Local Housing Allowance. Citizens Advice are generally worth contacting about complex Housing issues.

    • But if it’s the bank themselves emailing me to say they are now looking after the debt… so I still ignore?  also I’ve checked my spam and I’ve had an email from the bank to say that J&P are now also acting on their behalf?  How can they pass it on to two agencies? I’ve not seen any threads with this situation before?  they know from my letter I’m not working atm and  have no assets etc

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

Wondering if anyone can help. Quite upset about this. I've only just found out about this as I have applied for a mortgage and the mortgage broker told my wife that the only reason we can't go ahead and buy our new home is because I've missed 4 payments with Three. I haven't had a contract with Three since 2018.

I defaulted on a Three mobile account back in 2018. Went through a tough time, couldn't afford to pay my debts over so offered creditors token payments as it's all I could afford at the time, hence the default. That default was entered on my TransUnion and Experian reports in December 2018. Looking at the payment history it has showed 'D' (defaulted) from December 2018 for every month up until May 2023 when it stopped being reported for some reason.

When I was asked to take a look at my credit report by the broker, I had no idea what she meant because as far as I was aware the account had defaulted almost 5 years ago. When I looked, it seems Three have created a NEW account entry on my credit reports, I now show as having 2 accounts. Both with the same start date, 04 August 2017. The original one shows all my payment history up until May 2023 when reporting stopped. 

On the 'new' Three entry on my reports, there is no payment history from the last 5 years other than an 4 missed payments. I believe this isn't right as the only missed payments that should have been reported on my Three account are the ones from before the default in 2018. Also, why  have they made a brand new account on my report, with 4 missed payments when the account was closed a long time ago due to default. On my credit report it's appearing as  a brand new account, incorrectly reporting missed payments and now our mortgage broker says we can't go ahead with the house due to this one issue.

Could anyone advise what to do here? Tried calling Three earlier today and got absolutely nowhere. Nobody seems to be able to help or want to help to be honest.

When I took the decision to default on my debts I knew the consequences and my credit rating would suffer for a number of years. Worked so hard to get back to a reasonably ok financial position, never missed any payments since I defaulted on my debts and all we have wanted since sorting out debts is to buy a home. We are so close yet can't because Three have messed my credit file up.

Any advice would be much appreciated.

Three are moving to a new system. I think thats why you have 2 accounts on your Credit File

Raise a formal complaint via the CEO - It wont get fixed quick

this is the big pitfall of giving your broker the full copy of your credit file that only you see.

never ever do that

whom he applied to would not have seen that data if they'd searched with the limited access they have themselves

only you and three can ever see it.

oh and be aware, the brokers pull these tricks to make more money out of you and the commission they get from selling a dearer mortgage. always best to go directly to major banks not via a scamming broker!!

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Send them an SAR as well. If I were you I would also put the complaint into the ICO.

If you can eventually get response from the ICO that they have probably breached their obligations under the data protection act then we can probably help you get some compensation for any expenses you have incurred plus the stress involved.
You need to demonstrate very clearly that there is inaccurate data processing.

Update 

Spent hours on Live Chat with no luck. Just keep passing me from advisor to advisor and now they've just left the chat hanging nobody else responding.

Can't complain on their website using the form as it says the it's unavailable due to maintenance. I've wrote an email to the CEO email address. Is there anything else that I could do that anyone could suggest. We are so anxious about this as we could lose the plot we want if we don't get it resolved.

Of course it shouldn't be this difficult – but it is.

Follow our advice and make an SAR a priority. It may not solve anything – it may not tell you what's going on but it's your best hope for the moment to inform yourself.

I'm afraid spending hours on the telephone et cetera is certainly a complete waste of time.
