The claim includes statutory interest under S.69 of the County Courts Act 1984 at a rate of 8% per annum from the date of assignment to the date of the issue of these proceedings in the sum of £49.15 The Claimant claims the sum of £972   What is the total value of the claim? £1112   Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC (Pre Action Protocol) ? I dont know the details of the PAPDC to know if it was pursuant to paragaph 3, but I did receive a Letter of Claim with a questionaire/form to fill.   Have you changed your address since the time at which the debt referred to in the claim was allegedly incurred? No   Did you inform the claimant of your change of address? N/A Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account? Credit Card   When did you enter into the original agreement before or after April 2007 ? no   Do you recall how you entered into the agreement...On line /In branch/By post ? Online   Is the debt showing on your credit reference files (Experian/Equifax /Etc...) ? Yes   Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. I was aware, I'm not certain I received a 'Notice of Assignment' from Capital One but may have been informed the account had been sold without such a title on the letter?   Did you receive a Default Notice from the original creditor? Not since the debt purchase, and not from Capital One.   Why did you cease payments? I can't remember - it was the tail end of the pandemic and I may not have had enough income to keep up payments - I am self-employed and work in the event industry - at that time. I also had a bank account that didn't allow direct debits and may have just forgotten payments and became annoyed at fines for late payments.   What was the date of your last payment?     • Yes you should take this view, but this is nothing to worry about you will be fine. you have a very well edited WX im sure although I haven't actually looked at it because I can't seem to work out which one is the new one anymore, although I do remember something previously. however if i remember it right its just a lost parcel via packlink and no insurance which frankly is pretty straightforward and should be a copy of farooq v evri. Have I understood the case right? Please tell me if not as there is rather a lot on this forum
    • well in every other thread advocate or not evri always send a cpr27.9 because they never turn up. I don't think we've seen a thread here without one. Maybe @BankFodder can tell me if i've missed one, but all of the ones I can remember there has been a cpr 27.9 notice even when an advocate has attended and from my own knowledge also I've always had CPR 27.9 advocate or not. I dont think there is a single thread on this forum where evri have shown up themselves and similarly I don't think there is a single thread where they dont send notice (aside from this)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

All,

 

Where can I get a copy of a tenancy agreement (without paying large sums). Also, which agreement should be used - there are different types?

 

The situation - I am thinking of moving in with my girlfriend and let my 2up2down house to her son and son's girlfriend, but would like to do things correctly to be fair to both (all three?) parties.

 

Also, I would like to leave some of my property in the loft and garage - as girlfriends place does not have a garage for my motorcycles... does this change things?

 

Other things to consider?

John, ensure that you get a "furnished" assured shorthold tenancy agreement (6 months tenancy) as the conditions vary slightly if you are leaving items at the property. Would also recommend that you make a comprehensive list of the items which are being left, whether in the attic or not. This then needs to be attached to the Agreement and you all sign to say the list is correct.

John, ensure that you get a "furnished" assured shorthold tenancy agreement (6 months tenancy) as the conditions vary slightly if you are leaving items at the property. Would also recommend that you make a comprehensive list of the items which are being left, whether in the attic or not. This then needs to be attached to the Agreement and you all sign to say the list is correct.

Thanks.

The A.S.T. that thehomee forwarded is for furnished or unfurnished property. It mentions an attached itinerary of furnishings, so this will be done. I have not spoken to girlfriends son yet about furnished state.

 

thehomee - the agreement refers to the Landlord and Tenant Act 1985, but I can only find the 1987 amendments Act and the 1995 Act. I have looked but can not see if the 1995 Act supersedes the 1985 Act completely. Do you have an electronic copy of the 1985 Act?

Hi, I would advise getting a solicitor to draw it up. As a tenant, I have had some problems with my Landlord and the agreement is very flimsy - generally in my favour if it were get to court. But in the case of problems, its very upsetting for both sides not to know exactly where they stand - and then have to pay for legal advice anyway!

 

Make sure its water tight before yo sign your house away!

Any advice given is purely my opinion and not based on any legal fact unless referenced with a case. Follow my advice at your own risk. Although the fact may be correct, my interpretation and therefore findings may not

Many thanks for this. I have been reading up a lot on the Acts as well as the Trading Standards guide mentioned recently on Moneysavingexpert site. All interesting reading. Some time to go, so no rush - girlfirend has to sell her place first and we even have not got a valuation yet...

Hello all,

i've just read this thread and i can see that there is mention that someone may have an electronic copy of an AST Agreement.

 

Could i be cheeky and please ask someone to send this to me!

 

I'm letting out my house for the first time and although i know i have to give my tenants an AST Agreement

i have no idea where to get one from

 

more importantly what to put into it!!

 

Would you recommend getting a solicitor to draw one up or is it something i can do myself?
