    • Morning all, a while since I've been here....I contacted my bank regarding the matter and they took the decision to take "charge back" action against QVC, I initially got the money back and then letters from QVC basically stating I had defaulted on my payments and owed them the money Nationwide had claimed back, just as BF speculated they would. In short I repaid QVC to avoid having debt collectors after me, and having contacted CAB am now in the process of writing to Evri outlining my claim. CAB provided me with a basic template for the letter so I'll see how that goes. Regards.
    • Well you could say that you have pictures where the signs were not on the wall where you parked so would require strict proof of when they were erected . But in any case it was dark so even if a sign was there you didn't see as it was not illuminated. Little point in not having signs that can be seen at night though it obviously makes it easier to issue PCNs and pursue motorists claiming they have breached non contractual contracts whilst breaching those same motorist's GDPR.
    • It fizzled out, they kept delaying the complaints process. In the end I believe they stopped charging me for a bunch of services, unsure if it was deliberate or a mistake so I stopped bringing it up. Ultimately we bought a house and moved out.
    • There are so many factors, and local elections are often far more about local issues and people, but the one previously general rule in a general election are that the hard core Tories vote Tory and hard core Labour voters vote labour   Gaza seems to have dulled both the muslim and Jewish labour votes more than the Tories - and I can see why - but do the muslim voters really think that the Tories will do ANYTHING other than talk and then do whatever the Americans say - and thats support Israel whatever they do first and foremost in real terms? Reform has unquestionably affected the Tory local vote - so should affect the GE vote a bit more, but has largely been factored in - reform isnt new in any way - its all Brexitish although there seem to be far more ex 'conservative' core reform/ukip/brexitish voters than ex 'labour' core voters - about 6-8% of the national vote in a GE seems to me. A little up on prior brexitish/faragits scores But the large swathes of center ground voters who decide who wins the election seem to have utterly deserted the Tories in their millions - although they have gone to labour, libdems and greens - and many real conservatives are in limbo despite Sunak being naturally more a thatcherite than most - his party currently seems far less so. Johnson promised much, and many were taken in, just as people (inc me) made that mistake with Farage in the early days - but we now know that they are self serving liars who can't be trusted with anything - although I still think it likely The Liar will be back - but most likely after the GE (60/40) Starmer is lacking in charisma and presence, but others in his cabinet should shine. But Corbynistas could still cause trouble - another group that seem happy to drag everything down if they think it suites   Johnson perhaps could reunite some of the Tory party - but he seems to have numerous criminal and political convistions sitting in the background should he try Lying about giving preference to dogs in the Afghan evacuations - and lying about it Unlawfully proroguing parliament embezzlement re funds and spending (eg flat referb) .. repeatedly Taking jobs before he should after being booted - should lose his PM pension and rights over that IMO the list goes on ad nauseam

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

had repeated letters for years and now this …. Also confused by the advice here as I too thought ignore was the advice. 
not sure how a Backdoor ccj can happen if they are sending to an address you’re contactable at.

I did see a thread when a guy pleaded no contest and they didn’t hear from them so maybe a scare tactic and they backed off when their bluff was called. So hard to know but my gut says don’t engage. 
I know someone who has returned letters to sender for years and so far hasn’t had any issues with any backdoor action etc

Yeah, I’ve been researching the company and they offer no win no fee so it seems a big gamble for them to take the legal route when they don’t know if we can afford etc. I feel this statutory demand threat is a scare tactic but I’m just not sure!

The bank never cooperated with me when I left either. I went to branch they told me to call and visa Versa. I got my friend to put some money in atm but then lockdown happened and I was no longer in a situation to be able to do that…

do keep this thread updated and I’ll try and do the same… problem is we don’t have people coming back and saying what has happened most of the time

you only ignore if the original creditor is aware of your correct and current address from you in writing

 

dont forget advice evolves and also gets updated with greater wisdom of how the whole debt world operates.

 

people 99% of the time don't update their threads as nothing happened

they use us and fly away.

Btw when I say I went to the bank I didn’t expressly say I was leaving the country I asked if I could adjust payments to a plan as my job may be in 2 locations as I didn’t want them to panic and freeze my account. 
As it’s not a criminal offense anymore though is there actually anything they can do?

After my experience with Emirates nbd they’d deny they have any info anyway 😂

 

I got another letter today literally saying “it’s not wise to ignore us” you have another 3 weeks …. 


the person I know left with an initial 500k dhs loan… but sure how much was left when she left Dubai.

 

Mine is like 15k.

 

She has letters sent to her mums also since like 2017 or something.

 

This is what is telling me to hold off but it’s the uncertainty that makes me stress at times and probably what they’re counting on…. 


I think he means they’re just robots following processes to scare us into contact.

40k or literally 40dhs? Lol

 

so am I. It could be the wrong path but so far all is pointing towards that being the right move. 
I read years ago when I first got a letter that often you can be paying these people and then people weren’t paying it off or something… it’s all very confusing. This is why I chose not to engage with IDR initially - plus they never provide any proof of debt they just send generic letters so surely they have to do that before they can take you to court ….

 

 least we can update each other anyway. Keep me posted

This is exactly my thought. I did think it may have been dx who warned of this a while ago but wasn’t sure. 
 

I don’t have the money anyway so regardless if I make contact or it goes really far… I cannot pay so I’m not stressing anymore. 

Even if we ride out this time it’ll happen again as the person I know has had letters for years. So far they’ve been empty.

Another chaser letter this morning. Less wordy and aggressive but still threatening SD and bankruptcy etc. Nothing by way of proof sent this whole time, just standard letters. Thought I’d keep you updated. 

They also text me every couple of days too

I seem to only be able to block the number but it comes through anyway. I have an iPhone. Do you know how I do what you suggested…. Sorry not very savvy 😂🙈

Got another letter today. 1 week count down. I think if its not handed to me then I will 100% ignore. If its handed to me then how do I find out if its legit? Do I contact the court mentioned or something?

 

I dont have my own thread; love to teach and I are in exactly the same situation so have been updating each other here.

if its handed to you by a process server then it would be real.

but you'll get it in the post i bet,, just  a threat.

 

as i said before anyone can down load the form , it has nothing to do with a court, they dont know,

 

if you look in the london gazette where all bankruptcies are listed.

you will find as someone did last year there have only ever been i think 3?
