    • It will be years before Banks would sell to a debt buyer.  Sometimes Banks will use external debt collectors to try to collect, but generally Banks don't take Court action.  So you could be looking at 3 to 6 years, before any dca owning debt looks to take any Court action. And it is not definite that this would happen. So no need to feel pressured at this stage. In the event you found yourself unemployed, you have time to engage with Banks to advise of your situation and ask for time to deal with the situation, find new employment. As long as you inform the Banks they will offer assistance they can. E.g offer payment holiday or accept reduced payment for period. What you should not do, is not contact the Banks and simply default on payments. 
    • I'd get back to them tomorrow, and explain the circumstances, that you have a wedding reception, and just appeal to their better nature. Hopefully they will be able to move sooner rather than later, especially if you go in in person and speak to them, and show them the issue.
    • The 3 pieces of mortar that fell on the same day, at the same time, were approx. 25-30cm long and weighed around ½-1 kilo each from a roof that is above the 2nd floor; they were by no means tiny pieces of mortar but large chunks falling from a rather great height. I believe the size and weight is enough to cause serious injury and if it falls on your head, I assume it could potentially be lethal if unlucky, but we don't wish to put that theory to test... We can't in good conscience let a contractor install a patio and a gazebo as it is in the exact spot where the mortar fell, nor do I think anyone would be willing to take the chance. Looking at the roof, there are multiple other remaining pieces from the same 'line' or 'row' of mortar that can potentially fall. The mortar is right underneath the slate tiles on the neighbour's roof and I don't know whether the tiles are also (becoming) lose due to the loss of the mortar. I was trying to upload a photo but it seems it's not allowed. The first contractor to work in our garden in preparation for the patio and gazebo is scheduled to start on 10th June, that leaves the neighbour 5 workdays to sort their roof which is unlikely, so it seems we will have to postpone our patio contractor without knowing when they can come back. We have already had extensive work done in the garden in preparation for the wedding reception and it will become very costly for us if we have to move the wedding reception to a venue (if we can even get one at this short notice) rather than have it at home which was our dream.

Letter Of Claim       Reference: Techzone Mobile Phones Samsung A71 Mobile Phone £140 Purchase date 29. 5. 24     I the claimant purchased a 2nd hand Samsung A71 mobile from Techzone Mobile Phone unit 10 of the indoor market at the Potteries shopping centre. Initially the phone worked well until I used the camera and found debris in the camera lens spoiling pictures making it not fit for purpose. I contacted the seller who offered a replacement which I initially accepted but later rejected and wanted a refund in full which the seller refused saying they Do Not give refund is unlawful and goes against the Consumer rights act 2015. Therefore I intend to issue proceedings against you in a county court without further notice unless you reimburse me the above amount in Full within 7 days from the date of this Letter     ------------------------------------------    I think its best if i hand him the letter as posting it might not get through so can claim expenses traveling up there ?   or would it be best to just post and get 'Signed for'  ?   Should i also put in the letter of claim interest added or leave that till the Particulars letter ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

lynne, have rung Southend Court today, on 27th there were apparently 300 other bank cases being looked at, apparently we should hear in a couple of weeks.

hi there guys, i really need some advice here, just heard from my daughter who is down visiting her father in law (it's his address i'm using for my claim) she opened a letter from the court and i have to attend on the 13th sept, i really didn't think it would go this far but can some one plz give me some advice as wot to do, now i'm really worried cheers

i was just wonderin if i should ring the court on monday and ask wot all this means and should i inform them that i stay in scotland and that travellin to southend would be to far even have the case brought nearer to me plz guys someone help me here

Hi Lynn

 

It probably won't go that far, but it maybe an idea to call Capital One and see if they are going to settle. It is unusual for them to appear in court over charges. If they say they will turn up, then get the court bundle ready just in case. I think they will settle before the date.

lynne, I got the same letter about the court date at Southend Court, I have not informed them that my claim is concluded yet as I am still trying to get the Allocation Questionnaire fee, if I find out anything I'll post up on your thread.

Hi there, i have just had a letter from the court in southend, i applied to have it moved to a court nearer me, the letter says nothin about whether it is bein moved but it says that things a basically stayed just now until the test case is resolved i would like to scan this letter and have someone who actually understands these letters, have a look at it as, it is like a foreign language to me, is there such a person out there lol, let me know and i will scan and send it to u, any help is muchly appreciated ty

Credit Card cases are under different terms, so they are still ongoing. If you can give us some details, maybe type it out here, we can have a look at it for you. There is a removal of a "Stay" letter in the Bank Templates Library.

ok this is wot the letter says

 

Before district judge Dudley sitting at Southend County Court (address etc)

And upon it appearing to the Court that this claim will be affected by the outcome of those proceedings:

IT IS ORDERED THAT

1. This claim be stayed until determination of the proceedings in the High Court

 

2. Liberty to either party to apply on notice under CPR 23 to lift the stay

 

3.The hearing of any application to lift the stay be reserved to District Judge Dudley

 

This Order was made of the court's own initiative pursuant to CPR Part 3.3(4). You may apply to set aside, vary or stay the Order, but such application must be made within 7 days of recieving it

 

On an attached letter it says

 

Dear Claimnant

 

BANK CHARGES CASES

 

you will find attached an order frome the Court in relation to your case.

All cases have been stayed (all proceedings halted until the test case is determined).

If you need to get in touch with the court about your case we would ask you to write in rather than telephone the court as this allows us to process the work more quickly

 

Thank you for your cooperation

OMG this is just awful!!!

 

I am about to file my N1 finally (HURRAH!!) against Capital One & now from what I have read on your thread it appears that the CC's are getting 'stays' as well???

 

I thought that Capital usually settled a couple of weeks after filing & putting in their defence??

 

Is this right?? I thought it was only the banks that could get Stays??

hi guys, sorry i haven't been in for a while, got a bit dispondent just to update u i got another letter from the courts jsut before xmas to let me know the stay had been stayed but with the start of the court case yesterday i will be keepin an eye on things

yeah i know, it's bin over a year now since i started this and i'm gettin a bit fed up with it now but am not givin up as i'm sure crap one wishes i did, but have totally lost track of the interest they owe me now, one of the members very kindly started it for me, will they still owe me this interest from when i started, wot does anyone think?

well here i am again and still no further forward, just over 2yrs later, i actually wrote to crap 1 and offered them MY gesture of good will with a lump sum payment, which they refused they said they had sent out a cheque for the remainder of what they thought they owed me after clearing my acc, about £3000 short but would cancel that cheque and send another providing i halted the court proceedings, low and behold there never was a cheque and i haven't stopped the court case, any ideas as wot to do next and some help in my bank charges would be brill as i really can't get my head round how to do them, i have tried several times and it never comes out so don't know how much they do actually owe me now cheers

Oh dear, what a nightmare.. I wonder why it is taking so long!

 

Stick with it.. you have come this far... and keep going until you get that default removed.

as far as cap one goes, exactly where are you in the court stage?, for the ones I have done from issuing the corut paperwork to payment was approx 2-3 month....... one set of bailiffs and some radio exposure and national tv for one claim,....

Hi audrey, my papers r filed in the court i got a reply sayin it was stayed, i then sent a mail to rachel howey and told her as a gesture of MY good will i would be willing to settle with a lesser amount but she says she had settled my acc and sent me a chq, i never rec'd the chq so she said she would cancel that one and send me another, low and behold that one never arrived either, i have no idea how to work out the interest, have tried several times and failed miserably but don't know wot else to do now, rachel howey said that it was finished with and she sent me a form to discontinue the court proceedings of course i didn't send it had i the opportunity i would have shuved it elsewhere

I'm just starting the fight with Capital one they have only sent me terms and conditions so have sent off a letter (copy of one from this fab site) and see what happens. They have charged massive amounts of interest and charges lost cheques I have sent them (they have been cashed by my bank!) they telephoned me today for about the 5th time so when I answered I asked if they had heard of Ofcom quote regulations told them I was reporting them for harassment and all calls from Capital one were being monitered they hung up on me - I did feel good!!

Just out of interest has anyone won the case against credit companies because they havent filled in the right paperwork?
