Hello, hopefully I'm posting in the right place but unfortunately I've bought something from SCS and now I'm home I've measured up and I'm 100 percent sure I won't be able to get the sofa to fit into my doorway.

 

After reading a few things online about SCS I'm am regretting massively ordering from SCS I had absolutely no idea that there reputation was so bad. I'm going back into tomorrow to measure up again and see what they'll do for me whether I can find a sofa that will fit or whether they'll cancel my order. 

 

my question is

what rights will I have if I can't find a sofa that will fit tomorrow? 

 

Hopefully I will not even sure if I want a sofa off them now after reading reviews online and what peoples sofas look like when they receive them. I've been told the sofa wouldn't even be delivered until September!!

under contract law you can cancel within 14 days.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Was the item you ordered a standard stock item, or an item they'd make to your exact specification.

 

See their T&C's here, s. 2.4.8 b - https://www.scs.co.uk/help/terms-and-conditions/website-terms-and-conditions.html#:~:text=If you do not wish,do so under section 2.4.&text=After you cancel your Order,cancelled Products and their delivery.

 

In any event, go back to the store tomorrow and tell them you need to cancel the order because of the size. Let us know what they say.

Unfortunately I have no idea whether it was a standard stock item or an item made to specification with how much I've financed around the 1.8k mark and the fact delivery lead times were around September I would assume it's made to order. I'll have to double check. I'm going in today so I'll let you all know what they say. I'm just worried they'll say I have no terms or grounds to cancel.

If it wasn't a distance sale then you would be bound by the contract unless they breach it in some way.

They might breach it by failing to deliver on the due date, or by being defective when it arrived.

What exactly where your arrangements for delivery – in terms of timescale?

Also, in terms of quality – don't forget that on this forum and also elsewhere on the Internet, you tend only to get the bad news. Presumably there are lots of satisfied customers or else they couldn't possibly stay in business – but it certainly seems that when things go wrong, that they don't handle things very well – and that is the sign of a good or bad company, how they deal with things when they go wrong

So we agreed that delivery lead time would be around September we are ok with this and was expecting it. Unfortunately even reading many 5 star reviews lots still complain of quality issues and it does have me worried.  I just hope I have some wiggle room and in order cancelling

Well so far as I can see at the moment, you are going to have to rely on their discretion and their goodwill.

From that point of your think you then have to telephone them and have a very nice conversation and explain that you made a mistake and you need to cancel you need to look at it all again.

If they simply turn you down then there's not much that you can do unless they start exceeding the delivery time. You are saying that it is "around September". This is a very unsatisfactory timescale in my view.
What was actually agreed? If it really was "around September" then I have to ask, why on earth did you accept such a vague commitment from them.

You must find out if it's a Stock Item - if so, you have the right to cancel as per their own T&C's.

Thanks for everyone's help and luckily thanks to SCS and their good will they cancelled the order and we've ordered another sofa from knowing it will fit with guarantee so if they are any damages it will all be covered.
