    • The Barclay Card conditions is complete. There was only 3 pages. This had old address on. Full CCA. 15 pages. The only personal info is my name and address. The rest just like a generic document.  Barclays CCA 260424.pdf
    • An update to this case as I’ve not been on in a while.    I am still awaiting a charging decision in the case. The two police officers involved have said their personal belief is a section 47 ABH charge is the most likely outcome but this isn’t a sure thing of course.    The EA certificate from the issuing court has now lapsed. The court have refused to recertify him until they’ve had a hearing in to the case, and the district judge has issued orders to surrender all evidence, footage, photos etc.    I have done so promptly.    the EA, not so much . Equita have claimed they cannot provide his bodycam footage as the camera he was wearing is the EA personal one not one of theirs.   the EA has claimed he has asked Equita and the police for the footage as he claims he doesn’t have it.    the police have confirmed they didn’t seize his camera and they don’t have it.    so they are basically pointing the finger at each other all the while failing to comply with the district judges order to provide all evidence they intend to rely on at the rescheduled hearing.    The district judge has stated the hearing for his certification will NOT be the hearing for my complaint as there is no charge as of yet, and just as to whether he should be recertified or not.    I’m not 100% on why that can’t be done at the time, but I’m not about to question a judge…..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Our Community Council Clerk, had been in contact with someone who was at the same resort as the Superspreader, and she was coughing all though the Council meeting, this was in February. I was ill for about a week with what I thought was flu or something similar. a few days after that meeting.  Of course Covbid wasn't a big thing then.Son had similar wife not affected. Strange, was it Covid, probably never know, especially as PCR test  may give positive test for a common cold.

That's interesting, BN. My OH was in a meeting early this year with someone who later tested positive. We were both ill not long afterwards and I had a really bad cough that stopped me sleeping for at least a week.

 

Like you, we wonder if it was covid but I suppose if it was, the immunity could have worn off by now.

We are exempt as we are out hunting the scent trail previously laid by our politicians. Seems to smell of BS and be absolutely everywhere.

Going back to the new strain of covid, I thought the problem with it was that it's more 'efficient' at infecting people so it spreads faster than the original? I've read other articles that say the illness is about the same but the transmission is a lot faster.

Appears somebodies changing the code of the pages - mine eternally loading while I'm on page here now. Was working continually before, but didn't have current signs of loading page eternally (nothing visible apart from page slider constantly moving and processor working hard)

 

re the new strain(s) ('allegations so far)

reports it causes much higher viral loads quicker in a number of (susceptible?) people and has a more efficient/effective invasive mechanism (see earlier in thread for the start of this)

- fast/higher viral loads probable cause/link of infection spreading more into the nervous system and causing damage in brain/central nervous system/heart and lungs

 

- Very concerning.

Google first instances of severe psychological effects (disruption of brains communication mechanisms and what would be considered 'psychosis' (voices) effects)

 

Not attempting to scare monger in any way. Forewarned ... and all that.

Better to plan and prepare for the worst, and hope for the best, rather than blindly bumble and lie into a firestorm and just hope it will all turn out ok - as clearly seemed to happen with the (apparently known and monitored) spread of the new strain with an unwarranted low level of London/Kent lockdown  with fox hunts and ski trip farces.

the advice on who should or shouldn't have the pfizer vaccine is now largely the same as with the astrazenica one, with more details released from pfizer thatn from astazenica.

The storage temp is an issue clearly and a very clear benefit with the Oxford vaccine .. and others coming up.

 

Even the 'information' given in  the broadcasts on the oxford vaccine this morning was incredibly actual content lacking.

Answer: err after phase 1

question: How come there are such varied claims on its efficacy

Answer: well there were different tests and they were all done differently so the data we put together to claim certain percentages really cant be put together.
