    • Do not under any circumstances plead guilty until we know what we are dealing with. It's a sure way to 9 points. The tried and tested way to handle this is to plead not guilty to both charges and offer to plead guilty to speeding provided the "Fail to give information" charge is dropped. But I am concerned about this "ticket refused" sticker. I've never heard of this before. A "ticket" is not a term used in connection with speeding offences. There seems a distinct possibility that your response was received by the police but one thing worries me: I've never heard of a sticker being placed on a response and it being returned "Return to Sender". t's just not what ticket offices do. If you could post a picture of this document and the sticker it might help.  If you can show the response was received you may have a defence to the "Fail to Provide" charge (provided you completed your response properly). If the police are saying you did not respond they cannot succeed with a speeding charge (as they have no evidence you were driving). But if you did not respond, who put the sticker on the document and sent it back yo you?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Long time lurker on this site but now I need your advice please.

 

 

Step daughter 23 has not worked for several months since she lost her job in a call centre for swearing under her breath (so she thought) while on the phone to a customer. She has recently been diagnosed with borderline personality disorder which may explain her actions.

 

 

We have been looking after her to try to get her in a better frame of mind to move forward. We have not sought or received any financial assistance with this.

 

 

We encouraged her to look for work and sign on for JSA as she seems to be improving.

 

 

She had her interview today and they have told her that she has to attend the Job Centre for one hour every day for 5 weeks before she can claim.

 

 

My question is is this situation typical?

I personally have never heard of that , and can't really see how they could expect some one to visit the job centre 5 days per week for 1 hr, did they give any information as to what this was for ?

 

Does she have a claimant commitment yet? if so what does it list on that ,also did she actually agree to those steps on it

I've never heard of that happening either, certainly not at the start of a claim anyhow. I suppose we need to know: is she claiming JSA or has she been required to claim Universal Credit instead? Have the Jobcentre staff expressed any concern over the reason that she left her last job?

Also i will ad to this as well.

 

Boarderline Personality Disorder can lead to a whole raft of other things like depression etc, which you post implies you are aware of.

 

Depending on how the condition is impacting on how her life is, you may want to investigate whether JSA is the correct benefit to be claiming at this time. ESA and PIP may be worth looking into

Thank you for the replies so far.

 

Tommy456 - she has signed a Claimant Commitment. It says she will attend Futures GIS on Thursday and that she will attend the UC Jobs Club by 07/06/16. On a seperate card provided by the Work Coach it says attend daily Job Club.

 

antone - its Universal Credit. Don't think they were concerned about previous job.

 

SabreSheep - She came back from the interview very upset. She is not strong enough to deal with the Job Centre people.

We have been thinking of PIP but don't know where to start. She has only recently got the diagnosis from the Psychiatrist and is waiting to be called in to see her doctor.

Hi, i think this is a new thing where all people now signin on do have to do daily visits to the Job Centre, think its parts of getting people ready for work.

 

Also IMO they can pick people out for courses, training etc
