    • With regards to the letter of rejection, I found a template on line and used that. Please do let me know if anything needs changing.  Thanks
    • Morning, So the finance company is Warrenties2000. I have just sent a copy of the rejection letter to them too. So now they have it as of today, and the Big Motoring World have it as of yesterday. We still have 2 days left out of the first 14 days. The report is not a report, it's an email thread which the mechanic forwarded on to us. it shows that he did send the email to Warranties2000, their reply, and then his reply to them. This is the email that Warrenties2000 have said they've not received. BMW said the diagnostic test usually costs £100 but they have offered to pay £70 of it as a good will gesture. We have told them over the phone that we're not paying any of it. We are 8 miles away from the dealership. We have had 8 days of use of the car and on the 9th day it went to the garage. The garage found the faulty battery and faulty gearbox about half an hour after we dropped the car off.  I've just messaged my husband to tell me who we got the finance from as I don't know. He handled everything with the car.  The extended warranty was £1800 over three years and that was with Nissan I think. My husband contacted the Nissan warranty people yesterday and he said they're raising a complaint on our behalf. I will check with my husband to see if he has cancelled the warranty, I'm sure he has but I will check. So update from yesterday. My husband has cancelled his car insurance as of Friday as the car is undrivable anyway. I'm going to the car today to get our other bits out if the boot.  I have enclosed the details you have all asked for.     • Only had a conversation with the duty manager when I complained.  They were fully booked the night we arrived but offered the room next door for the following night! The hotel is called Widbrook Grange, Bradstock on Avon. I will upload the photos shortly.
    • but there's 'perhaps not entirely forthcoming .. and then theres lying through their teeth - like sunak and farage Vote us in this time and we'll do what we promised to do years ago and not only didn't, but blocked others from doing it .. and did largely the opposite.   I certainly wouldn't bundle a serial killer with someone not paying for a loaf of bread to feed their children eh? I have long voted for those I believe to be least worse - it has been difficult at times - but placing the poops (tory or deform) at the far  backend of my choices currently is not even an effort.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

When Citi did not file a defence against my claim I got a judgement, only for them to have it set aside claiming they had not received the particulars. I have now received their defence and the AQ's have been submitted to the Court.

surely once or twice not getting the paperwork will be accepted but there seems to be a bit of a trend going on here. Come on Mr Judge do your stuff and give Citi a good swift kick in the ......

thanks to Empire Strikes Back,I have been alerted to the fact that Citi are sending our personal,court and financial information to other people in an attempt to back up their attempts to deter further litigation.I have concrete proof of this,as ESB has provided this for me.They sent my details to him along with the letter referring to our juduicially mishandled claim.They grovelled to the court for confidentiality as to their charges,and send ours all over the place.The judge concerned has been alerted to this in writing

 

And as Citi are reading,I have alerted as many statutory bodies as possible,as well as Mohammad Sawar MP in order to get them in as much hot water as humanly possible.

 

This leaves us open to ID theft,and I hope Citi get a real good roasting for it!!!

Why not ask them for compensation? (maybe even sue them for compensation) And to twist the knife, why not make the amount of compensation equal to the difference between what you were awarded in court and what you claimed for?! :-D

Just caught up with this thread today and have read it with interest. I've now subscribed so I can see what happens before I start this process with them. Might mean a change to the letters I send.

The details of the cases themselves (anything beyond "Boddy vs Robin Bank plc") and any settlements reached out of court, however, are not. It is down to either party to decide whether or not they publish the details of the settlement - the court does not do it for them.

It is down to either party to decide whether or not they publish the details of the settlement - the court does not do it for them.

 

Well PoC, Defence, Reply, N244 are all filings. So they can be disclosed?

 

As well as details of a judgement which says "Case dismissed" or "Defendant to pay to the Claimant the amount of £XXX.XX as previously offered."

Due to promotion and consequent pressure of work, I have not been as active on this site of late as I would like to have been and have only just seen this thread upon reading the CAG Newsletter that drew attention to it.

 

LTWFB I'm pleased to see you are challenging the outcome of your hearing on 26/9. Just from what you have posted, I believe you have grounds for appeal - whether you should or not is a matter for you to decide. I propose to say no more about it here but for the benefit of the Citi folk who I know like to read this thread too, I speak in a professional capacity.

Dunno about that andrew - I posted back in May on another thread about the likelihood of the small claims court just following the OFT guidelines and that it was important to prepare your case to deal with that approach only to have an anonymous comment made on my reputation that my post was "not helping and even inaccurate in places". Hmmmm really? I don't think so.

 

No-one should be put off pursuing these claims by LTWFB's experience. It really is past high time that the Government through its quango the OFT, sorted this mess out instead of tax payers money being wasted by banks petulantly trying to defend the indefensible.

LTWFB, best of luck with your appeal. I appreciate you might not want to say too much on this thread but can I ask if you were successful in your claim for the interest on the charges?

 

I'm asking this as I've had a bit of a thought but your response may answer this so I'll say no more for the time being.

Hi there,im currently making a claim against Citi cards using moneyclaim online,im halfway through the process,im having a bit of trouble deciding exactly what address to put for citi,im also not sure what other info to put in the 'particulars of claim',could you please please give me a bit of help? Aren't citi a bit awkward to deal with these days?Thankyou-Craig

Citi havealways been a bit awkward - use the reading address that is their registered office.
