Hi all,

 

I joined DW Sports 1st November 2013 but

 

by mid November I lost my job and had to sign on to the dole,

 

by the end of November I had to cancel dw by going to the bank and cancelling DD

 

I had a £1000 wonga loan after numerous rollovers and a 500 sunny finance loan and still not got them sorted and

 

today I receive a letter from ARC stating they want £215 and if I don't pay within 10 days they will take it to a solicitors.

 

I'm 19 and in debt which I'm trying to get a job to start paying them off but I don't know what to do atm.

Hi Madamada and welcome to CAG

 

My advice here is restricted just to the gym m/ship and not the rest of your finances/debts.

 

DWF and ARC should not be high on your list of priorities. Once you answer my questions below, we'll tell you what you need to pay. They will be adding admin charges to what they say you owe but these admin chgs are NOT enforceable.

 

They will not send anyone round and they are very unlikely to take any court action. Bailiffs cannot become involved unless court action has been taken and a CCJ made against you.

 

Your DW m/ship agreement should allow for cancellation in certain circumstances such as moving home, medical reasons or redundancy. Check the m/ship agreement for T&C's that refer to cancelling.

 

You should find you can give a month's notice, pay one final monthly fee and then leave without penalty.

 

1. Did you tell DWF of the redundancy and your need to cancel the agreement - if so, when.

 

2. Please say when you cancelled the DD mandate via your bank.

 

There is no need to reply to DWF or ARC at this stage.

for those PDL debts you have.

 

just REMEMBER,

 

DCA's are NOT BAILIFFS.

they have NO SUCH BAILIFF POWERS

 

so CANNOT take anything from you.

and they

Hi Madamada,

 

Thanks for the info. When you have a chance, check the agreement and make sure there's a clause allowing you to cancel because of redundancy.

 

I suggest you write to DWF as follows:-

 

Dear sir or madam,

 

Shortly after joining the xxxx gym, I was made redundant on xxdate.

 

I had to take action to protect my finances and cancelled the DD mandate in your favour. This was notice of cancellation as per the High Court ruling in The OFT v Ashbourne Management Services Ltd in 2011.

 

I now realise I should pay you a final month's fee for the notice period and willing to do this, upon receipt of your written confirmation that you'll accept this in full settlement of all amounts owed to you.

 

I will not pay any amount in excess of the one month's fee. In particular, I will not pay any admin fees (penalty charges) added by ARC.

 

Kindly tell ARC this matter is in clear dispute and instruct them to stop making any further demands.

Regarding PDL's, they are VERY easily dealt with. You'll just need to be firm and stand your ground as the PDL's will lie and say things that will make you scream.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi all,

 

Sorry to reopen an old thread but today I recieved a letter from Major & Co. Solicitors, it reads basically A County Court Claim has now been prepared and is ready to be issued against me in Northampton County Court, the following costs will be added:

Debt Balance £215

Court Fee £15

Solicitors Cost £50

Annual Interest £17.20

 

Total £297.20

 

should i be worried?

scan it up please

 

**you can post up images/letters by this method immediately..you don't need 10 posts**

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc

but leave all monetary figures and dates.

you have many images too rather than many single pdfs

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice DD-mm-yyyy TSB

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

...

You are right to continue to use this thread to discuss your case. :wink:

 

It would have been far better if you had written to ARC when I first suggested it. However, at least you have now put this right.

 

While you wait for a reply from ARC, write to Major & Co Sol'rs as follows:-

 

Dear sir or madam,

 

I refer to your letter of xxdate about a gym membership.

 

This matter is in clear dispute and I have made ARC aware that they were wrong to make such demands.

 

If you contact me further in this matter, I will report ARC and yourselves to The OFT about inappropriate collection techniques.

 

Yours faithfully,

 

Don't be worried about being assertive with the Sol'rs. If you don't stand up for yourself, they'll bully you.
