My 19yr old son came to me with this issue that I've found across different sites all the stories have the same core problem going as far back as 2016.

He's currently down by about £300 in charges for not playing or when he was stuck in Benidorm and couldn't pay £30 right away he was slapped with £120 late payment charge. When he's tried to give notice before the end of the season apparently he's 2 days to late.

I do not intend to let him pay another penny.

I was just wondering if any of these previous threads were ever taken to court?

Or how were they resolved?

I am going to carry on looking into this for him and will update if I find anything that will be helpful to others.

In addition to the comments made by my site team member above, maybe you can give us a few more details.

Is your son actually been paying any of these charges?
How old was he when he entered into the contract?
I understand that he has received at least one threatening letter from some DCA. Maybe you could post it up here in PDF format – redact personal details but keep all of theirs in.

In addition to getting a bit of a slap in the welcome to the real world, maybe your son will benefit from a few pointers.
Firstly, even if there is a breach of contract, in principle the person in breach would only be required to recompense the innocent party any administrative expenses caused by their breach. The figure that you are suggesting – £120 in late payment charges because of a failure to pay £30 is clearly extortionate. In law it is known as an excessive penalty and is unenforceable.

Let's hear some more from you. If he has been paying out excessive penalties then maybe there is a basis for him recovering some of the money in a small claim if necessary.

I sent this Manager a text from my sons phone last night requesting a copy of this signed contract on the advise of his union rep so it could be forwarded to the solicitors. We will see if he actually does. 

In the meantime I am going to try and find out if there is any truth behind there FA affiliation the wording seems off to me I thought legit leagues were FA approved 🤔

if he has been scammed out of penalty fees and monthly membership fees since telling them he's off...go do a DD guarantee clawback for them.

Hi FMum,

Please confirm exactly how much YS has actually paid Soccersixes and the method for each payment, eg debit card, credit card, direct debit.

Don't communicate with SS further until we have all the info needed to give you advice based on the facts to date.

I'm not sure exactly how much he's paid. So I sent an email to the County FA.

  I am grateful for your reply I know there is probably nothing to be done about my sons case but I would just like to shine a light on this after reading so many stories it's clear it is common practice for this company to use loopholes to stop people leaving the league and then threaten them with court orders and legal fees to keep them paying.
 
 Quick time line weekly fee has been paid.
 
16th May - first match
23rd August - Said we would no longer be able to play
 
24th August- paid £120 for 2 games missed and a late fee 
 
16th Oct- Told 6 games left until the end of the season paid for the next 3 missed games.
 
7th Nov- Told 7 games left when this was questioned it was ignored.
 
13th Nov- Asked again about how many games left still ignored.
 
 Following is a copy of the text messages that have been sent since then. In bold soccersix.
 
 
I tried to call. If you give me a call tomorrow. Otherwise they will end up beginning legal proceedings against you

My son plays in Blackpool on a Tuesday night 
 I would pay for the next 3 games if I thought it would put an end to it but I came across a story where someone did this and still never got removed from the league and he never confirms how many games are actually left.
   
I have told my son not to communicate any more verbally or unofficial texts because they leave no paper trail.

You are giving your son the right advice and you certainly shouldn't be paying them anything to get them off your back.

You may be tempted to block their number but I suggest that you don't so that you can keep on gathering evidence of the sort of pressure you are coming under.

I suggest that your son sends them a subject access request

If they don't comply then we might consider the possibility of a small action against them for preach of the data protection act.

Send the subject access request anyway in. I think it would be a good move for you and it is completely free.

This really sounds like quite a disgusting company to do this to young people.

I think I did ask you how old your son was when he got involved with them. I'm not sure that you replied

He was 19 and the FA actually asked the same question.

They did reply saying they would pass it on to their small teams manager .

The disgusting thing is these threats of legal action come 1 or 2 days after payment is due and then on a daily basis there's no wonder people just get scared and pay up. I deleted the account number because I wasn't sure if it was against the rules to leave it on.

Question.

Can a clickwrap agreement be used and enforce for what is a lifetime membership (their words) and financial commitment.

If you apply for a credit card they send you a separate contract to sign setting out terms and conditions even electronically.

can clicking accept really hold you to a lifetime financial commitment ?

they will never ever ever go near a courtroom door . do not be scared of them, bluff them out all the way.

you need to tell you son to go get his moneyback ASAP . there is nothing they can do to stop it 

just need to know the method he paid by.

it doesn't sound like a direct debit, as if it was they'd just such suck what they like.

i'd guess he probably pays by debit card, it would be great if it was a credit car, but eitherway, it can be ALL reclaimed.

Yeah kids these days don't really think.

He's done it by bank transfer.

The 'contract is on the website I don't think he ever got sent a separate contract to his email.

I did do more digging I searched for the company on the Gov.uk website to make sure it was legit and it is on there but the office address listed is different from the website 

I googled it and they don't appear to be on the directory for that office building I know they don't have to be just a little suspicious. 

then I googled the address given on their website this appears to be a private residence ?

Simply someone working from home maybe ?

It's just looking a little suspect to me tbh.

oh god bank transfer, thats the very worst way to pay anyone, it practically removed all protection or hope of getting anything back.

now he could talk to his bank and for want of a different 'word' explain briefly how he got scammed into using that method and ask if there is any chance of getting his some of his moneyback  . they might help.
