I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am a gold member of the AA and

 

I have been with them for 23 years and they have never let me down until now.

 

As extra cover for myself and my son I took ot the AA Repair Plan 3 years ago.

 

I am retired and on a limited income so I thought it would be sensible to have this extra cover.

 

My son's car broke down last week

The pipe which takes the coolant to the engine broke and his engine was damaged to the tune of about £800.

 

the AA who initially said they would pay me up to £500 are now refusing to pay as I did not have the car serviced

exactly twelve months after the previous service in 2012.

 

My stupid fault I know as I should have read the small print of the policy much more carefully.

 

I have appealed to the AA and Vauxhall have supported me,

as this fault could not have been predicted and could have happened at any time even an hour after servicing.

 

I know I have made a mistake but I feel the decision by the AA is very harsh in not offering me anything at all after all the years I have been with them.

 

How stupid of me to think that loyalty counted for something.

 

I am a single parent so this bill is down to me and I don't have the money to pay for it.

How long after the "12 months" did you have the vehicle serviced ?

 

I would have thought this could be considered an unfair term.. the garage might not have been able to make you an appointment for "exactly" 12 months after the previous service !

The AA require the vehicle to be 'serviced in accordance with the manufacturers recommendations', which may not be exactly 12 months. Most manufacturers have an allowance for mileage and/or time - which would be within their recommendation.

The AA that is around now has absolutely nothing to do with the AA that was in existence 25 years ago.

Not really a 'let down' if you failed to comply with the conditions. I wouldn't expect my household insurers to pay out if I was burgled after leaving the door open.

 

I'd have thought that periodically checking engine coolant pipes were in good condition was a part of the vehicles service requirements.

 

If you are absolutely 100% convinced that the problem would not have been picked up in a decent service then put the details of the failure and service history down in black and white then approach the AA on the grounds that your non-compliance was not material to the failure at hand. Vauxhall should be able to tell you exactly what service is due at specific times/mileage and what they recommend that service comprises of.

The engine coolant hoses would have to be in pretty poor condition for one of them to split. They normally bloat up when they're on their way out, and " crunch " when you squeeze them, so they should have been picked up on the service. It seems that your Vauxhall dealers are trying to pass the buck for their own shoddy servicing. Also, your son must have carried on driving the car in order to cause £800 worth of damage ( cylinder head gasket failure ? ). The AA Breakdown repair Cover has a £35 excess, so they would pay out £465 IF they accept the claim. As with all insurance policies, you have to watch the small print, and you can't complain if you haven't complied with it. Check when it was last serviced and at what mileage, then check with Vauxhall when the next service was due. If there's not much of a discrepancy, it may well be wort contacting the AA again.

But some hoses blister on the inside so you would not see it, but a careful check of the outer hose casing would show a soft area which would be suspect and in need of investigation, as for the damage then as has been said continuing driving would be the main cause of problem, but if seen to straight away then the damaged limitaion would come in to it.

 

Remember decades ago whilst a RAC Patrol many a hose pipe blistered and it came to be norm to take off and inspect, also a case of a New Car on Motorway and a fault occured in another part of the car BUT the driver admitted the noise had been there for 150 miles, you guessed it the warranty was void in respect of the full damage, I remember that case as I heard about it after I had recovered that vehicle to main dealer.

Ive never had a coolant hose fail slowly before. They dont give you any audible or visual warnings and I bet not a single garage would go round and grope and squeeze every inch of all the coolant pipes in the car. Half of them arent even accessible without a bit of dismantling to get at them so the coolant hose failure is not service related.

 

However, if you lose all the coolant then continuing to run the engine and drive it is asking for damage to be done. It takes less than 5 minutes when the engine is idling and has no load on it to seriously overheat from cold, if its up to temperature and under load it will overheat in a couple of minutes and this will do damage. At the very least you are looking headgasket, possibly a cracked head, damaged water pump. These faults can then cascade into even more serious trouble which will end up in a replacement engine.
