A few month ago I took a loan for £200. When the payment was due a week later it was automatically rolled over for 1 month wich was ok as that was an option I had agreed to. My circumstances changed and there was no way I could make payment when it was due a month later. I made sure they could not take any money by 'losing' my bank card. I then waited for them to phone me to sort payments out, they held me on hold for half an hour so I gave up.

 

 

We then communicated by email I had messages from two different people one saying I had to pay 100 a month for three months they cound do nothing to help. The other one said 33 a month all interest frozen. I agreed and made the first payment. After this my circumstances got worse again so I contacted them and finally managed to arrange 5 a week which I had been paying.i refused to pay by card so they couldnt set up a cpa. I paid by bank transfer they used to send me multiple emails and messages at 8.00 on payday saying they had not received payment well this would be impossible until the banks open.

 

 

I emailed them last week as I need to sort my finances out and I cant afford 20 a month there response was its not their problem and if I dont pay 5 a week they will add interest and pass me to motormile finance. I received a letter from mr lender today saying its the second letter they have sent me - its actually the first. They have added the interest and if I dont contact them in the next 2 days they are passing me to motormile finance.

 

I have not contacted them yet because I do not want to pay the extra charges. When I contacted them last they refused to look at my income and expenditure now I know that is against OFT rules. How should I deal with this. I have a pregnant girlfriend and can not have the cowboys from motormile trying to kick my door in and be the a@@@@@@s they are.

I find listening to it cool.Then going through the letters etc.Reminds me what predators they are.

Hello and welcome,

 

Firstly, Mr Lender don't know what they're talking about, they're set up to lend and not to respect the needs of the consumer in difficulty, the good news is that the FOS, OFT and Citizens Advice aren't on their side.

 

Whether they want to accept your I&E or not its important that you write to them setting out your difficulties.

 

See here to go through more info and also the survey on the right hand side http://www.adviceguide.org.uk/england/debt_e/debt_borrowing_money_e/debt_types_of_borrowing_e/debt_loans_e/debt_payday_loans_e/pay_day_loans.htm. This will feed into the FOS if you need to escalate and make a complaint.

 

If you get nowhere its important you lodge a complaint using their complaints procedure listed on their website (they are useless though) and you aren't alone.

 

You must firstly outline the reasons for your hardship and include your I&E, ask for their response in full and in writing and cancel the CPA, I would give them 7 days to respond, if they fail to do so lodge a complaint. They have 8 weeks before the FOS will look at the issue from the date you lodge a complaint.

I can only email them at the moment as I do not have a postal address for them. I have kept copies of all emails to them. I want to get the interest removed as I had an arrangement with them they have added it because I have changed my payment plan. I want it removed.

I was going to find you their postal address but I can't even find a website for them at the moment.....is that just me? Or have the no longer got a website?!

 

They should be registered with Companies House though.

 

Your e-mails need to clearly be marked as "COMPLAINT" in order to get the issue addressed, ask for a copy of their complaints procedure.

 

Follow the link to the Citizens Advice above and complete the survey on the right hand side.

Their website is hard to find. I have had to find them on twitter there is a link. I now have the address. It just strikes me that the address is not on the letter. Its like they are trying ro push people into dealing with them on the phone which I will not do. Its the same with payments because I was paying by bank transfer they would harass me by email and text because it was not in their account at 00.01 on the due day. It felt like they where thrying to bully me into giving them card details, agian I will never do this.

All of these companies adopt exactly the strategies you describe. They will be registered in having a postal address. I did raise a complaint to [email protected] a couple of months ago, I got a successful outcome as well.

Hi Gunner, I too raised a complaint with them on Friday just gone and have had a successful outcome. I told them that I was unhappy about the way they continued to rollover the loan without checking affordibility or circumstances and that I would not be paying any charges or further interest.

 

I wanted to set up a payment plan over 6 months which is now in place and I did not have to provide any evidence of I&E. I took extracts out of many posts and from the survival guide and it seems to have worked

Lastest update I sent a formal written complaint to them nearly two weeks ago they have not responded yet however I have now received my first email from motormile finance telling me to phone them immediately to discuss the debt, not a chance of me doing that. I have emailed back stating the account is in dispute and subject to formal complaint and no further correspondence will be entered into with them. I received another email confirming receipt of my email saying it will be answered as soon as possible however I Should phone them to discuss the matter. Any suggestions on what I shoUlster do next.

Did you put deadline on the letter?

Its important that you hold them to a deadline and their own complaints procedure. E-mail again saying.

 

I raised a complaint on XXX (copy of which is shown below), I haven't received a response.

 

As a financial organisation you are required to treat customers fairly who are suffering financial difficulty, you have failed to do so and have subsequently failed to address my complaint.

 

I require a response to my complaint within 14 days, failure to response will result in me taking further action against you.

You've done the right thing in emailing MMF confirming the account is in dispute. Leave the ball in their court - do not call them.

 

Please be careful with Mr Lender - they're slippery s0ds. You've sent them a formal complaint, they;re obliged to acknowledge and respond to your complaint within 8 weeks. After this time you can (and probably should seriously consider) as FOS complaint. In the interim, send a complaint off to the OFT. It looks at this stage they're clearly ignoring you hoping you go away - don't. Don't be bullied into anything that's not in your interest.

The majority of PDL's hide behind either a PO box, or a mail redirection centre. IMHO, the FCA and OFT really need to put a stop to this.

Mr lender have responded to my written complaint saying the matter is closed they have done everything reasonable to help me and they have now sold my debt to motor mile finance. I have received my third email from motor mile saying I have not contacted them and they are considering a door step collector to assess my circumstances. If I don't phone them in 5 days they will pass my case to their legal dept. They seem to ignore the fact that I have emailed them twice with no response. I am pushing my complaint higher I will not let them wriggle their way out of it. Motor mile can take a running leap if some one does call at my house they will seriously regret it. I will not be intimidated by them.

Time to get the FOS involved. Theyve basically ignored you and tried to evade responsibility by selling the debt.

Make sure you provide the FOS with copies of all the correspondence, I've also found spoon feeding them helps so I write a summary of case referencing the various documents just so the case officer has no issue going through the info.

So, Mr Lender have decided your complaint is closed because they cannot be chuffed to deal with it? Bang out of order but entirely normal for this bunch. As they've sent you a "final response" you must get your complaint off to FOS sharpish. Use all the evidence, including their clear refusal to deal with your e-mails in at timely or a fair manner. Also, inform the OFT, these kind of numpties really shouldn't hold a credit licence as they don't have any integrity.

Just a quick question. Today I have received my first real letter from mmf giving me all of the loan details saying if I disagree that the loan is mine I should contact the police if I agree the loan is mine I can set up a payment plan and have enclosed a direct debit mandate. Not that I will ever give these jokers that much control over my bank account. But the envelope they used had their logo and full business name on the front so any one seeing it may know that it's a debt collection agency contacting me. Has this broken any data protection rules?

No DPA rules, but definitley OFT guidance.

 

Im also puzzled by their reply saying that if the debt isnt yours, then YOU have to contact the police. Umm... no. It is up to the creditor to prove the debt is valid. NOT the other way around.

Yes. Mr lender are one of the worst for ignoring people, then sending the debt on to someone else. Guess it doesnt help when the company is effectively a one man band.
