    • Firstly, I would like to thank everyone for their help in this matter. Since my last post I have received a reply from Plymouth Council Insurance Team concerning my wife’s accident (please see enclosed letter and photo of the offending Badminton post) which they deny any responsibility for the said accident. I feel that the Council is in breach of their statutory duties under the following acts: The Leisure Centre was negligent in its duty of care and therefore, in breach of the statutory duty owed under section 2 of the Occupiers’ Liability Act 1957. Health and Safety at Work Act 1974 (the Act) to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all their employees, and others who might be affected by its undertaking, e.g. members of the public visiting the Leisure Centre to use the facilities. The Management of Health and Safety at Work Regulations 1999 that requires employers to assess risks (including slip and trip risks) and, where necessary, take action to address them. The Provision and Use of Work Equipment Regulations (PUWER) require the risk to people’s health and safety from equipment that is used at a Leisure Centre be prevented or controlled. I would like some advice to see if my assumptions are correct and my approach to obtaining satisfactory outcome to this matter are accurate.     • Talking to them does not reset the time limit, although they will probably tell you it does, they'd be lying. Dumbdales are the in-house sols for Lowlife, just the next desk along. If Lowlifes were corresponding with you at your current address then Dumbdales know your address. However, knowing that they are lower than a snake's belly, you would be well advised to send them a letter, informing them of your current address and nothing else. Get 'proof of posting' which is free from the PO counter, don't sign it, simply type your name. That way then they have absolutely no excuse for attempting a back door CCJ.   P.S. Best course of action, IGNORE them, until or unless you get a claim form......you won't.
    • A 'signed for' Letter of Claim has been sent today so they have 14 days from tomorrow... Lets wait and see what happens but i suspect judging by their attitude they wont reply

    • Hi All, So brief outline. I have Natwest CC debt £8k last payment i made was 7th November 2018 Not a penny since. So coming up to the 6 year mark. Can't remember when i took out the  credit card would be a few years before everythign hit the fan. Moved house 2020 - updated NatWest as I still have a current account with them. Then Lowells took over from Moorcroft and were writing to me at my current address. I did get a family member to speak to them 3 years ago regarding the debt explained although it may be in my name I didn't rack it up then went contact again. 29th may received an email from overdales saying they were now managing the debt. I have not had any letter yet which i thought is odd?  Couple of questions 1. Does my family member speaking to lowell restart statute barred clock? 2. Do you think overdales aren't writing to me because they will back door CCJ to old address even though Lowells have contacted me at current address never at previous? ( have no proof though stupidly binned all letters  ) Should I write to them and confirm my address just incase? Does this restart statute barred clock? 3. what do you think best course of action is?   Any help/advice is appreciated I am aware they may ramp up the process now due to 7th December being the 6 year mark.   Many Thanks in advance! The threads on here have been super helpful to read.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks guys, ive posted a link to this thread on the BG facebook page too. Bets are on how long it stays there.

 

Im composing a letter to the Court right now. Im still gobsmacked a Court will issue a warrant to The Occupier! A warrant i have yet to see.

 

You should include in your letter that British Gas had been advised by both you and the Land Lady that the previous tenant was no longer there and a forwarding address had been provided. You should include copies of any letters that you and the LL wrote to BG advising they had the wrong person as well and if I recall, they wrote to you confirming they had this information. In which case, you should enclose BG's letter.

 

If you want to pop your draft letter up on the forum before sending we can make sure you have everything covered.

 

Meanwhile, both you and the Land Lady should send a Subject Access Request to British Gas, it will cost £10.00 what you really require is a copy of that warrant.

Did you contact the RSPCA regarding the snake ?

 

Apparently they would most likely prosecute this mistreatment and if you have vet reports as well, this would help them.

Thanks Citizen B, im gathering all the paperwork now. BG even had the nerve to moan that i did not return the Direct Debit mandate so my payment plan was cancelled!!

Ive pulled off the SAR template and that will be going first thing Monday, id do it this weekend but living between 2 homes is zapping my finances quite a lot.

 

I contacted a Reptile specialist that i know, who is writing me a report to say that the snake died from over heating, he described it like a dog in a hot car. As snakes are exothermic, our snake could not regulate her temperature, the STAT responds to temperature increases and decreases accordingly, the STAT was at zero. My Rep vet is also on board with the specialist. Ive made a complaint to the RSPCA and the IHS ( International Herpetological Society).

 

I did speak to the Court who told me they cannot give me a copy of the warrant as its not in my name, go figure!!

That is good you can get reports regarding the loss of your Son's pet.

 

They cant give you a copy of the warrant because it isn't in your name, but is has been used to turn your lives upside down !..

Update : Got off the phone with BG. They cannot send out a service engineer as they promised as i dont have a "live account"

 

Of course i dont have a live account, they wont connect me....

 

Only way to get gas now is to pay for a service engineer, i cannot afford that.

 

Stalemate. Suppose id better go find somewhere to sleep and shower tonight, again.

 

The lady on the end of the phone was in tears because i cracked up and cried, im being forced to be separated from my children. Im losing my mind and i cannot afford to be like this now, when i need to be sharp and have my facts in place.

 

Would someone help me write an email to Sam Laidlaw please. I know my MP is or has contacted his office, i guess thats why they were so quick to remove the PPM and install the Credit Meter.

Trying to, they are calling on my mobile so im limited. The woman im talking to now has said that the engineer would not switch the gas on if he found an appliance unsafe, he did not even come in the flat and said his boss told him not to connect it.

 

They are insisting on another boiler service despite the last one being 4 weeks ago. They were happy to install the PPM and switch that on, so why are they saying they cannot do it with a credit meter?

 

Its £99 to get gas back and my life. They refuse to put anything in an email too.

 

Being utterly truthful, i feel myself and my kids are being bullied and abused by this Company. I feel violated.

 

Update: My MP or his representative is on the way now, he has said he will not move till this is sorted out.

You should not have to pay anything. They entered illegally. You should simply have been replaced as the account holder.

 

They should be recording their own calls – bet they ‘mislay’ them in an unfortunate ‘admin error’.

Yep thats my thoughts too, still i have dates and times of calls and some partly recorded. Funnily enough since my MPs representative got on the phone, BG are sending out a National Grid engineer to reconnect me. Wait for it....because they think there is now a gas leak! But the previous engineer failed to mention it.

 

On his job sheet it stated that he was to leave me with a supply, as we know he refused. Now he can only refuse on the grounds some gas appliance is dangerous. How the hell would he know, he never entered the flat. He said he was forbidden to connect me by his boss who reiterated the same. BG have said he can only refuse if there is a suspected gas leak - thats why they are sending out an engineer.

 

So now what they are telling me is that i could have a dangerous gas leak - bit bloody late, ive been sat her since 3 o clock, i could have been blown to smithereens.

 

You could not make this up seriously.

It really sounds like a mistake was made originally and the people involved are desperately ( and failing) to cover their tracks. Oh well, more fuel for your legal action.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Gas doesn't explode. Gas and air mixed together in just the right ratio explodes if it catches light. There's only a small window with a gas leak where the ratio of gas to air will be potentially explosive so you're either past it or, :-) you're not there yet. I had gas leaks all over my old flat, the gas board checked it when they upgraded the meter and they shut everything down that was in it, boiler, fires, cooker, even some pipe-work was condemned. But it never blew up and there were pilot lights on, I was using the cooker regularly and the fires the whole time. I think you'll be safe for now!

I have just seen your thread and I am truly shocked.

 

The guys here are giving you the best advice they can.

 

You must sue them on every count and I'm sure there will be a solicitor who will act for you pro bono.

 

I hope this is resolved very soon. It's staggering how long it is taking them to put right what they got so wrong.

I knew it was too good to be true. The engineer has just left and said he cannot switch the gas back on, its been capped, until i pay £99 to have the boiler tested ( which was done 5 weeks ago)

 

Still no gas. I cannot take anymore. I cannot take care of my own children properly, what kind of a mother does that make me. A **** one that what. Ive had enough, i cannot fight them, i cannot think straight anymore.

You can fight them. Make sure you tell your MP everything that is goign on. Keep them updated. You also have a very high, almost guaranteed chance of a successful court claim.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Im trying to hang on to that Renegadeimp. It was the first week in July that me and the kids last spent a night together under the same roof. BG are aware of this but they continue. I miss them so much its making me sick. The Daily Mail are interested in running the story now as well as the Sun.

 

If anyone from BG is reading this, and with 120 guests, i guess its possible, i have a message....what you are doing to me and my family is TORTURE. Its BULLYING. You messed up, not me. You acted illegally, not me. I pay my bills, i do whats right. All i want is a hot shower, a hot meal, and a little heat to take the chill out of the room my baby sleeps in. May God have mercy on your souls because when i get your sorry asses in Court, il make damn sure that the Judge and Press show you the same treatment as you are showing me. How would you feel if some broke into your home, killed your kids pet, left you with no means to take care of your family, had to farm the kids out to whoever can look after them. Is it you comforting my baby Esme when she cries for me? No its not so dont you dare ever try and justify this.

 

For the record, il be paying CAG for its advice and claiming it back from you.

You are not a **** mother. You are a victim of British Gas's ineptitude and totally appalling behaviour. None of this is your fault. They don't give a damn. They couldn't care less. They wrecked my little girl's room by fitting the wrong valve to my water tank and then told me that I had done it myself. They will do everything they can to avoid liability. They only settled with me when I issued court proceedings. They were rude and aggressive throughout and just as they are doing to you, they wouldn't return calls and denied any liability.

 

Hopefully the papers will run your story very quickly.

I received a letter from an (apparently) independent loss assessor. They weren't independent. They were part of British Gas trying to force blame on me. They wanted me to claim on my insurance for the damage caused by their engineer. Don't allow them to send anyone to assess the damage. They are rotten to the core.

 

I am so sorry you and your children are going through this.

Thank you. Ive gone as far as im willing to now with these clowns. Ive been offered help here with Court proceedings, im going to start that tomorrow.

 

They even lie to my MP, how bad is that.

Thank you honey. That was my thought too, if we pay this money then thats accepting their terms and i will not do that. The appliances were good enough when they fitted the PPM and they had been stood 7 days since the gas inspection.

 

Facebook is going crazy, ive had offers from new snakes for my son, to nice messages from strangers saying dont give up, if you give up thats saying its ok what they have done and its not.

 

My sons CAF officer is steaming. She has now waded into the situation and will be making a report about the psychological damage they have done and are continuing to do to my son.

 

Its now at a stage ive got to move house. Its going on that long that my lad will never be settled here, its always in the back of his mind what happened to Coco, his snake. I dont think i need to say to you Danielle about bonding and small babies, you know the importance, i will not risk my babies health - simple as that, so she has to stay somewhere else. Im sorry to hear of your daughters room, kids own space is important, its where they feel safe.

 

BG have gone very quiet.
