    • I'd get back to them tomorrow, and explain the circumstances, that you have a wedding reception, and just appeal to their better nature. Hopefully they will be able to move sooner rather than later, especially if you go in in person and speak to them, and show them the issue.
    • The 3 pieces of mortar that fell on the same day, at the same time, were approx. 25-30cm long and weighed around ½-1 kilo each from a roof that is above the 2nd floor; they were by no means tiny pieces of mortar but large chunks falling from a rather great height. I believe the size and weight is enough to cause serious injury and if it falls on your head, I assume it could potentially be lethal if unlucky, but we don't wish to put that theory to test... We can't in good conscience let a contractor install a patio and a gazebo as it is in the exact spot where the mortar fell, nor do I think anyone would be willing to take the chance. Looking at the roof, there are multiple other remaining pieces from the same 'line' or 'row' of mortar that can potentially fall. The mortar is right underneath the slate tiles on the neighbour's roof and I don't know whether the tiles are also (becoming) lose due to the loss of the mortar. I was trying to upload a photo but it seems it's not allowed. The first contractor to work in our garden in preparation for the patio and gazebo is scheduled to start on 10th June, that leaves the neighbour 5 workdays to sort their roof which is unlikely, so it seems we will have to postpone our patio contractor without knowing when they can come back. We have already had extensive work done in the garden in preparation for the wedding reception and it will become very costly for us if we have to move the wedding reception to a venue (if we can even get one at this short notice) rather than have it at home which was our dream.

I contacted the seller who offered a replacement which I initially accepted but later rejected and wanted a refund in full which the seller refused saying they Do Not give refund is unlawful and goes against the Consumer rights act 2015. Therefore I intend to issue proceedings against you in a county court without further notice unless you reimburse me the above amount in Full within 7 days from the date of this Letter     ------------------------------------------    I think its best if i hand him the letter as posting it might not get through so can claim expenses traveling up there ?   or would it be best to just post and get 'Signed for'  ?   Should i also put in the letter of claim interest added or leave that till the Particulars letter ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I stupidly took a pay day loan out with these people as my partner has been on long term sick. When i looked on there repayment schedule it didnt make any sense. This month it was 98.00 then next month it was 158.00. I asked if i could set up a new repayment pan and offered to pay 35 this month and next and when my partner returned back to work in May i could pay a lot more.

They sent me an email back with an explanation why the payments were different each month but it didnt make any sense to me. They have asked me to email them an I+E and my payslip and wont take any payments till the 22nd April. At the bottom of the email it goes on to say that if i want to set up a new repayment plan to get in touch with them. This is what i have done and they seemed to have ignored it do you think they have done this on purpose. It states on my account that i borrowed 315 and that total repayment is 409 but according to the schedule i am clearly paying more than that. I have sent them a further email this morning stating that i have asked for a new repayment plan and i am offering to pay something i just cant afford what is on the schedule for the next two months. Any advice on these people will be greatly recieved.:???:

Dont send them any of that info.

 

Can you post the letter where they explain the amounts? Make sure to edit out personal info and reference codes.

Ok. So one more question. How much did you take, what was the contracted loan period and how much was the interest repayable that was stated on the contract?

    Hey there, just did some sums on the figures seem correct, easy way to work it out is

     

    Loan amount x 1.3

     

    First month you don't clear any capital just cover the interest of £94.50

     

    From then on you clear as stated 20% of the capital I.e 315 - 63 which leaves capital of £252 then there's interest added which takes the amount owed back up to £327.6 and this goes on for six months until its cleared. You pay a lot more for the loan if you don't clear it early which is what they are hoping for

     

    Think what's confusing you is that this is an instalment loan rather than a standard payday loan, I've had a few of them and it took me ages to work it out.

     

    Hope you can get rid of them soon, you will get great advice on here from those with more knowledge than me

    Dear All

     

    They have now sent me an email this morning to say that my account is in default and they have added £12 to the account. They have ignored the fact i asked to pay a lower amount for the next two months in my first email i have sent them two emails since then and they have ignored them also. The email that they sent said they would defer payment till April then they have tried to take the payment yesterday dont really know what to do next.

    Is that £12 a default fee or late payment fee.

    Ok so that fee is legit and enforceable. I would send them a letter of complaint, detailing your issue and what you want achieved. This sounds like an extended loan too, and not a payday loan, so it doesnt quite abide by the same rules as a 30 day payday loan does.

    Hey, I understand your concern. Don worry, there is a collections team working for this lender, you can reach out to them by calling 08453511482. Just ask to transfer to collections team. They will help you with an alternate payment plan.

     

    One of my friend in UK took out a loan and then had difficulty in paying back, so he approached their collection manager and got a new plan.

     

    Try calling them.

    If avoidable, NEVER phone a payday/installment loan company unless you can record the call.

     

    Not saying this particular company WOULD, but a lot of these company's are known to bully, harass and intimidate callers.

     

    Deal with it in writing or via email only to ensure a paper trail.
