    • Nothing will happen in regard to this one shoplifting event, other than Sainsburys won't let you shop in this store again.   But, if you continued to shoplift, then the consequences are more serious. Local to me, there  is a town where about 13 people have been banned from shopping in many of the shops. They are subject to some form of order, where if they set foot in any of the stores, they will be subject to arrest by Police.  
    • Agree with DX, Sadly, from the pics, it looks like you're bang to rights😪 The rules are very explicit. Before entering the box, you must ensure that you are able to completely exit. It looks like the car in front may have moved a couple of feet and tempted you to set off, but when you did that, there still wasn't enough room to completely exit the box. By all means ask to see the video evidence, but saying you had to stop because the vehicle in front stopped, isn't a valid defence.
    • Hello, welcome to CAG. I imagine the letter that the security guards talked about will be a letter from a company or lawyers who specialise in trying to extract money from shoplifters. I think Sainsbury's use DWF solicitors, otherwise it could be a company like RLP. It won't be a 'fine', only the police can do that. Look at this as a parallel 'justice' system that doesn't involve the plice. If you read around the forum for other cases of shoplifting, you'll get the idea of how this all works.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Long story short, my ex has been claiming High rate mobility and medium rate care for 4 years, shes never had an assessment, it was granted to her for chronic fatigue syndrome and the only evidence was a GP letter.

 

I had no reason to disbelieve her, she always walked with 2 sticks and on outing made me push her in a wheelchair, during the night I'd need to help her use the toilet and before work, i'd help her out of bed and to get dressed.

 

My friends all told me that I was being taken for a mug and there was actually nothing wrong with her and they knew it, I of course , back my ex , as at the time, I had no reason at all to disbelieve her.

 

However, since we have split, family and friends have provided me with 4 videos of her walking, some distance, without her sticks, at a brisk pace and clearly not suffering any pain (She used to visually show it)

 

Is there an email address I can pass these onto the DWP on ? I know there's an online form, but these video's cant be added to an online form.

 

I might sound bitter, but im not, benefit fraud is something I am simply against 100%, she might have recovered since we split and thats fine, but shes still driving the same motability issued car and using her blue badge.

Seems to me that people are stirring. DLA is usually given for a fixed period of time. It may be that there has been an improvement which should be reported as a change of circumstances. If it were me i would just report you suspect there has been an improvement.

Yes you are right to say benefit fraud is benefit fraud but it does sound as if you are being manipulated. If your family have shown you these videos why haven't they reported her?

I have the videos, so its not really stirring TBH

 

It's clear that I have been taken for a ride , They have not reported her because they wanted it to be my choice, so that I didnt blame them.

 

When someone claims to be unable to get out of bed daily, for 4 years, then the next thing is they are in a supermarket , bending, stretching, then carrying lots of bags in their arms, then walking totally unaided etc etc, the proof is there really.

They probably won't be able to use the videos in the investigation, but you can report it by either phoning 0800 854440 or completing the online form on

Why is it that you had no reason to disbelieve her and now 4 videos of isolated events seem to have convinced you otherwise?

 

Why were these videos made? Why were they supplied to you? Are these so called friends who told you there was nothing wrong with her qualified medical professionals with access to her notes and party to her care plan?

 

If I were you then the first thing I would do would be to contact her directly and get her side of the story. Tell her about the videos, show them to her and give her the opportunity to take control of the situation rather than sneaking about behind her back and risking massive repercussions you may not have considered. What happens if you report her and some jobsworth sells the videos to the Daily Mail to "teach her a lesson"?

 

Nice the way the DWP provide a freephone number for reporting benefit fraud and refuse to supply numbers to benefit claimants that are included in call plans despite steering group recommendations that such numbers should be provided. Shows you where their priorities lie.

 

If you're really dead set against benefit fraud then maybe you'd like to consider directing your anger at the predatory corporations stealing public money under the auspices of the Work Program. See

The sad fact is, the videos are all one month apart ,showing that it's not just a day, like I say, she's never walked un aided before, be it sticks or a wheelchair

 

I know that genuine disabled people are being taken off DLA unfairly

 

but this runs much deeper, I know it does.

talking to her isnt an option, she just hurls abuse, I got out because for years she was physically, emotionally and financially abusing me tbh.

 

She isnt the type of person you can have a chat to , everything is ultra defensive mode.

It's pretty pro DLA here and for those who are genuine, I agree, but if actions like this stop it getting to the genuine, then surly , it needs stopping

Annonboy, you dont say how long you cared for her, was it for the 4 years (or longer) that she's had these illnesses and claimed DLA? If so, how could she fool someone for 4 plus years? Also her GP would not prescribe morphine patches without good reason. I really think you need more than 4 random videos, also, as you have been caring for her, then it may possibly implicate you.

 

Think very carefully before doing something you may regret and could well be nothing more than malicious tittle tattle.

When someone controls you , your money, the fact you cant have friends, speak to relatives , leave the house, other than to work , then its pretty clear to me that they are very manipulative, I was with her when she got the patches from her GP, the conversation was short and sweet

 

"Im in loads of pain, depressed by it, cant move, nothing else has worked (prescribed pain killers) what can I have stronger"

 

The GP then put her on morphine patches and that has stayed the same in all that time.

 

I understand it looks like I am an accomplice, but when I wasnt permitted access to my own bank account, either my debit card, or online account, I was regally beaten if I even dare asked for more than my £5 allowance (She has been changed for assault ) then there has to be mitigating circumstances in all this

If you decide that you wish to report her the best way for you to do so is on line. You can google report benefit fraud and its probably one of the first things that comes up.

 

I think that it is quite a long form but there is a part towards the end that you could say that you have this information - the only problem with this would be that you would have to give your contact details for the investigator to get in touch with you. This doesn't mean that your ex would find out who had reported her as that should be kept as confidential. They may decide not to contact you but that would not mean that they are not taking the investigation forward.

 

They would probably not use your video's as evidence but it would give them some indication as to whether or not they should launch a full investigation and gather their own evidence independently.

 

Only you can decide what is the best thing to do.

What you describe about the abuse you were under Annon is shocking, however, I have read your Child Benefit thread, and it may be worth thinking what the affect any investigation may have on your children, especially if your ex's wife's GP has prescribed and I assume she is using the morphine patches and he has further written a letter stating she is suffering from these illnesses.

 

By what you have described, its great that you are now free of this woman and that hopefully you can start building a new future for you and your children.

It's easy to faslify dates on videos, how do you know they are true? Example below.

Those videos will not be sufficient evidence. I agree with the others, if you send them in you are proving that you are a bitter ex as you saw nothing, whereas the person who made the videos could report what they personally saw. It's not your job, what you are actually know is nothing, all you have is hearsay and some videos which could easily be falsified.

 

You can tell the people who showed you the videos to do what they like with them, but to leave you out of it. Let the legal system be justice for any charges you bring against your ex, these are the things that are your business and that you do know about; nothing else.

Doctors are loathed to provide morphine these days thanks to our friend Harold Shipman. As they are a controlled drug they will be audited as well.

I do not doubt you were an abused partner but frankly the evidence is very scant.

In my opinion,if you want to report her do that but let them investigate.

I also suggest that you might need some support as i am afraid some people allow themselves to be manipulated and abused. I loved my late wife very much and on a good day she would admit that she knew exactly what buttons to press to get the required response. We were separated for 10 years and i was still never free of her and this annoyed my current partner very much.

Any opinion I give is from personal experience .

My son was reported by someone who felt he did not deserve DLA and we have been to hell and back even though his doctors have given statements in his defence. His gp and specialists have had to give no end of their time because someone decided that he was prescribed medication that he did not need by telling the doctors the other stuff did not kill the pain just as you have said. This is still going on for us and I am sure others are still going through the same due to people thinking they know better than doctors. As already said morphine is never given out that easily there has to be something genuinely wrong and I would think her doctors would back her up on this. I for one feel that when anyone reports someone they should be prepared to stand up and be counted. You will find they will not be able to use your videos either as they are supposed to use their own if they decide to prosecute we were told this by two solicitors.

No one on here knows what your ex has put on her claim or review forms. If you report her the investigators will use these forms to see if an offence is taking place. Like myself & kk3852 have already said, its doubtful they will be able to use the videos as part of the investigation, but if you leave your details at the end of the form they may decide to contact you about them.

 

If you also provide info on any regular appointments, shopping trips etc, where she could be observed this would enable the investigators to obtain their own video evidence, which in turn can be used to help prove or disprove the case.
