    • Hi I was caught shoplifting 4 items £20 worth, I’m petrified the Police will come to my house now please can you help. What can I do I worried about my job. 
    • I heard nothing more from J&P but have now had an email from the bank saying they have instructed IDR to act on their behalf?  so are they just passing it back? Selling it on again? I don’t know if this is a good or bad thing 
    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks... I asked HSBC to extend my o/d but they wont (I wonder why!) so Ive just gone over my limit 'un authorised'. Im not gonna let them spoil my xmas!! But still, id love to share your chocolate biccies, thank you, your very kind! :)

 

I did my MCOL on the 20th it was issued on the 21st. Ive worked yours out to be the 15th? She said that if its a weekend or bank holiday that they have until they give them till the next working day! :( But either way, if yours is the 14th or 15th your fine!! Thats next week!!!

Yep, my 'big' day is next wed all being well, then I can HIT that little ole judgement button in MCOL, but I just know that that dear ole DEBS at DG will scupper that one by submitting a full waffle charged defence and then I have to find another £100 taking my account even more overdrawn and getting even more charges - life on planet earth goes on, it's off to work I owe I owe, with a debit card and cheque it's of to work I go, dum dee dum dee dee dum

Even my big box of help didn't arrive - what am I going to do NOW :eek:

 

Had a snotty call from EGG this morning, that set me up for the w.e. nicely, missed last months CC payment, arrggghhhhh I think I'll be walking the streets this christmas selling chestnuts :eek: and shoelaces - unless I sell my body - nah that wouldn't work, all the refunds would make me worse off (thought I'd get that in BEFORE you say it) ;)

I need some advice ??

 

Just checking my HSBC account, and yep you can guess !!

 

Oct charges = £125 + interest

Nov charges = £150 + interest

 

That's £275 down the DRAIN - how on earth will I EVER get my account back in order when this is how they behave

 

The question is "As I have a MCOL running, 28 days up on 14th Dec can I start a 2nd claim ?

 

i.e current claim is for period 09/00 - 08/06 so can I start a 2nd one for period 09/06 onward ????

 

Would they be likely to close my account, if they did, can they close ALL my accounts, or just the current one (I have a pesonal loan account as well)

 

I think I'll go bust at this rate !!!! sniff sniff

i think you could do with a two-pronged approach. first, contact the bank, a quick letter to you branch manager perhaps. tell him, you are trying to get your finances in order but their constant charging is not helping. tell him you have filed a claim against the bank for older charges and ask him if, as a good faith gesture, he might like to reverse these two charges. let him know that you (always polite, even when firm) will not hesitate to file again, but to save the bank and yourself this action - would he not care to remove them.

then, don't do anything else - but when dg contact you - as surely they must soon, when you get into any kind of meaningful dialogue with them - use the same approach with them. you have had 2 more charges levied against you - would they like to include them in your claim to avoid further legal action. (keep on top of your account - if the bank reverses them - don't mention them to dg).

as their right hand doesn't seem to know what their left is doing - i figure one or the other of these might work.

as for actually filing a second claim - yes, they will probably close your current acct. shouldn't effect your other accts. so you might like to open a current acct somewhere else if you do decide to file again. try the two-pronged approach first.

Thanks for the very helpful info, ok I'll try the 'nice' approach with my branch first - pointing out that I'm not one to be messed with as I have claim on the go at the moment !

I have a couple of savings accounts with HSBC, and also a ISA (sadly all pretty barren at the mo :| )

 

But although my account isn't actually overdrawn as I write this, it probably will be when I get hit in a couple of weeks time with £150 in charges + interest - how on earth they think I can ever get my self out of this is beyond me - incidentally I have a CC account with EGG, and they are bending over backwards to the point of being horizontal :)

 

Maybe HSBC should take leaf out of their book :D

Hey Steve!!! (Im still humming the tune - desoerate to watch snow white now!!)

 

Im in a similar situation, was charges last month for £55 and this month for £125 (which I thought was the maximum charge? Ive never been charges more than this despite living outside my o/d limit for the whole month!!

 

I also have another account with them and a savings account, I have only made a claim up to may this year to keep it within £5000 to keep court fees down, my plan was to do a second claim in the new year for the rest oweing - £850 (aprox!) Now I hear 2 claims means ur account gets closed?! So like you I wanna know if there gonna close all my accounts or just one?!

 

No other bank is going to let me open an account, my credit rating is way too bad!!

Just a brief note, I opened an account with Lloyds TSB, all beit only a 'cash account' but at least it's somewhere to get my salary paid into if the brown stuff hits the fan with HSBC

 

Obviously if I get all my claim back (£3,700) I won't be in amess with them anyway (shrug)

 

Talk about chicken and egg !!

From what I read they usually do close accts....my credit rating is crap too but I opened a really basic one at Nat West, step acct i think its called, with no prob.
