    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.
    • I see you said you tried to stop the DD but it seems that didn't work. May I please ask why that didn't work? You should be asking your bank to cancel the DD and I don't see why they would have objected, hopefully you can clarify this. I agree that you should be making a claim here against your bank and ask them for a DD refund. There is no timeframes for this.
    • JK: Yeah That's correct. We left rent payment coming out of his bank account from January 2023 - August 2023 until we could find somewhere to sort out his belongings which was fine. I tried to give notice a few times from August 2023 asking for advice from Sanctuary housing how we went about this explaining his condition and that he was in a Nursing home from December 2022. I explained we don't have any legal powers to his account like POT but were in the process of going for Deputyship and that I was the named person to act on his behalf to speak with Santuary housing. I said we could provide details of his condition and proof he was now in a nursing home with date he moved in. This went ignored despite repeated attempts to contact them until a housing manager contacted us end of February 2024 and notice was finally accepted with his tenancy coming to an end March 22 2024. Although they have continued to take rental payments for the flat despite someone else living in it from the 1st April. I wasn't aware payments were still being taken till I checked his May banks statements. I had asked them to back date rental payments to August 2023 when I gave notice rather than just giving notice in March 2024 but they've ignored that bit. I don't see why they shouldn't give it back they've taken money they shouldn't have. Thanks DX, I wasn't aware we could do that for that length of time. I'll ask my wife to check with the bank this week

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I've been accepted for a job, but have to fill in an online form with bank details etc.

 

The problem is they want to know if I have a UK Passport - I am British but don't have a passport. I tick yes, it asks for the number, I tick no, it asks me to upload a number of other things, either which I don't have as they are for non British people, things I don't have full stop, or things I don't have on my PC.

 

What can I do? It won't let me skip to the next page :-( I may not be able to have the job as soon as I have been offered it.

Hello there.

 

If you've been offered a job, do you have a letter with someone's name and contact details on it? I would be inclined to ring them and explain the problem and see if they can suggest a way around the problem.

Thanks for the replies.

 

I went to the store today and handed in my CV and he offered me the job there and then.

 

He said I should go back tomorrow with Birth Certificate and NI proof tomorrow.

 

What I have done is upload a note saying I am a British citizen and will take proof to store tomorrow as requested by the store manager.

 

Hopefully that will be enough.

 

Sorry, really stressed as don't want to lose the job as soon as I got it.

If you have NI card, a full birth certificate, and a proof of address that should be plenty :) A photo ID would be the icing on the cake. (like a drivers licence?)

The problem is, I don't have a birth certificate. My mother passed away and I never got it from her and in any case, i've changed my name since, but I do have my deed poll.

 

I don't have a drivers licence, as I don't drive, but I do have photo ID, but it's ID from other jobs I have done. I have NI proof. I guess I just take as much as possible.

 

Ironically, the store deputy manager who gave me the job, knew me from another job 12 years ago - and I sound as British as they come.

Thank you, I may have to do that...and if/when I start the job, get a passport regardless of if I am going abroad!

 

I hope head office are willing to wait. He's fine, they may not be.

If you live locally to where you were born you may even be able to pop down to the registry office tomorrow and get it sorted.

You can still get a copy of your birth certificate from the local registry office - the fact that it isn't an original shouldn't matter.

 

Is it also worth applying for your provisional driving licence? Even if you don't want to drive, it's handy for formal ID purposes. No idea how much it costs, though!

I don't live locally to where I was born - about 100 miles. Plus It's complicated. I've had about 4 surnames in my life.

 

I can get a provisional and not have to at least try to drive? I think if I get this sorted, I'll go for a passport to avoidthese issues again.

Ok. I went to the registry office today, just to get some advice.

 

They say, back in 1982 when my name was changed, it may be the case that it wasn't officially changed, as back in those days it wasn't required that you go through official channels, so basically I could be screwed as there may be no evidence. I have to phone another county as my local office is not where I was born.

 

The Employer is holding the position for me, until Wednesday. I have until then to provide evidence. The store are happy for me to start, their head office want the info.

 

My Job Centre are not understanding why they can't let me be employed with the evidence I do have. I have a P45 and other documents. They have phoned the employer but they will not budge.

 

Really disappointed. After 7 years of illness and being a carer, this was my first paid job since. (I just missed out on a managerial job 2 weeks ago, but was delighted at how I performed at interview and my feedback I received)

 

I now feel flat. I want to work, now feel able too, but I may not legally have existed for 20 years and it is now stopping me getting my job!

You would also need to cancel the membership after the trial period if you don't need it.

 

I have to say that I don't quite understand about unofficial name changes as recently as 1982, I thought it was some time before that.

but your deed poll evidences your change of name?

 

 

It has been changed 3 times.....Mum was serial wedder.

 

Missing the deed poll from 82-02 and registrar says if it wasn't officially done, then their will be naturally no evidence.

I could....are they easy to cancel?

 

I was born 1976 and my name changed in 1977, 1982 and 2002 (when Mum died, I changed name) It's the 1982 one that I have never seen any evidence of.

Another thought for you, it might be worth a phone call.

 

A friend of mine altered his name to sound more English and when he needed to prove his name for insurance purposes, I think he swore a statutory declaration in front of a commissioner for oaths, if that's the right name, a local solicitor.

 

As I said, worth a quick phone call, and I'm sorry if I've remembered this wrong.

If HR are being difficult a letter of explanation would go a long way, particularly if it was countersigned as a Statutory Declaration. Ive seen this done quite a bit.

 

A passport is valid for 10 years and is useful even if you don't travel. I had to get mine renewed recently very quickly but was able to go to the office in Victoria, London without too much trouble.

Problem is that when you apply for a Passport or a Driving License for the first time you still need to provide a Birth Certificate as proof of identity.

 

The employer will need to see EITHER a Passport OR a Birth Certificate with supporting documents, so the OP needs to get a BC one way or the other, and will at this stage need to pay for speedy delivery to have it by Wednesday. Bear in mind also that this must be the FULL certificate, not the short form.

 

I fail to understand why the Job Centre are 'surprised' that the prospective employer needs to see proper proof of eligibility - the requirement has been there for several years now and anybody applying for a job needs to make sure that they have either a Passport or BC as for 99% of employers these are needed before en employee starts work.

 

Are there family members who might be able to help you unravel names or places in order to help get the certificate? The employer is certainly within their rights to withdraw the offer if you can't provide the documents so you need to make this a priority.

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

Ok....thank you for all of your responses, comments and offers.....the last 3 days have been eye opening!

 

My name change in the early 1980's was never official. It was a simple case of starting to use a new name. Apparently my brother had the same issue 4 years ago.....what a shame he never mentioned it to me!

 

So, the easiest way of doing this is to change my name that I had from 1977-1982/3 to what it is today. It sounds simple enough but it's going to take a few days and the employer won't wait that long.

 

Disappointing, but at least I will be able to sort this mess out so it doesn't happen again next time!
