Halifax now with 1st Credit

My Halifax account, which I have always believed to be unenforceable,

has now been sold to 1st Credit who are threatening bankruptcy proceedings.

 

Here is the CCA I got from the Halifax a few years ago.

Is this enforceable?

 

Also, what is the likelihood that 1st Credit will have any paperwork from Halifax?

 

Should I CCA them too?

Try posting your document using the following instructions :)

 

Dx100 – Instructions on uploading pdfs

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

the hit reply button

Can you also tell us a little more about the debt. Has it been defaulted have you received a Default Notice - when was the last payment made to the account.

I haven't paid anything on this for about 3-4 years.

 

I have this document handy, but I have a file full of other documents and letters which I will have to dig out.

 

To be honest, I thought this had gone away.

 

To answer BRIGADIER2JCS,

I believe it is unenforceable because it is an agreement from before 2007 and all they have sent me is a copy of an application form

which I am led to believe does not contain the relevant terms and conditions.

 

They did, later, send me some other stuff but this is in the file I have to locate.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

My guess is that they are attempting to produce a reconstituted agreement by providing ans app form and separate terms and conditions to satisfy sections 77/78 of CCA 1974.

 

If I remember correctly pre 2007 Halifax appsserved also as an agreement.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Halifax certainly used the dual purpose app/agreement form, as far as I can see this looks ok but is difficult to read.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

A lot of ppl have these ones ..mine is different from this ..I still dont think mine is ligit either ..to many niggles with it

 

not had that letter from cruds either ..mine was a welcome letter we have brought your debt blah blah ..Have put the account back in dispute..Makes me wonder if these Apps or/and any other paper work is ligit..why sell them on if Halifax thems selves could get the order..I did have a 40% discount in 2009 from halifax ..that tells you something :)

Well it makes us wonder how 4 years down the line no court from any1 ..If the Applications are ligit ..there maybe other probs with other paper work,, also Penaulty charges I have a lot on mine..I take yours has been through loads of DCAs and they have all given up?

 

Yes, I've lost track but it's at least 4. 1st Credit must have a way of doing things that works for them. Threatening bankruptcy is fairly extreme.
