Hi,

 

Have received a Statutory Demand from CapQuest.

 

They are threatening Bankruptcy.

 

Anyone have a rough idea if they will follow through on the promise?

 

I desperatley want to go Bankrupt, i am saving like mad for it (£40k debt)

 

Hopefully they may save me the £700 ish it takes

Ironically if you intended to avoid BR the best way would be to write to CapQuest informing them you are pleased to receive their SD and look forward to BR as you have a large number of creditors and cannot afford the considerable fee involved.....I bet they would run a mile!

Strange you should say that,

 

The provident person who spoke to me on the phone, another debt, couldnt get me off the phone quick enough.

 

Should have the cash by August - should have done it last year but everythime i get a little savinings together something breaks in the house or with the car

I suppose the only concern is if you have assets such as equity in property, cars etc, that exceeds your total debt. Also if you work in certain sectors such as finance etc BR would have a serious impact on your ability to find employment. In any event, if you have limited or no assets they may not bother. I'm sure someone with BR knowledge will advise shortly. Good luck!

Live in a rented house, no assets as such, small car in my wifes name.

 

I owe about 40k, mortgage shortfall from losing our old house, credit cards & loans.

 

Im just looking forward to a fresh start with all my problems gone :)

**UPDATE**

 

Recieved letter this morning from CapQuest.

 

They are sending a field agent to my address to serve me with a Bankruptcy petition.

 

However i can avoid such action by calling them to discuss repyment terms.

 

Amount is around £2500

 

Dont mind being served with it if they are going to go thru with it :)

 

does this sound familiar to anyone?

Tell them to send it by mail or courier. Not one of their commission based "field agents".

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
