    • So, Sunak has managed to get someone to 'volunteer to go to Rwanda hasn't he? .. for just £3000 payment to the person plus 5 years free board and lodging isnt it? - cost to UK taxpayer over £300M+ (300 million quid+) isnt it? - Bargain says Rwanda, especially with all the profit we made privately selling those luxury chalets Bravermann advertised for us   I wonder how many brits would jump at that offer? Thousands? Hundreds of thousands? Lets see, up to 5 years free board and lodging and £3k in my pocket .. I'd go - and like that person - just come back if/when I get bored. First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have they actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table? Thanks for your help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello All

 

I applied for a £120 loan from these people yesterday.

I had an email this morning telling me it had been sent however they'd only sent £105 as they used £15 for same day transfer.

The agreement was signed yesterday morning therefore they havent used same day transfer. Also, I didnt see anywhere it stated it would cost me another £15 (it usually comes out of the extortionate interest doesnt it?)

 

Anyway, I called them and expplained this and told them i want to cancel and was told that the cooling off period doesnt applied to me as Ive had a loan from them before??!!

 

My T&Cs say i do have the cancellation period at a rate of 0.70p per day and it doesnt mention anywhere that £15 will come off me for the transfer.

 

Does anyone know where i stand please?? I need to act quick due to the 0.70 rate of interest per day.

Have you had any loans from them before (or indeed any other payday style companies that might be part of the same group) ? I suggest that you cancel the loan (distance selling regulations) and the fact that the loan you took out was £15 light without any indication that this is what you were going to receive would not stand up in court against CPUTR2008. I have copied their FAQ's for future use. Are you able to scan up a copy of the agreement ? (minus the personal details). I also suggest that you send a complaint to the OFT too.

This is exactly what I thought, ive scoured their T&CS and cant find anything.

 

Also the man on the phone said the cancellation period (or lack of) is on their website (which I couldnt find)

 

the thing is, if i cancel now, will I lose that £15 on the transfer fee too>??? and shall i say i want to pay back their £105 immediately ??

 

ok, ill print it and try to scan the agreement up.

ooh forgot to mention, i have had a loan or two off them before.. all paid back.

 

i have a loan outstanding with money shop (who ive noticed they are connected to) but its a seperate agreement.

Same day service with a £15 charge (the £15 will be deducted from the amount transferred)

This is what I found on the application process... so I got that big wrong. However.. it didnt transfer on the same day, they sent it the day after it was approved.. and also as someone already said, it says on their website transfers within 45min (with no mention of fee)

I have spoken to consumer direct who basically told me whatever is in the T&Cs they have to adhere to..

 

Ok, so phoned Payyday express back.. went through the story again and was told yes i have to pay the fll amount of credit etc etc... so.. i told them ahem.. please check your own T&Cs.. i have a 14 day cooling off period and if i cancel within that time, i owe you the amount funded + 70 per day.. so off he went to his manager and came back after what seemed like ages... and agreed.. yess miss melbel, we will honour that but you cant do this again blah blah... EXCUSE ME?? do what again? i suggest you change your T&Cs i was simply following my rights! cheeky sod!

 

anyway, he then tried to take £120.05 (15 pounds of it being the same day transfer charge) when i had to correct him again, i explained, there was NO same day transfer.. and this was where it all started!! so he is only authourised to take £105.70 off me!! off he went again and spoke to his manager...

he came back and agreed to it!!

 

sorted!!

 

how annoying having to go through that stress though!!

 

They are obviiously not very confident or well trained in their T&Cs either

Good stuff.

 

The argument that these people provide a valuable service to those who can't get finace elsewhere I think is as shallow as a puddle of flea's pee. I think they are **** loan sharks and and should be treated with utter contempt.

Good result,

 

All OFT calls are 'routed' via Consumerdirect, apparently this is because some OFT offices were only dealing with certain issues and leaving others alone, and they all needed to have better clarity on what they have dealt with complaints wise. Quite sensible in a way.

 

Perhaps the CAB could do the same, our one is as good as a chocolate teapot... I knew more than them about who to complain to!

I have to say I had a result with them, had a loan of 756 to pay off, the first girl said they would only forego 32 of the 155 interest owed, when I phoned back to pay I got pit through to a supervisor to make payment, he messed up and didn't take any interest :)) silly boy, so I emptied my account so they get sod all from me ever again.

 

Wages into new non toxic account and payday hell over and done with, never again will I use them, ill turn to prostitution first :))

Seems some how I've ended up on the payday express mailing list, i'm getting their emails and this morning received a flier in my post box, i can opt out of the email which i now have but there's no mention of how to opt out from their post mailings... i'm also receiving other payday orientated emails that don't have an opt out which is quite annoying.

Marketing emails must have a clear optout. Failure to do so is a Breach of he privacy and electronic communications ( EC dirctive ) regulations 2003. Report to oft....

Send them a request under the DPA that you revoke the right for them to use any information they may hold on you to be used for any purpose.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I applied for a loan with payday express back in november 2012, i wasn't even accepted and yet still get emails and have even been phoned several times on my mobile by other finance companies. I've never applied for a payday loan before or since so there I must have been put on some form of list by payday express that's been sold on... so yes this goes on.
