    • I understand confusion with this thread.  I tried to keep threads separate because there have been so many angles.    But a team member merged them all.  This is why it's hard to keep track. This forum exists to help little people fight injustice - however big or small.  Im here to try get a decent resolution. Not to give in to the ' big boys'. My "matter' became complicated 'matters' simply because a lender refused to sell a property. What can I say?  I'll try in a nutshell to give an overview: There's a long lease property. I originally bought it short lease with a s.146 on it from original freeholder.  I had no concerns. So lender should have been able to sell a well-maintained lovely long lease property.  The property was great. The issue is not the property.  Economy, sdlt increases, elections, brexit, covid, interest hikes etc didn't help.  The issue is simple - the lender wanted to keep it.   House or Flat? Before repo I offered to clear my loan.  I was a bit short and lender refused.  They said (recorded) they thought the property was worth much more and they were happy to keep accruing interest (in their benefit) until it reached a point where they felt they could repo and still easily quickly sell to get their £s back.  This was a mistake.  The market was (and is) tough.   2y later the lender ceo bid the same sum to buy the property for himself. He'd rejected higher offers in the intervening period whilst accruing interest. Lenders have a legal obligation to sell the property for the best price they can get. If they feel the offer is low they won't sell it, because it's likely the borrower will say the same. I had the property under offer to a fantastic niche buyer but lender rushed to repo and buyer got spooked and walked.  It had taken a long time to find such a lucrative buyer.  A sale which would have resulted in £s and another asset for me. Post repo lender had 1 offer immediately.  But dragged out the process for >1y - allegedly trying to get other offers. But disclosure shows there was only one valid buyer. Again, points as above. Lender appointed receiver (after 4 months) - simply to try acquire the freehold.  He used his powers as receiver to use me, as leaseholder, to serve notice on freeholders.  Legally that failed. Meanwhile lender failed to secure property - and squatters got in (3 times).  And they failed to maintain it.  So freeholders served a dilapidations notice (external) - on me as leaseholder (cc-ed to lender).   (That's how it works legally) Why serve a delapidations notice? If it's in the terms of the lease to maintain the property to a good standard, then serve an S146 notice instead as it's a clear breach of the lease. I don't own the freehold.  But I am a trustee and have to do right by the freeholders.  This is where matters got/ get complicated.  And probably lose most caggers.   Lawyers got involved for the freeholders to firstly void the receiver enfranchisement notice. Secondly, to serve the dilapidations notice.  The lack of maintenance was in breach of lease and had to be served to protect fh asset. Enfranchisement isn't something that can be "voided", it's in the Leasehold Reform Act 1967 that leaseholders have the right to buy the freehold of the property. It's normal, whether it is a "normal" leaseholder or a repossession with a leasehold house, to claim this right of enfranchisement and sell the property with said rights attached and the purchase price of the freehold included in the final completion price. That's likely what the mortgage provider wished to do. The lender did no repairs. They said a buyer would undertake them. Which was probably correct. If they had sold. After 1y lender finally agreed to sell to the 1st offeror and contracts went with lawyers.  Within 1 month lender reneged.  Lender tried to suggest buyer walked. Evidence shows he/ his lawyers continued trying to exchange (cash) for 4 months.  Evidence shows lender and receiver strategy had been to renege and for ceo to take control.   I still think that's their plan. Redact and scan said evidence up for others to look at? Lender then stupidly chose to pretty much bulldoze the property.  Other stuff was going on in the background. After repo I was in touch by phone and email and lender knew post got to me.   Despite this, after about 10 months (before and then during covid), they deliberately sent SDs and eventually a B petition to an incorrect address and an obscure small court.  They never served me properly.  (In hindsight I understand they hoped to get a backdoor B - so they could keep the property that way.)  Eventually the random court told them to email me by way of service.  At this point their ruse to make me B failed.  I got a lawyer (friend paid). The B petition was struck out. They’d failed to include the property as an asset. They were in breach of insolvency rules. So this is dealt with then. Simultaneously the receiver again appointed lawyers to act on my behalf as leaseholder. This time to serve notice on the freeholders for a lease extension.  He had hoped to try and vary the strict lease. Evidence shows the already long length of lease wasn't an issue.  The lender obviously hoped to get round their lack of permission to do works (which they were already doing) by hoping to remove the strict clauses that prevent leaseholder doing alterations.  You wouldn't vary a lease through a lease extension. You'd need a Deed of Variation for that. This may be done at the same time but the lease has already been extended once and that's all they have a right to. The extension created a new legal angle for me to deal with.  I had to act as trustee for freeholders against me as leaseholder/ the receiver.  Inconsistencies and incompetence by receiver lawyers dragged this out 3y.  It still isn't properly resolved. The lease has already been extended once so they have no right to another extension. It seems pretty easy to just get the lawyer to say no and stick by those terms as the law is on your side there. Meanwhile - going back to the the works the lender undertook. The works were consciously in breach of lease.  The lender hadn't remedied the breaches listed in the dilapidations notice.  They destroyed the property.  The trustees compiled all evidence.  The freeholders lawyers then served a forfeiture notice. This notice started a different legal battle. I was acting for the freeholders against what the lender had done on my behalf as leaseholder.  This legal battle took 3y to resolve. Again, order them to revert it as they didn't have permission to do the works, or else serve an S146 notice for breach of the lease. The simple exit would have been for lender to sell. A simple agreement to remedy the breaches and recompense the freeholders in compensation - and there's have been clean title to sell.  That option was proposed to them.   This happened by way of mediation for all parties 2y ago.  A resolution option was put forward and in principle agreed.  But immediately after the lender lawyers failed to engage.  A hard lesson to learn - mediation cannot be referred to in court. It's considered w/o prejudice. The steps they took have made no difference to their ability to sell the property.  Almost 3y since they finished works they still haven't sold. ** ** I followed up some leads myself.  A qualified cash buyer offered me a substantial sum.  The lender and receiver both refused it.   I found another offer in disclosure.  6 months later someone had apparently offered a substantial sum via an agent.  The receiver again rejected it.  The problem of course was that the agent had inflated the market price to get the business. But no-one was or is ever going to offer their list price.  Yet the receiver wanted/wants to hold out for the list price.  Which means 1y later not only has it not sold - disclosure shows few viewings and zero interest.  It's transparently over-priced.  And tarnished. For those asking why I don't give up - I couldn't/ can't.  Firstly I have fiduciary duties as a trustee. Secondly, legal advice indicates I (as leaseholder) could succeed with a large compensation claim v the lender.  Also - I started a claim v my old lawyer and the firm immediately reimbursed some £s. That was encouraging.  And a sign to continue.  So I'm going for compensation.  I had finance in place (via friend) to do a deal and take the property back off the lender - and that lawyer messed up bad.   He should have done a deal.  Instead further years have been wasted.   Maybe I only get back my lost savings - but that will be a result.   If I can add some kind of complaint/ claim v the receiver's conscious impropriety I will do so.   I have been left with nothing - so fighting for something is worth it. The lender wants to talk re a form of settlement.  Similar to my proposal 2y ago.  I have a pretty clear idea of what that means to me.  This is exactly why I do not give up.  And why I continue to ask for snippets of advice/ pointers on cag.

In #194 you said you'd tried to sell for four years.  The reason for these points is that a lot of the claims against for example your surveyor, solicitor, broker, the lender and now the receiver are mainly founded in a belief that they should have been able to do something but did not. Things that might seem self evident to you but not necessarily to others. Pressing these claims may well need a bit more hard evidence, rather than an appeal to common sense. Can you show evidence of similar properties, with similar freehold issues, selling readily? And solid reasons why the lender should have been able to sell when you couldn't.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had a lump in the center of my ribs for the past three years and its grown from about the size of the top of my little finger to about the size of half my palm in that time...also about the same time span there has been two growths appear on each side of my bottom ribs they feel like hard nodules maybe an inch x an inch in size. I have seen no less than 7 doctors at my surgery and yesterday was the stand and fight day 'especially when i found out I had been lied to at 9.30' in the morning when the receptionist told me that they ahd tried to call me to say that the doc would not be able to see me due to being off sick....I returning home 'fuming' I checked my phone and on one had called me what so ever so I forced a new appontment for yesterday afternoon and had a heated argument with not one but two doctors there who are refusing me an MIR scan to my head shoulders front of chest and the two ribs....I think there is a fear there that the surgery has made a massive fopar with my ongoing diagnosis.....................I need to get this scan done they had sort of agreed to get me seen by a specialist but I fear it's all too late ....any advise on what i can do to force this issue to a faster consultation...noting will allay my fears now other than an MIR.

I was listening to Dr Phil hammond on questiontime a few weeks ago and he laid it wide open as to why we older people get less and less care...................I have paid my taxes basts

burlyb - you really should start a new thread but I feel the need to comment.

 

1. Have any of the seven doctors given you a diagnosis or an explanation for your 'lumps'?

2. Which specialty are they going to refer you on to?

3. Why do you want a MRI specifically? A CT scan +/- contrast is usually used in detection/classification of tumours affecting the chest, abdomen and pelvis.

4. Are your GPs allowed to refer for MRIs? AFAIK I think it is not commonplace. There is a trial going on in my health board at the minute for GP MRI referrals.

5. Why do you feel "it's too late"? You say you noticed the first one three years ago. Is your general health deteriorating?

6. Do the practice have the right telephone number for you?

seems all I do in here is write the wrong thing in the wrong place all the time.....I was following on fromt the top COMPLAINTS...............i'm complaing that my GP and the pracatice HAS been complained to in letter and verbal form by me................where does MY post differ so much from the others above it AND if I knew the answers #9 then i would NOT be here writting this COMPLAINT

Hello burlyb. No-one's criticising you, but this thread is about mjc's problems. The site rules do say something along the lines of no matter how closely your problem resembles the other person's, it's good practice to start your own thread. There's always copy and paste :). It also means you will receive advice specific to you, which is good.

You are obviously worried about your diagnosis and your inability to get the answers you need or want from your GP. This is very understandable and not a criticism in any way. If you feel you are writing things on this forum in the "wrong place" then I'd take honeybee's advice and start a new thread about the matter. Even if you post these in the wrong forums, the moderators wil - I am sure - move them for you.

 

Although the OP's poster was about formal complaints she was really looking for support or advice on her issue not as a invitation to other users to post their particular issues. Of course anyone is allowed to post but yours is on a different issue entirely but I am certainly here to help hence my questions. My questions are specific as I think they will help you get the answers you are seeking. You might not have answers to some e.g. the MRI and GP referral question but surely one of the seven doctors has told you what it is and why the aren't referring you on? Your diagnosis? Surely you can check with the receptionist if they have the correct number rather than assuming they lied when they said they tried to contact you?

 

As I said, I can understand your frustration but going in and shouting and arguing with your GP or his/her partners is not going to get you anywhere except booted off of their list and you will be back to square one. My questions were posted to try to get a better understanding of your situation and to provide you with advice and support. Making a complaint is entirely up to you and I sure the users of this forum will help your formulate one which can address your concerns about your health and wellbeing.

cheers everyone it can be daunting in here at times then being told i posted in the wrong place 'I do it all the time' lol

I have been under 7 different doctors at my surgery for almost three years and the lump in the center of my chest has grown from something about the size of the top of my little finger to something about 60mm across and maybe 10 or more mm deep. It affects me like now bending forwards and it pokes out under my skin if i lean back....it reads more horrible than it feels TBH BUT when I eat I have to sometimes stop and lean back andtake an extra breath due to it feels like it's trying to tuck under my rib cage 'docs have tried to allay my fears of what it may be. and have told me they can stick a needle in it and drain it off...not on their nelly I WANT to see what it is via an MIR scan before they fiddle with it. I also have two hardish nodules mabe about and inch by inch growing off the last rib on each side of me and these nodules can also be seen if i bend left or righ and they give a dull ache if I lay on them....I didnt have any of these symptoms before i started taking my heart pills or diabetic pills. I need to MIR to do two things....one to SEE whats growing there and to alay my fears and then also to check my shoulders and arms due I wrenched the right one when I fell over a raised pavement outside my house 'The last doctor told me that they do NOT do referals for shoulder strains' from the surgery....whats that all about and I also need to have them check my forehead when my head hit the path as i fell and it has left a small crater to the top left sdie of my forehead ......'council has been informed' still no one has visited the site or contacted me or checked the path.

I am just sick and tired of being at the sh-t end of the stick all the damn time....i've paid my taxes I deserve....and demand better than whats so far been offered

Why would you want an MRI scan? I've had similar on my back and it was just drained off with no further investigation. (but have now been told that it should have been investigated)

 

You will only get an MRI scan if the GP / consultant believes it's needed. You can't just request a scan like that.

thats what I need the scan for ....answers to many questions as to the raw pains in my ribs but through my shoulders from a fall over a raised council path too all thanks to a cyclist WHO was riding his bike and made me side step out of his way and onto the raised iffy repair....I ripped so much stuff in my right shoulder and cracked my head on the concrete that its somehow made a small crater in my forehead.....I need answers that xrays will not give....pity I'm not in bupa or it would have all been done by now.............I need to know for not just MY health but for my peace of mind too...............jeeeeeeeeeez....7 doctors ...why did I have to get past 7 doctors just to get the letter to get to triage...............if I were new to these shores i'd be loaded and seeing speicalists every other day

What is the clinical question you believe will be answered by a scan ?

 

Why do you believe that MRI is the most appropriate imaging methodology ?

 

NHS or private referrals for imaging are still evaluated against the RCR guidelines - http://www.rcr.ac.uk/content.aspx?PageID=995 - unfortunately there isn't a free online version of the 7th edition i can find

 

Second part

 

what 'evidence' other than the lies put about by the likes of the BNP that immigrants of whatever legality get preferential access to health services ?

some people spoil for fights #16...........I need to know whats going wrong with me due to I have my two sons to think about IF things are wrong ...they came close to losing me in nov 06 and DID lose their mum in Jan 99 so # 15 i'll leave it at that...and i'm more UKIP than BNP cheers for your input but YOU dont know me and vise versa but I know what i mean when i say what i say......

I had an almost stand up row with two docs last week about it Sean ....one of them told me not to be so aggressive :-x was more the the thing....7 blidy doctors and it came to an argument to get them to allow me to triage......dr Phil Hammond was right on question time the other week and I told one of the doctors that .....wow good old Phil he said...stirring it all up again..............someone has to grrrrrrrrrrrr

I just want answers to my questions due to it's my body NOT theirs and they cant feel the things I feel inside it ....tired here I just drove back with my son from our visit to check out Luton Uni...it's a great uni...I need a nap now poor ole me lol

I'm a nurse not a doctor and my usual stance for anyone looking for health advice on forums is to see their GP. Now obviously you have done that and come to this stage where you feel you have to post on this forum and feel the need for a formal complaint.

 

You do seem to have a fixation on MRI scans and the perceived benefits that you think/hope they will provide to your treatment - if any.

A needle aspirate would be appropriate in my opinion. An MRI would not. The tissue/fluid could be taken and sent to the pathology lab for analysis to determine its nature. An MRI might tell if it is a solid mass or a fluid filled one - possibly might be able to determine its nature but not likely. An MRI will likely tell us the location and size of these growths but ultimately a biopsy would be required. In any case, I am sure a HRCT (High Resolution CT) scan is the standard imaging investigation here. I may be wrong and will stand to be corrected.

How long ago did this happen? Did you go to casualty after this trip over the kerb? Are you still having issues with your arm and shoulders? An MRI might be of use here then again could provide no diagnostic information. A skull depression? Where exactly is this? I am sure in an adult would likely be a fracture - even a hair line one - and I assume you don't exhibit symptoms of a skull fracture? Your rather dramatic description of a 'crater' would seem to suggest it's pretty serious. From my days in casualty, I think the gold standard is a CT scan rather than MRI in any case.

 

I think the GPs have all acted reasonably. These advanced imaging techniques - if used in the way you propose - would bankrupt the NHS pretty quickly and cause patients with complaints that can be sorted in primary care to cause lengthy waits at radiology departments up and down the country. It would be great if everyone who came to their GP with a headache for instance could be offered a CT. 99.9% of them will show nothing.

 

From your posts it is obvious you are worried that these growths are malignant (cancer). From the little information you have posted, to me it wouldn't seem that way. I know that's not going to alleviate your worry for you and your sons. But you do come across as quite aggressive and your GPs seem to have had immense patience with you. I know many GPs who would remove you from your list for much less. Rather than you 'winning' by getting your referral, it is probably so the GPs can get you out of their hair for a wee while at least.

 

Good luck with your onward referral to whatever speciality your GP has referred you to.

you know what YOU know but you dont know me or the history of me and my family. I will re-read what you have posted BUT also I have tried for the past three years to have questions answerd......gp's are governed by how much they can spend per patient....I wasnt told that when I paid my stamp since I started work 43 years ago. I am worried about cancer due to my eldest and the younger of my sisters have died from it and I myself have had...............ah well.....

aimed at # 20 and in part to #22 damn it who do YOU think you are ...........................read the private message and digest it maybe you'll learn something instead of spouting off why I should or shouldnt do this that or the other YOU DONT KNOW ME and as for A&E back then I didnt go due to I didnt want to clog up their time with what i thought was trivial it's onle the past weeks that it's all come back to haunt me................I am NOT having needles in me without knowing more about what is being probed ...and like I said....Triage here I come BUT if that isnt what I expect it to be then I will be reporting my gp..............thats for sure.................7 doctors SEVEN

You know I have learnt myself, sometimes we can get worked up or flustered about something and think we have the right stance or understanding of what should happen, to realise later we were OTT and they do have patient interestes at heart of all they do. They do know what they are doing re the needle as first move.

 

I may get flustered and have a moan on here, but would never be rude to someone or want to come across agressive. You do burley come across aggressive, so why not let them do what they suggest and take it form there or the alternative is to go private and find the funds to pay for it.

I paid my way I have no intention of paying for something I already put into why would i want to go private ??..............I am aggressive to people who are pure ignorant to other peoples plight and especially when the other person may know what they are talking about BUT does NOT know me or my way of thinking...............you can have as many needles in you as much as you want...............I want what I want and not what that want as the cheapest option.............I was told that I had just 5 days to make my mind up on the triage .............hows that for the NHS.

I am sick of trying to explain to some of you...you have your notionas and i have mine...........you neither know me or can possible understand what and where I have to in my life.................I have paid into the NHS and i expect service and to be able to get cured and or put my mind at rest and if any of you can not see that because YOU are all sorted then good for you..........as for me I'm going to do what I can to get peace of mind and be cured.

 

I have so many issues to be posted in other forums on here and you would be surprised maybe when you know the shyte I have been through and still am going through.............nahhhhhhhhhhh you wouldnt I realise that you wouldnt understand
