    • I am sorry that you have come across excel -possibly the most inhumane of all the rogues that ruin parking in private car parks. i am more sorry that I have missed your thread until now. As I understand it, their artic. was parked in front of their parking sign and the Blue badge places forcing you to stop somewhere else in the car park to observe the rules. On realising that even the Blue badge places were paid places and that you did not have the correct coinage you quite rightly decided to leave. Thus you had read their terms and until you have read them and signified your acceptance by either paying or staying, you are not classed as being parked.  You have a MINiMUM of five minutes  leave. Sadly Excel do not understand any words greater than two syllables which is where their problems start. Their greed, ignorance, inhumanity, etc etc all carry on from there. However they do know that Judges do understand what minimum means and are well aware of the Equality Act  so I wouldn't be too worried about what excel  will do. Plus we still have to see their PCN and when it comes to producing a Notice that complies with the Act relating to private car parks they do not excel at that. I hope that the Iceland MD will cancel the ticket. You still have a couple of other routes you could try. The first one is your Member of Parliament will probably be happy to help as they will need all the votes they can get with an election looming. Plus your local newspaper may also pitch in after hearing your story to go after Iceland and excel. [You may notice I have not merite them with a capital E as it is definitely undeserved.]

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Lotta - well done!

Just wondering how you managed to get them to settle! Presume that this was before court action. I just got my second "NO" today, so I'll file a claim in court. Do you have a good relationship with someone at Lloyds or are you just very persuasive?

I haven't accepted their offer to settle as it was only on the basis that I would accept several conditions that I am not happy to accept as I do not see why I should be bound by them in order to be paid back something which is mine be begin with.

 

They have until Saturday to file their defence.

Just to let you know that I've received a copy of their defence and my allocation questionnaire from the Court today. They sent their defence to the Court on Tuesday, the same day I received their offer of settlement with strings attached.

 

Onwards and upwards.... any journalists or reporters fancy coming along to the Court case? Lol!

They have admitted it is your money by offering it to you?

What will they gain in court unless they are going for a silent restraint.

Got two letters from their Solicitors today, one regarding each of my claims and... they will pay the full amount of my claims into my current account and there are no strings attached!!!!!!!!!!!!!!!!!!!!!!!

 

£2,270.68 from charges on my current account and £388.20 for credit card charges.

 

So very happy.

Those of us who have been through the mangle continue to log on every day to assist. I got nearly £3,000 back at the eleventh hour, don't blink, fight...

Done the bank, going for Credit/Store Cards next. After that Mortgage companies ( 12 years ) but look for Bank Fodder in the FAQ's for overcoming the Limitation Act 1980, bloody good option, frankly. This site does work, and more importantly it does not cost, though there is a fighting fund for law books so they can keep up to date with current legislation. The advice and experience in this forum is good. Had I not taken note of the Newspaper Articles and the references to this site I would have been £3000 worse off, think on and go for it. It's your money, get it back....

Can you move your thread out of litigation in progress to concluded or does a mod/admin need to do it. Every time I log on I check to see how many threads are in concluded; the more there are the more encouragement I get.

 

I'm sure it's the same with many others.
