  2. Same man, my case moved to barnstaple (north devon) which is 45 miles away but the nearest one.
  3. Hi Brecken, I also got their defence and A/Q today so we are on the exact same timeline. They have also moved the case to my local county court for 8/8/06.
  4. Thanks for no advice on the above. Recieved A/Q today and LTSB defence. They have moved the case to my local county court.
  5. Got the letter from LTSB C/C department confirming account was closed on 28/3/06 with a balance of £0. Got equifax file today stating. Limit £7500 Current £6846 Last updated 6/7/06 I will now be putting in DPA on C/C. Is there anything else I can do because I believe this is retaliation ?. I have it in black and white that they have entered on my credit file the above. Whats my best next move ?. I am willing to take this as far as I can if you think I have grounds.
  6. RETALIATION OR WHAT. This is a personal joint account I'm claiming back charges on. Me and my wife paid off in full and cancelled LTSB C/C's on 3/06. Had a credit check done today only to find LTSB C/C have informed the reference agency that both accounts are 3 months in arrears ????????????? Went into local branch today and mentioned it to the useless-ess, I mean the manager-ess. She checked on computer and confirmed it was paid in full and closed. She phoned C/C dept who confirmed it was paid in full and closed. She asked for proof of the entry so I said "do a credit check yourself ". Had to leave the bank at that point but said I would return tommorow. Now, I could understand if it was paid off last week or even last month due to internal updates or human error the info had not filtered through, but 4 months ago ???? thats very suspect to me. What do you think ?.
  7. Deemed served on 2/7 Acknowledged on 4/7 by Sechiara Clark and Mitchel solicitors, and guess what, they're going to defend in full. I'm on the final countdown.
  8. Congratulations Reload, Well you have had a busy 10 days and I missed it all happening live. My computer has been down and just got back online today, looked for your thread first as I knew something would of developed by now. Apart from account review did you agree to any other conditions ?.
  9. Hi Towelie, When my statements arrived the first 2 or 3 years were copy of actual statements. After that (the last 3 years) were just the charges listed. Reference O/D interest, there is advice in the stickys to cover it. My own opinion on is its not worth the hassle for little reward. My charges were £977 and the O/D interest worked out to be £15 ish, so I did'nt bother.
  10. Hi Pieterclassens, I had the same problem as you, LTSB informed me by statement that they would be taking £70 in charges 1/06 which was a few days before I could file moneyclaim. I waited so I could include it, but to my surprise it was never taken. Carry on regardless and good luck.
  11. Hi and welcome to the site, Send the prelim letter with the figure £935. (wait 14 days) Send LBA £935 (if you get any more charges add to £935)wait 14 days. File on moneyclaim £935 + 8% interest calculated on the spreadsheet + court fee. Good luck
  12. Hi Clp, I will try to help you a little. I did not include O/D interest, it is hard to work out but there is help in the sticky's to do it. My charges total £977 and the O/D int on that was only £15, not worth the hassle. Total up your charges and send the prelim letter ( found in the templates library ) and forget about the spreadsheet for now. When you put your charges and dates on the spreadsheet it will automatically work out the 8% interest for you, but this is for when you get to the court stage only. You are allowed by law to put 8% interest per anum on the money you are owed.
  13. Filed a new claim this morning for a total of £1196.46. £977.50 charges, £98.96 interest and £120 court fee, did'nt include £10 DPAR as the cheque was never cashed. Last month the bank informed me on the statement that they would be taking £70 from my account on 1/6. Something must be happening in high places because this was never taken.
  14. Hi Spacebug, I sent my DPAR early april when they were no where near as busy as the poor buggers are now and it took 22 days. Use the dead time to get wised up on the next step and so on. That way your one step ahead and know exactly what happening. Good luck and do it right FIRST TIME.
  15. Hi, You have done it correct so far but dont send LBA untill 14 days after you sent the prelim letter. I see you have all your charges but its a good idea to have any notes of manual intervention which would come with the DPA request. Proceedure is - Dpa request Prelim letter LBA letter Court Good luck
  16. Phoned the court this morning told them I made a mistake with the figures and they advised me to suspend the claim which I have done. They will give me a refund and I have to submit a new claim and pay again, then e-mail them with the old and new case numbers. Going to file new claim in the next few hours and inform B/F of my **** up. Annoying thing is I did it right first time and then changed it.
  17. Decided to give them a call tommorow otherwise I think I will loose the £98.96. Sure I read somewhere if your total charges are less than £1000 you pay £80 court fee then add on the 8% interest. Will update you in the morning, thanks for your help anyway.
  18. Right just filed on money claim but may have made a mistake. £977.50 charges and £98.96 interest. Total box put £977.50 and paid £80 court charge, ticked box to say I was claiming the interest. Should I have put £1076.46 in the total box.
  19. I'm back, Sorry I went AWOL my computer packed up completely and its taken untill now to get it fixed. Bet you all thought I got my money back and buggered off without donating. QUESTION - I could of filed money claim on 2/6/06 can I just go ahead and do it today or will the 20 day delay alter things. In LBA I did not state when I would go to court so I think I am allowed to file money claim today.PLEASE ADVISE.
  20. Hi MrsF, You can add any charges you get right up to money-claim. So when you file you put £1744 + 8% interest.
  21. Hi MrsF, You can add on any charges you get right up untill you file money-claim and add 8% interest aswell.
  22. Wait the 14 days then file money-claim. In the meantime read up as much as possible on that proceedure. You are 2 days behind me, good luck.
  23. Received today their usual blah de blah responce from my LBA. Will be fileing money-claim on the 2/6/06. Watching Creds thread with great interest.
  24. Hi Reload, Watching your thread closely as we were on the same time line now you are 10 days ahead of me. Good luck.
  25. Hi Gary, I would send LBA on the 1/6 with the new charge added on. Some posters are sending LBA as soon as they get a reply from prelim letter, which they can do. You can add any charges on to your claim right up to money claim (court).
