  3. Quick question. I entered the judgement stating I wanted to receive my money by 2nd Jan but nothing has happened yet. I just logged onto Moneyclaim online and there is a start button available to issue a warrant. Has anyone else done this and should I go ahead and issue the warrant or wait awhile longer?
  4. Well they didn't acknowledge my claim at the 11th hour like I thought they probably would so I have started my judgement against them today. Not sure how long I will have to wait for them to pay up but I'll be patient. Watch this space.....
  5. Well IF have until today to acknowledge the claim otherwise I can start the judgement against them. I'm so excited. Will I have to start the judgement tomorrow do you think? Has anyone else gone the judgement route? I really thought they would file a defence. Any other feedback will be greatly received.

  7. I know I have been away for ages but I'm back and have started my action against IF again. I've written first and second letters requesting repayment of charges. I was told no in the first letter but have been offered a settlement figure of £167 with my second letter which I will not be accepting as my claim is for £466. I'm just filling the Moneyclaim in online but as IF address is in Edinburgh it has said that I cannot do this using Moneyclaim as it is not in England or Wales. Can anyone advise if they know if Intelligent Finance has a service address in England? If not how should I instigate my claim?
  8. I'm not sure if anyone else has experienced this with Intelligent Finance or any other bank but advice on next steps would be much appreciated. I wrote to IF on 25th March requesting statements and a list of charges to which they responded just detailing a list of charges and the dates but not my actual statements. They stated that this would be £5 per statement. I wrote to them again DPA - Data subject Access Request enclosing a £10 cheque for the statements and reminding them that the 40 days to respond is still ticking by. Today I receive a letter (with my returned £10 cheque) which states the following: Thank you for your request to access the information we hold about you, which is your right under the Data Protection Act 1998. I note your request for a list of your statement for the period Feb 2002 to August 2005. Please note this is not classed as personal information therfore we are not required to provide this as part of the DSAR and ordinarily we would charge for copy statements, £5.00 per copy. Therefore please find enclosed your cheque for £10.00 It goes on to say that they have enclosed three leaflets: All About Data Protection (which ironically states in it "Under the DPA you have the right to have access to information we hold about you on our records. The Act allows us to charge a fee of £10 for this service") All About Credit Scoring (I didn't ask for this??) All About our Complaints Procedure Please can I have some advice on how best to respond the above as they are contradicting themselves but I want to ensure that I follow procedure step by step. Do I complain to the Information Commissioner at this stage? And if so will this delay the whole process of me claiming my charges back? All advice welcome and appreciated!!!

  10. Okay I'm being impatient now. How long is reasonable to wait for the credit to my account after sending my signed acceptance back to Lloyds Solicitors. I posted it recorded delivery Saturday 27th May. I even went as far as having my ridiculous bank review with them today and listened to my account manager try to sell me more loans at extortionate interest rates!!! Let me know how others who have already had settlements got on at this final hurdle??
  11. In response to my DPA request I have received a letter listing details of 14 charges since 2002 which total £367 of which I cannot work out what is unfair without my detailed statements. IF have stated that they have detailed a summary of charges and should I wish a full list of transactions ther is a fee of £5.00 per statement to a maximum of £60.00. Can anyone give me advice of what I should write in response to the ridiculous request of £5 per statement as I didn't have this problem with Lloyds who provided all the statements I requested without charge. Thanks in advance!!
  12. Thanks for the advice. I will be writing to them again today as advised and let you know how I get on. This is such a frustrating situation and I will be so pleased when I have resolved it. Will keep you posted.....
  13. Has anyone had any trouble trying to close an account with Next Directory? I called them twice back in March to close the account which has been inactive for 2 years but have recently discovered was still open with a £3600 credit limit. I was told on both occasions that it had been closed but I can still log onto it online and access the selfserve number by phone. When I asked if I can have a letter confirming the closure I was told that they do not send out such letters. I wrote them a very strong letter stating that I want the account closed and confirmation that this has been done. I received a response a couple of days later stating that they are sorry I want to close the account (not that they had actually done it) and thanks for my custom. I decided to check again to make sure it had definitely been closed and it is STILL open and we are now in May!! Can anyone let me know if they have had the same or similar problem with Next and if so what you did to resolve it? I would now like to take this further but am unsure of the best way to tackle this as they have not responded to my request either by phone or in writing. Any advice would be much appreciated
  14. My claim including interest and court fees was £460. Thanks for all of your kind words and stay encouraged. It looks as though that Lloyds tough nut is beginning to crack!!!!!
  15. Good luck HD. I've got a good feeling that your settlement letter is winging itself to you right now:o) It took about a week between sending the AQ and receiving my settlement letter yesterday.
  16. Just as I was beginning to get impatient I come home today to find a settlement letter from Lloyds Solicitors. It does come with conditions so just wanted to run it by you all for advice on what I should do next. The letter states the following: In our open letter we have set out details of the Bank's defence and we should inform you that the Bank does not accept that there is any merit to your claim. However, regrettably the costs of resolving a dispute can easily exceed the amoun in issue regardless of who "wins" at the end of the day. The Bank is therefore willing to settle your claim on the following basis: 1. The amount of your claim will be credited to your account (I'M HAPPY WITH THIS!) 2. You must cooperate with the Bank's request that your account is reviewed (I'M OKAY WITH THIS!) 3. You must maintain your account within your current limit, and any new limit agreed with the bank (I'M HAPPY WITH THIS!) 4. Payment will be in full and final settlement of this claim and any further claims you have or may have against the Bank arising out of or in any way connected to this claim. (THIS IS THE POINT I AM NOT COMFORTABLE WITH AS IF THE BANK CHARGE ME UNFAIRLY IN FUTURE I FULLY INTEND TO CLAIM IT BACK) I'm really happy!!! Any advice will be much appreciated before I sign on the dotted line.
  17. Hi all, I am starting a new thread in this group as I now intend to get my unfair charges back from Intelligent Finance in addition to the claim I currently have going with LloydsTSB. I am posting my DPA Disclosure information request today via recorded delivery as I could only view transactions online for 2 years. Has anyone else successfully claimed back through Intelligent Finance? Will keep you all posted on my progress....

Quick question I am filling in the Court Allocation question and have got to the Other Information box which states: In the space below, set out any other information you consider will help the judge to manage or clarify the claim, including any other information you consider should be supplied by the other party. What should i fill in here? Can anyone else tell me what they have written? Also the cover letter states I should return the questionnaire and return it with, where the claim is over £1500 the court fee of £100. My claim is only for £460 so am I right in my understanding that I don't have to pay an additional fee?? I've ticked the No box to fee enclosed and written that the claim is under £1500 and I hope this is correct. Help!!!
  22. Okay I've received my Court Allocation Questionnaire which has to be returned by 27.05.06. Must admit getting a bit nervous now but am still prepared to take it the whole way. I am seriously out of my comfort zone now. eek!!!

  25. Hi HD just got a letter of acknowledgment today saying they intend to defend all of my claim. The letter says that Lloyds now have 28 days from 13.04.06 to file a defence. Is that what yours says too?
