  8. Oh, referee! I used spell check, okay syntax is wobbly, but so are their legal arguments against our individual arguments. I know you mean well but no judge in a court of law will mark any of us down for poor Grammar etc. The last remark was a taunt meant merely to goad them. You know as well as I do that all their communications are merely designed to intimidate. Quite frankly, I would rate my syntax and Grammar at least two grades above theirs having read some of their replys to me. These folk are supposed to be solicitors , educated in some of the finest institutions that this country p
  9. Hi all Just rattling through the latter stages of my second claim against lloyds ( all the usual stuff that Martineau Johnson send out ). Defence acknowledged etc. I've just received an open letter which they say they will draw to the attention of the court ( yeah right!) because of the agreement we signed last time around. The saucy gits have told me that to avoid this matter escalating further I should contact Lloyds Customer Support Team to discuss turning my overdraft into a loan repaid on a monthly basis! Yeah, okay, you make unlawful charges on my account, charge me interest, co
  10. Hi All My wife has a Credit Card on which arrears are owed. We have been avoiding the issue admittedly. But they have snatched £253.22 from our JOINT Halifax savings account to satisfy the minimum payment owed leaving £11 for us to live on. I confronted them in branch and they said they were allowed to connect accounts in this way and sweep payments across to satisfy a debt. Can they take money in this way without prior notification? Leaving us without funds to buy food and essentials. More importantly can they do this every time money hits the account? If so, we may never eat
  11. C C Charges Down, no word from the supporters of the banks? All quiet on the Western Front, I thought so,hmmm..... Were we right? I BLOODY WELL THINK SO!!!! :)
  12. Hi This is a general question which will apply to most users of this site, so all info is welcome. Given that a specific Bank/ Card holder/Organisation ( insert your own personal nemesis here ) agrees to refund charges rather than go to court. Are they legally obliged to refund it from the acount from which it was taken? Or, are you allowed to specify the terms for repayment? If you agree to the repayment + any other terms and the method of repayment is the only sticking point, if you refuse to terminate the claim on this basis because if the refund goes to an account you cannot acces
  13. I have completed one successful action against Lloyds whilst having an overdraft of £3400 and a loan of £1000, they didn't call either in. However, have launched one new action against them and have one more ready to go, so they may do so then ( they may view me as a persistent litigant ). Will let you know. In all probability they will "Let you off" for a " first offence" which is mighty big considering they are in the wrong!!!!
  14. No really, I'm serious..... If you don't believe me try it:D
  15. It Goes Something Like This: Actual Letter Sent to Martineau Johnson:D :D : Without Prejudice Confidential and Privileged Dear MJ How nice that we are on so formal terms that you can sign yourself just so. Just one step removed from a computer generated letter, much like your client sends out for £30 plus a throw, though I daresay yours cost a little more, however, I digress. Just to let you know, and of course, your client, that I have launched Legal Proceedings in respect of post March 2006 Charges, which you should soon be in receipt of via Lloyds Banbury Branch (
