    • Thank you very much for your letter in regard to the above mentioned shipment.  Due to the high volume of parcels coursing through the courier network each day, undergoing continuous processing and handling, certain packages may experience delays or even can get lost in the course of this journey. Please note that due to the time that has passed, this shipment has been declared as lost.  I have today processed the claim and made offers to the value of £75 as a goodwill gesture without prejudice. I do acknowledge that you have mentioned in your letter that the value was higher, however, you did not take out any protection to that amount. The protection for this shipment was £20 and we will not be increasing our goodwill offer any further.    Please log into your account online in order to accept our offer. Once accepted, our accounts department will process the claim accordingly. The claim payment will be processed and received within 7 working days.                                  In addition, a refund of the carriage fee will be processed as a separate payment and will be received within 3 working days.  If I can further assist, please feel free to contact me.   I have also just noticed that yesterday afternoon they sent me an email stating that "after my request" they have refunded the cost of shipping. I did not request the refund so will mention that in my letter as well.
    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy?     • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

I hope someone can help.

 

I have been claiming ESA and went for my medical last October with a very rude nurse who said I was fine to work.

 

I made an appeal and had my tribunal hearing yesterday which I won and was told I am in no fit condition to be in a work placement.

 

My question is even though I still had to send off sick certs and was recieving 65.00 per week now my money is to rise can I claim it be back dated? Will they allow this.

Sorry if I seem a bit dumb I'm new to ESA. Would this be done automatically or do I have to request it? Even though I was still being paid will they pay the difference in amounts or the full 90 odd pounds a week?

Hello there. I wonder if you're making this a bit more complicated than it needs to be. If you've been receiving the assessment rate of £65pw, then they owe you the difference between that and what you should have received for someone either in the work-related group [WRAG] or the support group, as I understand it. So the £30 or so a week should be backdated to te beginning of week 14. This is what the directgov website says.

Weekly rate during the assessment phase

 

The assessment phase rate is paid for the first 13 weeks of your claim while a decision is made on your capability for work through the Work Capability Assessment.

Age of claimant Weekly amount A single person aged under 25 up to £53.45 A single person aged 25 and over up to £67.50Weekly rate during the main phase

 

The main phase starts from week 14 of your claim, if the Work Capability Assessment shows that your illness or disability does limit your ability to work.

Type of group Weekly amount A single person in the Work Related Activity Group up to £94.25 A single person in the Support Group up to £99.85 In most cases you will not get any money for the first three days of your claim. These are called 'waiting days'.

Depending on your circumstances you may be able to get more money if you get income-related Employment and Support Allowance.

Like I said I'm new to this so do not fully understand the ins and out. Hope if I clarify what and when I've been getting will help.

 

I started a ESA claim in August last year getting 67.50 per week.

 

I had a medical in December which was unsuccessful, so had to keep sending sick certificates to cover me and still getting 67.50 p/w, I then appealed and had my hearing yesterday which I won.

 

So are you saying I will get the difference back dated to me automatically or do I have to request that it's backdated?

You've won your appeal - it will be backdated automatically. You should be paid the difference between the assessment rate that you actually were paid, and the rate for whatever group you were placed in by the appeal tribunal. That should apply, as mentioned, from week 13 of your claim.

 

The computer system that ESA processers use should take take care of this automatically and make the appropriate payment. It's not a bad idea to chase things up with you BDC just to make sure.

Hi all,

 

Well they've only gone and done it. They've paid me whoop whoop

 

What I don't get it the rates they've paid, as per my letter

 

From 18th December 2010 your ESA will be £85.64 a week

From 31st December 2010 your ESA will be £91.16 a week

From 7th January 2011 your ESA will be £91.40 a week

from 15th April 2011 your ESA will be £94.25 a week.

 

Why all these different amounts?

Did you have any crisis loans or emergency immediate payments at any point whilst waiting for your claim to be decided?

It could be the recovery of those from your weekly entitlement. If not then I'm araid I don't know sorry.

The rates from the 7th January are your full weekly entitlement for some aged over 25 with the work related activity component. So it is the amount orior to that date which are reduced.

No pension and no loan.

 

It actually did not take long to come through, just under 3 weeks and they backdated me over £1200.

 

I was so surprised as whenever I ring or send letters they are so slow and quite thick.

 

Just so happy that they have finally got proof that I am not fit for work no thanks to that stupid ATOS 'nurse' who basically made stuff up and wrote things I didnt say.

I'm sorry I don't. Like I said this nurse just made stuff up. I was in there less than 15 mins bawling my eyes out he didn't look at me once during the whole time, didn't offer me a tissue, absolutely nothing. For 2 of the sections he gave me 0 while the courts found it in favour and awarded me 6 points each.

 

Obviously just tell the truth and when you get a copy of the report read it carefully. As my report made me laugh as most of it was full of things I never said.

Oh and try and take as much proof as you can. I took everything with me and he still declined my application.

 

My circumstances changed by the time I got the report and sent off my appeal letter with more proof but again it was declined with the words, Miss X 'alleged' changes feel she is not fit for work.

 

I took absolutely everything I had to the court and under 5 mins the decision was made

That is absolutely ridiculous. (in the sense that you were found fit for work at the assessment and were at the tribunal who overturned the decision that quick)
