    • Well we can't predict what the judge will believe. PE will say that they responded in the deadline and you will say they don't. Nobody can tell what a random DJ will decide. However if you go for an OOC settlement you should still be able to get some money
    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i am getting a phone call appointment this week as my adviser is off not well and has been for weeks can anyone give me info on what they will ask u?

got a text from ingeus from a mobile number saying "are you interested in attending and employment fair in glasgow next week? ingeus have organised an event with 50 employers and over 300 vacancies. if you would like more information reply to this message with your name and someone will call you.thanks"

 

do i have to go or is it fine to say no? as i prefer something closer to home not wanting to travel far everyday back and forward.

plus this wasnt a text from my adviser as shes off sick this was another adviser can they take numbers from other and advisers and text them even though my actual adviser is off?

 

hope to get answers soon thanks

Interested being the KEY word here - in other words you are not mandated to go, it is voluntary. If you do not want to go, don't

 

yeh didnt think u had to go but was just double checking

 

u ever been to one of these fairs or sayed no to them?

my friend just been sent a text also told him what u told me

 

see if i was to get a sanction for not going even though Mandatory Activity Notice was not giving and was only a text saying if i was interested would i easily get my sanction overturned?

They have NO RIGHT to even think about a sanction, the proof is the text message with the key word INTERESTED

Unless they send you a MAN insisting that you go to this event, you can't be sanctioned. Should they try (by sending a WP08 to JCP), explain politely to the JCP staff that as no MAN was issued, attendance should be voluntary.

yeh a foned up and sayed i wasnt interested a prefer closer to home and they try to say its a good chance for a job and then sayed the job may not even be for a couple of months etc i was thinking but why have a fair if jobs wont be for a few months would u not be better off actually putting jobs there on the fair day for people.

 

for me up and down probz take me 2 hours maybe more and all just for a fair be a waste if there isnt any jobs.

yeh most jobs these work programmes etc push u in to work but your going to be worse off and less money but they dont care even tho u struggle as it is with the money u get at the moment.

 

they need to clarify rules these days with there claimants and with job centre so u know the rules and u get given all info on what happens if u dont do this or that.

i have no problems with ingeus when they do right things but when they be sly and try anything to get your money stop then that what ****es me right off with them.

Yes, they should - but the fact is they don't want us to know the rules. They only get away with so much because a lot of claimants simply don't know the rules and so believe everything the JC and WP tell them or threaten them with. Like many here, I've been lied to by both WP and JC advisors but thanks to sites like this I'm now far more aware and can report the hell out of anyone who does it.

 

It really is vital to know the rules of the game or else you're going to get played.

 

Regarding Jobs Fairs, they most definitely are a waste of time - no concrete vacancies ever on offer, merely companies collecting CV's for God knows what purpose.

yeh i agree its like take us on for 2 year and then dont let us know the rules well to be honest they should have like a booklet u keep to show what happens if u dont do this etc etc because we dont know what we do wrong as we dont know the rules so if they know the rules then so should the claiments simple as that.

see even though you get telephone calls from ingeus are u still suppose to get text message alert about your appointment?

 

i had one the day but no text message i didnt get my call to 11 when appointment was 10 phoned up after 10 sayed i will call u back straight away but wasnt to i called them back that during the call i got a text saying missed call but was 11.03 when i was on the phone that time but my phone has been on all morning but yet supposedly i wasnt as why would i get a missed call from ingeus not my falut surely? its my network provider?

 

anyone had one of these telephone calls from ingeus but missed a call or u didn't receive the call and u foned them back?

If your advisor is off sick/holiday then someone has to do his/her job while they are off work....I mean lets face it, ingeus aren't going to leave you alone just cos your advisor is off sick now are they? :roll:

While you are at Ingeus any of the advisors can ring/text you.

 

Ingeus have no mobile number and email address, but as far as they are concerned i don't have a mobile lol

I was with them but finished my 2 years of crap last June. They hardly ever asked me in - thankfully - and on my last day I gave the advisor a piece of my mind and told them never to contact me again. I also sent in a lovely detailed complaint letter - 4 pages long - to the heads of the work programme down in Sheffield. There was one phone call a few weeks after from a different branch of Ingeus to 'see how I was doing and how can we help' and they got told the same thing too - never bother me again.

 

...they haven't ! :) Good riddance.

i got a telephone call today as my adviser is off sick and appointment was 10 and never got anything so i phoned up 15 mins later to say when i was getting this call and for the person to phone me back as my mobile credit was running out she sayed i will call u straight back and got to 10.55 i called and sayed a have been waiting on a call from 10 and this women was nice and sayed al take this and asked me stuff like what jobs a have applied for and have i been sending cvs/specs out sayed yes and during the call got a text from ingeus but was a o2 alert to say i had missed a call at 11.03 but i was still on the phone and she had to phone while i was on the phone

Just back from my appointment - painless and trouble free - my adviser doesn't even ask to see proof of my applications. Quick discussion and "see you in 2 weeks" Happy with that if it continues. They have obviously realised I do not need additional support and capable of doing stuff myself like CVs, CLs and applications and that I have 24/7 (if needed) IT at home plus a smart phone for calls and emails. So, basically, my time at INGEUS is fruitless and pointless if I am being honest.

Its the same when i go to see mine, he NEVER asks to proof what ive applied for, doesn't even ask how many ive applied for.

 

as for it being pointless and fruitless its the same for everyone, i total waste of government money if you ask me!
