    • I have recently found myself in financial difficulties and with the help of forum members in another thread regarding this, I think I can get myself sorted. My query here is how to deal with a Cifas marker that has been logged against me by one of my creditors for "evasion of payment". Admittedly yes I did get a £5000 loan with them and have not paid any payment but at the start of the year, which is when the loan landed, I realised I was going to be struggling to repay that and other debts and I contacted MCB to ask if there was any way I could extend the loan from 24 months to 36 months. I explained my situation and that I was going with a DMP and asked them if they could help me with this. They did not reply. I then emailed them again a month later explaining that my DMP was going ahead and could they confirm that the direct debit was indeed cancelled. Again, they did not reply. The DMP fell apart and so did everything else thereafter. My bank withdrew my overdraft and said I could not stay with them (I thought initially that it was because of the DMP) so I opened another account (Starling) and set up all my direct debits etc with the new bank. A month into being with the new bank, they contacted me and said they were closing my account in three months. So I started applying for other basic accounts and every single one of them either refused or revoked.  Through the help in the other thread, I requested a SAR from Cifas and discovered that I have this marker against my name for "evasion of payment". I have logged a complaint with MCB on the advice of other forum members, but my query really is do you think the marker is fair given that I did ask them for help and I did explain that I was going to be struggling financially to repay the loan over the original two years, and is there any way that I can get it removed? I fully admit that I have yet to make a payment to them and I suppose in my naivety and panic I thought if I emailed them early on they could extend the loan and help me out, but they didn't even reply  I did manage to open an account with Monzo before the marker was in place, but I am very concerned that if Monzo do what Starling did, I will have no bank account to pay my bills or get my wages paid into.  Realistically based on the information I have given here, what do you think my chances are of getting this marker removed? Any help/advice on this would be greatly appreciated x
    • Thank you dx, that is what I intend to do now. I have gone through all the SAR documents, a lot of which I am seeing for the first time! As per my previous post #116 letters and statements alleged to have been sent to me, as recorded on their system notes I have not received. Letters I have sent requesting information and account statements have not been recorded as being received by them, all were sent either by Recorded or Special Delivery. I have all the proof you menrtioned from my files for payments and from their SAR info for fees added. Thanks t
    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?

Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received a letter yesterday from Excel Counselling Services requesting that they meet with me at my address to discuss my borrowings. It says I have 48 hours to contact them or they will visit me. I assume it is 48 hours from the date of the letter which was dated 29/03/11.

 

I obviously have no desire to meet with them. I'm also a bit annoyed as I have written to Lloyds and provided a record of my outgoings and incomings and they seem to have chosen to ignore this, passed on my details to Excel and also continued to send me harassing letters, as well as call me every few days from their call centre in India.

 

As an aside, the Indian call centre has no record of what is going on in the other areas of Lloyds and had no record of a letter that Lloyds sent to me a couple of months back in response to me requesting that they put my account on hold for 28 days!

 

Anyway, my question is what do I do next with regards to Excel and with regards to Lloyds as well.

 

I have access to a printer for about the next 3 hours so am hoping to get anything I need typed up and printed by then.

Just print your name and if poss send recorded for proof of delivery taking into account the alleged time scale but there's more than a good chance they wont turn up anyway, keep a copy or two by the door just in case and shove it through the letter box

 

You're under no obligation to even talk to them let alone let them in, if they arrive and get snotty call your local Police (Not 999) and tell them you're being harassed by someone that wont leave

Do you think it's best just to leave Lloyds for now? It'd be nice if they bothered getting back to me re: my suggested payment!

 

I'd get Excel off your back first then get your paperwork together and make a formal complaint to Lloyds, I imagine you can find how to do that on thier website

The thing is you've contacted Lloyds with an offer that so far they seem to have ignored and that being the case if they started to get heavy handed when your offer was brought up again they'd look very silly

I sent a statement of my outgoings and incomings to Lloyds last month and have not yet had a response. Yesterday I received a letter from their debt collection company (Excel) requesting that I arrange a home visit with them.

 

I got some very kind help and a letter to send to Excel from someone on this forum already. That is ready to be taken to the post office.

 

I was just wondering what to do about Lloyds? Any advise appreciated greatly!

In my experience, Excel are just puppets for Lloyds TSB. What was the debt for? The reason I ask is that all Excel will offer is to turn it into a loan with 'one easy payment'.

I wouldn't worry too much, they can't come to your house without your permission, and if they do, just tell them to go away and all dealings should be in writing only.

When Excel first contacted me, the letter said that their representative had called but no one was in. This note was in an envelope, stamped, and franked. They're not too clever

but it sounds as though you're at the early stages. You will probably hear from Westcot soon.

Meanwhile I keep getting calls from their call centre in India. I usually take them. As one part of Lloyds don't talk to the other part and haven't a clue what's going on, they get confused and eventually put the calls on hold for 7 days usually. I can't take it anymore though! This week I have had the following calls:

 

4 on Friday

5 on Saturday

1 so far today

 

I haven't answered these ones as I can't bare to try and explain again to a very confused person on the phone who hasn't got a record of half of what's gone on on her computer system and is only interested in taking payment All well and good but when I don't have the money, I can't pay. I also got a letter from Excel Counselling Services last week which I posted on here about. I have written to them telling them I do not wish them to visit me and taking away their implied rights of access.

 

Has anyone got any advice please? I am at the end of my tether.

Thank you. I was sure I read that once upon a time but I wasn't sure if that was 1 or 2 times where they actually got through and I've been ignoring their calls this week.

 

It's probably not the right thing to do to ignore the calls but I see no point in speaking to them when they don't know what is going on and haven't responded to my letter.

 

I actually was asked a month or so ago by the call centre who were calling me to bring into a branch a letter that they had sent to me to prove that they had sent it because they didn't have a record of it their system. It's bad enough having to prove I sent letters to them without having to prove they've sent letters to me as well!

Write a "Do Not Call" letter and send it both to the creditor and their harrassing representative. This letter should include your name, account information, and instructions about when, where, and how they may contact you. Make sure to send this letter via registerd post so you will have evidence the letter was received, should you need proof in the future.

 

 

 

Keep a log of the harassing calls. Mark down the date and time of each call, the name of the collector who contacted you and the creditor they represent either on a calendar or in a notebook kept right next to your telephone. You can then use this log as evidence you are indeed being harassed.

While this idea may not prevent harassing calls, it will certainly help you prove their existence. Why not record the calls? And even if you aren't actually recording calls, there is nothing wrong with telling a creditor or their representative that you are. More than likely, the tone of the conversation will change considerably.

Lloyds are driving me mad - at least Mint have agreed my repayment with relative ease where as Lloyds are just being unbelievable.

i had tsame problem with barclay's and rbs after while they send dcas to yourselves i know i shouldnt of but ignored their calls and letters and i had few letters from various dca for barclays tryin to get my attention while rbs has no contact or even dca for them that least been 5 yrs i think so hopefully it statury barred for me since i'm in bonnie scotland - land of the ****ing rain lol

Do not speak to them on the phone, other than to tell them not to call and to put everything in writing. Refuse their security questions, barr the numbers if you can or change your number. They have no right to keep calling if you ask them not to, it constitutes harassment.

Keep everything in writing. You have informed them of your situation and how much you can afford to pay. You are under no obligation to provide an I&E or any other information they ask for, only a court can order this. If you can make a payment, just do this by standing order if you can. The main thing is to get them off your phone and stop this harassment.

A good tip if they ring and ask for you is to say 'I will just get them' then put the phone in a drawer, next to the TV and let them listen to 'Bargain Hunt', turn on the vacuum cleaner etc. They will soon get hacked off and get the message. You are under no obligation whatsoever to speak to them, remember that. Personally, I tell them to sod off or similar.

once i was in a funny mood i think i had few vodka n cokes when one of the dca (male ) phoned me up i started to chat the guy up asking for his number what is he wearing etc i have never seen dca lost for words haha he soon hangup i partner was ****ing herself she couldnt believe what i done but oh well

Clearly, the amount of telephone calls is not acceptable. I would follow the advice given by Cobee33 and coledog. Tell ( don't ask,tell ) LLoyds to contact you in writing only. They are obliged to do this and cannot refuse.

Tell them to leave an you do not want any further contact and send a letter saying same and telling them you will have them arrested for trespass and harassment to both Excel and to Lloyds. You do not have to let them in. I had to force them to leave as they became aggressive and hurt my shoulder. Then I told them on their answer machine what I thought of them and sent an email and letter with the same. I think they got the message.
