    • sorry but that letter needs to be much much better. you need to express that it was a stilly youthful mistake trying to be the big man and jumping the turnstile to look big infront of your peers. TfL prosecutors are on the email address on their first letter. get the court form sent back to the court , (but copy it first) stating you plead guilty and wish to attend to address the judge in person face to face to show your genuine remorse for your stupid youthful exuberance.      
    • I thought I should send the begging letter to the prosecutor. Does the hearing means the time I need to send back by? I hope that I could teach the lovely students again, which may not be allowed with a criminal record. I would please ask that you would please provide me a single opportunity to settle all outstanding sums owed outside of court without the need for legal proceedings which would have a determinantal impact on my teaching career.  I sincerely apologise again for my crime.     • Utter Rubbish!! lowell dont write and beg for deals once they start court. as for your attitude, we'll thats nothing new for you.😎 you wont be quizzed, it's not like TV, simply refer to your defence/WS when answering anything the judge may ever ask. well it involves chickens. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, I am new to this forum and I hope that this is the right place to start this thread.

 

I bought a PC in Currys/PCWorld(two companies in one big store) in Ashton-Under-Lyne. I bought it on 30/01/2010. In the end of November 2010 my PC started to shutdown itself unexpectedly. After it happened a few times, I took the PC to Currys/PCWorld(the same one which I bought it from) and they arranged a warranty repair with Techguys. My PC came back from repair in two weeks. Everything seemed to work fine after the repair for the first week. However, after the first week after the repair, my PC started doing the same thing(shutting down unexpectedly). So, again, I took the PC to Currys/PCWorld and they arranged warranty repair with Techguys again. I did not get a call from them at all, so after 28 days (this is how much they have to repair my PC) I went to Currys/PCWorld saying that I want my PC back. Then I have found out that my PC was ready more than two weeks ago, but for some unknown reason nobody called me(by the way my warranty period expired while my PC was in the second repair, but if the same thing is happening, the warranty extends for another 90 days). That made me a bit angry. Anyway, I took the PC home and I installed the software that I am using and then, again, the PC shutdown unexpectedly. So, the next day after I collected my PC from the second repair, I took it to Currys/PCWorld saying that this is the third time and that I want my money back or my PC to be replace with the new one. The manager (who by the way needs to be reported to headquarters or somewhere else for being unkind and for not caring about the customer) kept using the word 'they', meaning Techguys. What I mean is that he kept saying: 'you have to contact them', 'they have to repair it', 'they won't give you your money back' etc. I thought that I bought this PC from Currys/PCWorld and not from Techguys, but the manager seemed to think differently. Anyway, they arranged another repair with Techguys and now I have to wait another up to 28 days to get my PC back, knowing that it still might be faulty after.

 

Since it is Sunday today, there is not much I can do through the phone or by going to 'places'. By 'places' I mean Citizen Advice Bureau, who hopefully will help me. So, today I am asking you guys, what I can do in this situation. All I want is my money back or new PC. To be honest, I would rather prefer the first option, because I don't want to have anything to do with Currys/PCWorld anymore.

 

Any help appreciated

Hi. welcome to CAG.

 

Don't worry about CAB. Speak to Trading Standards first. Get a complaint logged.

 

We had a similar situation with Comets. You maybe should change your stance to "I have no faith in your equipment or your repairs - therefore, I want my money back!". It doesn't matter that it's out of warranty period, you can demonstrate that the issue was there before the period expired.

 

We had to issue a court claim but they settled the day before the hearing.

you are in a great position.

 

over a year old and repaired 3-4 times? sorry not good enough.

they obviously cannot effectively repair it, it MUST be replaced.

 

if you want a refund you will need to go down the inherrantly faulty route, which you have a good shot at considering the history of the unit.

 

however the SOGA does state you cannot refuse a repair after 3 months, but the store have to remedy your situation within a reasonable time frame, im suggesting that after 3-4 repairs they are unable to do so, it now needs replacing or refunding as not of merchantable quality.

 

good luck, they can be stubborn buggers.

how the hell do you start a thread on this site!!! am i being dumb here!!!! but im a member of loads of sites like this and can instantly get there within 20 seconds!!! i have so much juice on currys ( EDIT ) tell me! a new thread...simple me thinks not on this site!

I have just taken currys to court and IT is my business.

They are impossible i found they did not respond to myself and my solicitor.

I suggest you send recorded delivery letter to the store and DSG headquarters asking for your money back and letter before action.

Did you finance the machine?

I would make sure you keep all the slips from when it was repaired and dates as it is obvious it is not fit for purpose.

I would just use small claims as they will not listen until court papers are issued.

Thanks for all the replies and sorry for not being online for a long time.

Anyway, my PC is still in the third repair. I went to Citizen Advice Bureau, since it is close to my house, and they gave me a leaflet containing Sales Of Goods Act facts. So, if my PC isn't repaired after this repair, I am going to go to the store and show them this leaflet and ask for either replacement or refund. By the way, the next time I go to this store I am only going to talk to a proper manager (the guy described in first post is not the highest rank in the store; it turned out he's a supervisor).

 

Although, it seems like a good plan, which should work, I have a feeling that even the proper manager will refuse to give a replacement or refund. What can I do then? I was thinking about court, but I don't know how it looks like and what I would have to do exactly and what costs I would have to cover(Do you have to pay for the court?).

Ensure you mention the CAB when you get out the leaflet, that will show that you aren't going to be a pushover.

 

As for a court claim, you value what you think the computer is worth and then issue a claim here https://www.moneyclaim.gov.uk/web/mcol/welcome all done online.

 

It will cost you about £35 but you will get this back when you win.

There is a CAB logo on the leaflet, but anyway I will tell them I have seen an advisor and that's where I have got it from.

 

You said it costs £35, but I get it back when I win. But what happens, if I don't win. Do I have to cover any additional cost or they will just keep this £35? And also do I need a lawyer, do I actually go to court or is it all online somehow? Sorry if these questions are a bit silly, but I have never had anything to do with court before.

Yes, finally it's over.

As I have written in my previous posts, I left my PC with Currys/Techguys for the third time. And yesterday, 28 days has passed since I left it there. So, I went to the store and gave them documents and said to them that I am here to collect my PC(not knowing whether it is actually in store yet). So, the guy from KNOWHOW(that's the new name of Techguys apparently or Currys is not with Techguys anymore and now is with KNOWHOW, which might be totally different company) walked up to some lady who had a Currys t-shirt(she was hired by Currys and that guy was hired by KNOWHOW) and they started talking. I couldn't hear what they were talking about, but from looking at their faces I could tell that something is wrong. After a few minutes, he walked up to me and said 'We had your PC back from Techguys, but I was all broken into pieces, which probably happened during the transport. I know that 28 days is gone now, so you can go and choose a computer, which price is the same as the one you bought last year'. So, basically I spend 550 pounds last year on PC and now I had the same amount of money to spend on a new one with better hardware of course. I have chosen the PC that I liked and I have covered the difference, because it was more than 550 pounds.

 

I just thought I'll share this story with you, to prove that there's always hope and chance that everything will sort out in a good way.
