    • Under the consumer rights act 2015, if a defect manifests itself within 30 days and you have a right to return the vehicle for a full refund. If any defect manifests itself within the first six months of ownership then you have a right to return the vehicle for a full refund subject to the retailers right to carry out a repair. If the retailer declines to repair or if the repair fails then you have the right to return. The problem here is that you have to assert their right. It's a bit ridiculous – but you have to do let them know preferably in writing that you are asserting your rights under the consumer rights act either the 30 day right or the six month right. I suppose that you haven't done this – which would be quite understandable because most people don't know that these rights exist and that they are subject to these conditions – the condition that the right must be inserted. It is frankly ridiculous. The dealers know it and we have lots of instances of this company delaying appointments et cetera and our strong suspicion is that they are simply trying to run their customers out of time. On the basis that you haven't asserted your rights, we now have to look to ordinary contract law. You are entitled to purchase a vehicle which is of satisfactory condition and which remains that way for a reasonable period of time. Clearly it is in satisfactory. They are blaming you. Has your independent inspection identified the reason for the defect? This will be important because as you have seen BMW are already saying it is down to your driving and you are going to have to produce evidence that it wasn't down to your driving and the you drove it absolutely reasonably and it was simply the condition of the car. Have you been without the car for any period of time. Is it driveable now? If the car was off the road for a substantial amount of time and was still off the road then you would be able to argue that this is a fundamental breach of contract and that you have been deprived of substantially the whole benefit of the contract and therefore you will be entitled to treat the contract as breached by Big Motoring World and insist on cancelling the contract. It may be that you will eventually be obliged to keep the car but have the repairs paid for. Have you had any quotations for the work that needs doing? I asked you questions about the MOT – but you haven't responded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Every Sunday I feel like jumping off a high building..........why is Britain so damn boring with Sunday being the worse ever day for boredom............having lived abroad for 4 years in places that were buzzin on a Sunday ...this place is soooo boring...I dont drink so I dont go to pubs and the like......dont fancy going to the local church either......so what does one do?? :madgrin::madgrin:

 

There is sod all for people to do in this country except browse the shops or sit in a beer garden and if you dont have any money it makes your depression doubly worse........if I had the money I would leave this place again tomorrow but unfortunately Im stuck here now....rows and rows of houses as far as the eye can see but no places of entertainment or socialising.....then again I suppose if the council try to build places they get residents shouting their heads off and trying to get them stopped.....boring boring boring cant wait to save up and get the hell out before I galvanize with boredom. :sad:

You must hate Christmas then. Because Christmas Day is like one really really bad Sunday every year. I should know. I was born on the wretched day. Just in case anyone missed it on other threads.

Or have children and spend your weekends taking the kids to swimming, Gym and dance lessons or freezing on Rugby / football fields then you will wish for a boring Sunday to do nothing :-)

Excuse me I have children but they are grown with their own lives and live in other parts of the country to which I cant go because Im supposed to be on standby looking for work in my own area. :madgrin:

 

Ten pin bowling - where ?

Art Galleries -seen them

Hiking / walking - great go walking in the woods alone or up hills alone really entertain! lol

Swimming = cant swim

Concert (In the summer free ones in the park) = no concerts where I live

Horse shows = why would I want to go to a horse show unless I had a horse?

Dog shows = dont like dogs?

Car / Bike shows = dont own a car and not interested in bikes

Flower shows = dont have a garden and not interested in anyone elses.

Invite friends around for dinner = friends usually visiting their own families on a sunday

The Laundrette is a busy place on a Sunday.= got a washing machine

I'm on my own and there are lots of things to do, if you knit or crochet there might be a local group you can join, I go to one in a nearby town, combine it with a shopping trip and lunch out then afternoon tea and knitting/crocheting/gossiping, breaks the monotony of a normal month.

 

The local hotel near me has a gym and swimming pool, and I am currently having swimming lessons at aget 53, I can do front crawl no problem but breast stroke has always defeated me....

 

One of my favourite ways of spending Sunday is crashed out on the sofa in front of the tv with a pile of films to watch and some needlework, with a pc nearby should I want to listen to some music instead.

I confess I do have a gym membership and I go and there on a Sunday.....

 

Wish I had a love of knitting and crocheting but I dont...

 

Having come back from abroad I dont have a TV connected up yet so I end up watching DVDS in the evening Ive watched a thousand times before....I could almost act them.....hey that's an idea what about acting societies ? Perhaps I should start a group up! :-D

Just to add a little to this thread, vat has risen by 2.5%

So if something was £85.20 before vat, it would cost £100.11. It will now cost £102.12.

The rise is not this vast thing that people are making it out to be.

Still, that's off topic a little, and although not just the vat rise... money is scarse!

 

My philosophy is to do something once in a while that is a little out of my comfort zone. There are lots of things going off that maybe you fancy but don't know how other people there will be. I went to a pub that has a poker night last week. Before that I had only played poker online, and I don't drink, so that was the 1st time I've been to a pub alone! I had a great time, broke even on the night as I came 2nd in one of the games which covered my entry fee and j2o's LOL.

 

I'm working on a comedy routine with a friend and we plan on going to an open mic night. I'm writing material and he's gonna go on stage! We're both nervous, but we're gonna have a laugh. I've got the last joke... just incase he totally bombs :p "Comedy eh? The only thing that if you screw up nobody laughs!"

 

Hope someone finds some inspiration to take nike's advice and "Just do it!"

I love light sci-fi! Have you read the "Dune" books by Frank Herbert? I loved them! If you still want to fill in a couple of Sundays, get them from your library.

I saw the film Dune.....yes I love SCI FI..always have my kids think Im mad......I used to like Babylon 5 and all those kind of things. Im watching a load of Stargate now and Ive got some old Star Trek DVDS...8)
