hi there i had my date fr my esa tribunal and the day before (yes the day before) i got a letter form them saying it was cancelled by the judge due to someone on the pannal being familiar with my case ( a doctor) i called my surgery up and they said sometime my doctor doe the esa tribal

 

anyone else ever had this??

Hello there. I haven't seen this, but I can understand that if the doctor already knows you, it would be a conflict of interest. It could be that they only received the papers from the DWP a couple of days before the hearing, so it was realised late on that there was a problem. I hope they're going to call you in another time with a different doctor?

yes got another appointment for next year which mean it will be over a year since they stopped my benefit and i appealed

 

when i get another ATOS medical which ill be soon as its been over a year now since my last one can i request the medical examiners qualifications?? and contact the general medical council and the dwp to welt them know i am doing this the only reason i ask is at my last one the person had not what i suffer with or anything about my disorders and they fact they never looked ta any evidence i brought with me i dont want to have to go through the same thing again next year you see i want to make sure the person im seeing knows about my disorder

Hello again. I'm not sure about some of your points, but from being on the forum, I don't think we have too many rights in all this process. Hopefully, someone will be along soon to comment.

Unfortunately, there is no right to be seen by someone who has specialist knowledge of your condition. Only a right to be seen by someone trained in the assessment of capability for work as far as is required for ESA. You have no right to see the qualifications of an individual, as this is personal data. But you can look them up on the GMC or NMC to see if they are on the specialist register; that will also tell you what area the specliaise in.

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. If requested, I will provide a link where possible to relevant legislation or guidance, so that advice provided can be confirmed and I do encourage others to follow those links for their own peace of mind. Sometimes my advice is not what people necesserily want to hear, but I will advise on facts as I know them - although it may not be what a person wants to hear it helps to know where you stand. Hi

I have two ESA appeals oustanding one from 12 months ago and one 17 months old. No sign of a tirbunal date in ether case

 

.....And what is your point please, roblynmouth? The time taken to go to appeal depends on where you live. I think most of us know that it isn't quick.
